HomeMy WebLinkAboutOrd 5023 05/18/1999 ORDINANCE NO. 5023 AN ORDINANCE AMENDING CHAPTER 14 (ZONING) OF THE VILLAGE CODE OF MOUNT PROSPECT Passed and approved by the President and Board of Trustees the 18th day of May, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 19th day of May, 1999 V~NL/ 5/10/99 5/11/99 5/19/99 ORDINANCE NO. 5023 AN ORDINANCE AMENDING CHAPTER 14 (ZONING) OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, the Petitioner (Board of Trustees of the Village of Mount Prospect) have filed an application for certain text amendments to Chapter 14 (Zoning) of the Village Code of Mount Prospect to amend regulations relative to front pomh encroachments into front yard setbacks in residential zoning districts; and WHEREAS, the Petitioner seeks amendments to the following Sections of the Village Code: Section 14.803 R-X District Section 14.903 R-1 District Section 14.1003 R-A Distdct Section 14.1103 R-2 District Section 14.1203 R-3 District Section 14.1303 R-4 Distdct Section 14.2401 Definitions WHEREAS, a Public Hearing was held on the proposed amendments, being the subject of ZBA Case No. 06-99, before the Zoning Board of Appeals on April 22, 1999, pursuant to due and proper legal notice having been published in the Mount Prospect Journal and Topics on the 7~ day of April, 1999; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given consideration to the requests being the subject of ZBA 06-99. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. Page 2 of 3 Porches SECTION TWO: That Section 14.803.A entitled "Conditional Uses" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front pomhes attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." SECTION THREE: That Section 14.903.A entitled "R-1 District" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front porches attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." SECTION FOUR: That Section 14.1003.A entitled "R-A District" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front porches attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." SECTION FIVE: That Section 14.1103.A entitled "R-2 District" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front porches attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." SECTION SlX: That Section 14.1203 entitled "R-3 District" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front porches attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." Page 3 of 3 Porches SECTION SEVEN: That Section 14.1303.A entitled "R-A District" of Chapter 14 (Zoning), as amended, is hereby further amended by adding to the list of Conditional Uses the following: "Unenclosed front porches attached to single-family residences, with an approved Certificate of Occupancy as of May 18, 1999, encroaching up to five feet (5') into front setbacks." SECTION EIGHT: That Section 14.2401 entitled "Definitions" of Chapter 14 (Zoning), as amended, is further amended by adding a definition of unenclosed porch which shall be inserted in the proper alphabetical sequence and shall be and read as follows: "UNENCLOSED PORCH. A roofed, open structure, without walls, screens, or windows, attached to and part of a structure, with direct access to and from the structure." SECTION NINE: That this Ordinance shall be in full fome and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
