AN ORDINANCE GRANTING A ZONING MAP AMENDMENT AND A CONDITIONAL USE FOR A PLANNED UNIT DEVELOPMENT WITH SENIOR HOUSING FOR PROPERTY LOCATED AT 1101- 1111 LINNEMAN ROAD, MOUNT PROSPECT, ILLINOIS WHEREAS, David Simon of ISL Ventures, ("Petitioner'), has filed a petition for a zoning map amendment of Lot 2 of the proposed "Mount Prospect Senior Living Subdivision" from R -X to R-4 and a Conditional Use for a Preliminary Planned Unit Development (PUD), consisting of one (1) principal building used for senior housing for property located at 1101-1111 Linneman Road in the Village of Mount Prospect, Illinois ("Property) and legally described as: LOT 2 IN COURTS OF ST. JOHN, BEING A SUBDIVISION OF PART OF THE WEST HALF OF THE NORTH HALF OF THE SOUTHEAST QUARTER OF SECTION 14, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED ON AUGUST 21, 1986, AS DOCUMENT NUMBER 86368276, ALL IN COOK COUNTY, ILLINOIS Property Index Number: 08-14-401-151-0000; and WHEREAS, the Petitioner proposes to construct one (1) principal building consisting of eighty-eight (88) senior housing dwelling units on the site comprised of both memory care and assisted living units; and WHEREAS, a Public Hearing was held on the request for rezoning being the subject of PZ -19-18, before the Planning and Zoning Commission of the Village of Mount Prospect on the 25th day of October, 2018, pursuant to proper legal notice having been published in the Daily Herald Newspaper on the 10th day of October, 2018; and WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of PZ -19-18; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use permit and would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect approve a zoning map amendment for Lot 2 of the proposed "Mount Prospect Senior Living Subdivision from R -X to R-4 and grant a Conditional Use for a preliminary planned unit development consisting of one (1) principal building, subject to compliance with the following conditions prior to final PUD approval: Fire hydrants shall be provided on the west side of the site/building; Submittal of a landscape, irrigation, and photometric plan that meet the intent of the Village Code requirements; Compliance with all applicable development, fire, building, and other Village Codes and regulations; and A building permit, in accordance with the current regulations and requirements of the Village of Mount Prospect, must be issued within one (1) year from the date of adoption of the enabling ordinance by the Village Board which authorized the development proposal." SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
