Information
The Petitioner, Nick Papanicholas Jr. of Pima 4, LLC, is seeking a conditional use to operate a sports training and teaching
establishment on the parcel located at 431 Lakeview Court (The "Subject Property").
The Subject Property is located at the end of Lakeview Court and is zoned Il Limited Industrial District. The Subject Property
includes an existing 82,289 square foot manufacturing and warehouse building with related improvements. The Petitioner is
seeking a conditional use to operate a sports training and teaching establishment on the Subject Property. The proposed use
would occupy 14,840 square feet of the existing building; no exterior alterations are proposed. The Petitioner states that the
proposed use will not be a detriment to, or endanger the welfare of, the general public. The proposed MPI Sports Development
Center will be a benefit to the public by providing a safe and controlled environment for the teaching and advancement of
sports development for clubs and organizations. The Petitioner states that the MPI Sports Development Center will have no
negative impacts on adjacent properties nor will it impair property values. Minor flooring changes and the construction of locker
rooms will be required and granting a conditional use for a sports teaching facility will not prevent other sites to orderly
develop. The Petitioner states that the facility will be a benefit to the community and will be bring participants from around the
Chicagoland area to the Village of Mount Prospect to participate at a leading training facility.
Staff has reviewed the Petitioner's request and is supportive. Other departments reviewed the Petitioner's proposal and did not
object to the use or find that it would have an adverse impact on the adjacent properties. Conditional uses for similar sports
training facilities have been approved for several properties in the Village including 520, 550, and 900 Business Center Drive
and 600 Wheeling Road. The Village most recently approved a similar request at 1900 - 1980 Carboy Road in 2017 (PZ -09-17).
Staff has not received any comment on the requested conditional use. The Planning and Zoning Commission voted to approve
the project by a vote of 5-0, subject to the conditions in the staff report.

Standards
Conditional Use - No conditional use shall be recommended for approval by the planning and zoning
commission unless it finds:
1. That the establishment, maintenance, or operation of the conditional use will not be detrimental to, or
endanger the public health, safety, morals, comfort, or general welfare;
2. That the conditional use will not be injurious to the uses and enjoyment of other property in the immediate
vicinity for the purposes already permitted, nor substantially diminish and impair property values within
the neighborhood in which it is to be located;
3. That the establishment of the conditional use will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district;
4. That adequate public utilities, access roads, drainage and/or necessary facilities have been or will be
provided;
5. That adequate measures have been or will be taken to provide ingress and egress so designed as to
minimize traffic congestion in the public streets;
6. That the proposed conditional use is not contrary to the objectives of the current Comprehensive Plan for
the Village; and
7. That the conditional use shall, in all other respects, conform to the applicable regulations of the district in
which it is located, except as such regulations may, in each instance, be modified pursuant to the
recommendations of the Planning & Zoning Commission.
Variation - A variation from the zoning regulations shall not be granted or recommended for approval by the
Planning and Zoning Commission unless findings of fact based on evidence are made in each specific case that
affirm the following standards:
1. Because of the particular physical surroundings, shape, or topographical conditions of the specific
property involved, a specific hardship to the owner would result, as distinguished from a mere
inconvenience if the strict letter of the regulations was to be applied;
2. The conditions upon which an application for a variation are based are unique to the property for which
the variation is sought and are not generally applicable to other property within the same zoning
classification;
3. The purpose of the variation is not based primarily upon a desire to increase financial gain;
4. The alleged difficulty or hardship is caused by this Chapter and has not been created by any person
presently having an interest in the property;
5. The granting of the variation will not be detrimental to the public welfare or injurious to other property or
improvements in the neighborhood in which the property is located;
6. The granting of the variation will not alter the essential character of the neighborhood; and
7. The proposed variation will not impair an adequate supply of light and air to adjacent property or
substantially increase the congestion of the public streets, or increase the danger of fire, or impair natural
drainage or create drainage problems on adjacent properties, or endanger the public safety, or
substantially diminish or impair property values within the neighborhood.

Purpose of operation: Mount Prospect Ice Arena has outgrown its existing 5,000 SF "off -ice"
sports development area located within the existing Mount Prospect Ice Arena. To respond to
current demand from our clubs & organizations MP Ice Arena has launched MPI Sports
Development Center which will be a multi-purpose athletic training and performance
operation. Primary users within this center will be existing clubs & organizations skating at MP
Ice Arena: Northwest Chargers, Glenview Stars, Saint Viator High School, Notre Dame College
Prep just to name a few.

A public hearing has been scheduled for the September 13, 2018 Planning & Zoning Commission meeting to review
the application by Pima 4, LLC (the "Petitioner"), regarding the property located at 431 Lakeview Court (the
"Subject Property"). The Petitioner is seeking conditional use approval to operate a sports training and teaching
establishment. The P&Z Commission hearing was properly noticed in the August 29, 2018 edition of the Daily
Herald newspaper. In addition, the Petitioner has completed the required written notice to property owners within
250 -feet and staff posted a public hearing sign on the Subject Property.
PROPERTY DESCRIPTION
The Subject Property is located at the end of Lakeview Court and includes an 82,289 square foot manufacturing
and warehouse building with related improvements. The Subject Property is zoned I1 Limited Industrial and is
bordered to the west, north, and east by the 11 Limited Industrial District and to the south by the R1 Single Family
Residence District.
SUMMARY OF PROPOSAL
A sports training and teaching establishment requires conditional use approval in the I1 District. The proposed floor
plan indicates that several different flooring types (turf, hardwood, and rubber) will be installed to facilitate teaching
multiple sports at the same time. Areas for basketball/drills, hockey skills, fitness/P.T., restrooms, lockers, and
shower areas are proposed. A reception area, small office, and ready area are also proposed.
Hours of operation are estimated as follows:
Monday — Sunday: 7:00am — 10:00pm
Class sizes will vary, with a maximum of one hundred (100) athletes and two (2) staff during operational hours.
The Petitioner states that the Mount Prospect Ice Arena has outgrown its existing 5,000 square foot "off -ice" sports
development area at 1501 Feehanville Drive, which received conditional use approval in 2016. The proposed
conditional use is a response to current demand from clubs and organizations skating at the Mount Prospect Ice
Arena.

PARKING
Based on the peak number of employees and athletes anticipated, the sports training and teaching establishment
will require a total of one hundred one (101) parking spaces. This is in addition to the ninety (90) spaces required
by all other current vacancies in the multi -tenant building, totaling one hundred ninety-one (191) required spaces.
The Plat of Survey indicates three hundred thirty-five (335) standard parking spaces with eleven (11) accessible
parking spaces are on site. The following table summarizes the parking requirement for 431 Lakeview Court:

ADDITIONAL STAFF COMMENTS
Fire — An egress plan including occupant loads, travel distances, egress widths, and common path of travel distances
will be required when the building plans are submitted for review. Further, a fire sprinkler system in accordance
with NFPA 13 and an alarm system will be required. Fire sprinkler shop drawings, hydraulic calculations, fire alarm
shop drawings with point to point wiring diagrams, battery load calculations, and equipment cut sheets will be
required at time of building permit plan submittal. While these are issues to be addressed as part of the building
permit process, these requirements are included as part of the Staff Report in an effort to ensure the Petitioner is
aware of the requirements and submits the necessary documentation.
CONDITIONAL USE STANDARDS
The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include
seven specific findings that must be made in order to approve a conditional use. The following list is a summary
of these findings:
• The conditional use will not have a detrimental impact on the public health, safety, morals, comfort or
general welfare;
• The conditional use will not be injurious to the use, enjoyment, or value of other properties in the vicinity
or impede the orderly development of those properties;
• There is adequate provision for utilities, drainage, and design of access and egress to minimize congestion
on Village streets; and
• The request is in compliance of the conditional use with the provisions of the Comprehensive Plan, Zoning
Code, and other Village Ordinances.

RECOMMENDATION
Staff believes the sports training and teaching establishment meets the conditional use standards subject to
complying with the conditions listed below and that granting such request would be in the best interest of the
Village. Based on these findings, Staff recommends that the Planning & Zoning Commission recommend approval
of the following motion:
"To approve a Conditional Use permit for a sports training and teaching establishment at 431 Lakeview Court,
subject to the following condition:
1) Compliance with all applicable Village Code requirements, including, but not limited to, fire code,
lighting regulations, sign code regulations, and building regulations."
The Village Board's decision is final for this case.

Chairman Donnelly called the meeting to order at 7:01 pm. Commissioner Fitzgerald made a
motion seconded by Commissioner Otteman to approve the minutes from the Planning and Zoning
Commission meeting on August 23, 2018. The minutes were approved 4-0 with Commissioner
Beattie abstaining. Chairman Donnelly introduced case, PZ -16-18 as 431 Lakeview Court and
stated this case is Village Board final.
Mr. Shallcross gave a brief description of the Subject Property and summarized the Conditional
Use request. He explained the comments from the Fire Department requiring an egress plan
including occupant loads, travel distance, egress widths, and common path of travel distances.
He further stated, per the petitioner, The MPI Sports Development Center will be a benefit to the
public by providing a safe and controlled environment for the teaching and advancement of sports
development for clubs and organizations. The Petitioner states that the MPI Sports Development
Center will have no negative impacts on adjacent properties nor will it impair property values.
Minor flooring changes and the construction of locker rooms will be required and granting a

conditional use for a sports teaching facility will not prevent other sites to orderly develop. The
Petitioner states that the MPI Sports Development Center will be a benefit to the community and
will help bring participants from around the Chicagoland area to the Village of Mount Prospect to
participate at a leading training facility.
Mr. Shallcross stated, Staff believes the sports training and teaching establishment meets the
conditional use standards subject to complying with the conditions listed below and that granting
such request would be in the best interest of the Village. Based on these findings, Staff
recommends that the Planning & Zoning Commission recommend approval of the following
motion:
"To approve a Conditional Use permit for a sports training and teaching establishment at 431
Lakeview Court, subject to the following condition:
1) Compliance with all applicable Village Code requirements, including, but not limited
to, fire code, lighting regulations, sign code regulations, and building regulations."
The Village Board's decision is final for this case.
The Planning and Zoning Commission had no questions for Staff.
Chairman Donnelly swore in Scott Richards of 11246 Fleetwood Street, Huntley Illinois.
Mr. Richards introduced himself as the Project Manager of the project and gave a brief overview
of the proposal.
Chairman Donnelly asked if the proposed use was mostly to be utilized by children.
Mr. Richards confirmed that the purpose of the space is to be used by children. The majority of
the teams are of adolescent age through early high school.
Chairman Donnelly asked if Mr. Richards was amenable to the conditions recommended by staff.
Mr. Richards stated he was fine with the conditions.
Commissioner Beattie asked if tables and physical therapists would be hired to provide services to
organizations who rent the space.
Mr. Richards stated that no physical therapists will be employed at the Subject Property.
Commissioner Beattie asked for a description of the material used in the hockey skills training
area.
Mr. Richards stated that the proposed flooring is a rubber material commonly used in hockey
training facilities. He stated that it allows athletes to practice shooting while not needing to skate
to do so.

Commissioner Fitzgerald asked if the company would ever need to expand into adjacent vacant
space in the building due to growth.
Mr. Richards stated that the one hundred (100) students listed in the supplemental materials
provided were a best case scenario that would likely be built to over time. He stated that ideally
the adjacent vacant spaces would be filled with other tenants before MPI Sports would ever need
to expand.
Commissioner Fitzgerald asked about other users who might lease the vacant spaces in the
building.
Mr. Richards stated that potential users include warehouse businesses and storage facilities that
would not require a zoning request to be approved. Mr. Richards stated that build -outs of other
vacant spaces in the building are forthcoming to accommodate new tenants.
Hearing no further discussion from the board, Commissioner Beattie made a motion seconded by
Commissioner Fitzgerald to approve the following motions:
A conditional use permit for a sports training and teaching establishment at 431
Lakeview Court, subject to the following condition:
a. Compliance with all applicable Village Code requirements, including, but not
limited to, fire code, lighting regulations, sign code regulations, and building
regulations.

WHEREAS, Nick Papanicholas, Jr. of Pima 4, LLC ("Petitioner') has filed a petition for a Conditional
Use permit with respect to property located at 431 Lakeview Court, ("Property") and legally described as
follows:
LOT 506 IN KENSINGTON CENTER -RESUBDIVISION TWENTY SIX, A RESUBDIVISION
OF LOTS 503 AND 504 IN KENSINGTON CENTER-RESUBDIVISON 22 IN PART OF THE
NORTHEAST'/4 OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11, EAST OF THE
THIRD PRINCIPAL MERIDIAN, ACCORIDNG TO PLAT THEREOF FILED ON MARCH 30,
31989 AS LR3782933, IN COOK COUNTY ILLINOIS.

WHEREAS, the Petitioner seeks a Conditional Use permit to operate a sports training and teaching
establishment on the parcel located at 431 Lakeview Court; and
WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being the subject
of PZ -16-18 before the Planning and Zoning Commission of the Village of Mount Prospect on the 13th
day of September, 2018, pursuant to proper legal notice having been published in the Daily Herald
Newspaper on the 19th day of August, 2018; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to
the Mayor and Board of Trustees in support of the request being the subject of PZ -16-18; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given
consideration to the request herein and have determined that the same meets the standards of the
Village and that the granting of the proposed Conditional Use permit would be in the best interest of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF
THEIR HOME RULE POWERS:
SECTION ONE: The recitals set forth are incorporated as findings of fact by the Mayor and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect do hereby grant a
Conditional Use permit, to allow petitioner to operate a sports training facility and teaching
establishment at 431 Lakeview Court, as shown on the Land Survey a copy of which is attached and
made a part of this Ordinance as Exhibit "A".
SECTION THREE: The Village Clerk is hereby authorized and directed to record a certified copy of this
Ordinance with the Recorder of Deeds of Cook County.
SECTION FOUR This Ordinance shall be in full force and effect from and after its passage, approval
