NEW BUSINESS 7.1 1st reading of an ORDINANCE AMENDING CHAPTER 9 OF THE VILLAGE CODE RELATIVE TO THE PERMITTING, REGULATION, AND DEPLOYMENT OF SMALL CELL WIRELESS FACILITIES. Mallory Milluzzi, attorney for Klein, Thorpe and Jenkins, presented the ordinance that adds a new chapter to the Village Code in order to regulate the permitting and deployment of small wireless facility installations consistent with the requirements of the Small Wireless Facilities Deployment Act signed into law by Governor Rauner on April 12, https://www.boarddocs.com/il/vomp/Board.nsf/Public 8/20/2018 BoardDocs® Pro Page 2 of 3 2018. Ms. Milluzzi provided an overview of the proposed ordinance and recommended to waive the second reading and adopt the ordinance this evening. Ms. Milluzzi stated small wireless facilities ("small cell') are attached to utility and other poles. These facilities provide the transmission of data and wireless communication to and from a wireless device. Ms. Milluzzi stated the need for this has increased over time as the amount of data we are sharing and streaming grows. The telecommunications plan to roll out of a 5G telecommunications network using small wireless installations attached to utility and other polls with minimal input from municipalities as to where the installations are sited. a, Ms. Milluzzi stated the Act limits the local authorities ability to regulate the installation of small wireless facilities. ThC Act allows the placement of small wireless facilities on municipal utility poles of a telecommunication provider's ••. Ms. Milluzzi provided areas where a municipality can specify certain limits: • Permit requirements • Agreement between the Village and small wireless facilities • Imposing Collocation requirements Providing for alternate placing of small cells on new poles where possible implementing height limitations on existing poles and/or new poles • Implementing permit fees (within the limits of the Act) • Implementing annual rates for each small cell located on Village -owned poles Requiring indemnification protection for the Village Requiring the Village to be named as an additional insured party Ms. Milluzzi provided the following in response to questions from the Village Board: • Existing poles can be extended by 10 feet; Village will have authorization to deny or approve based on the integrity and balance of the pole. If applicant chooses to replace a pole, it will be done at the telecommunication provider's expense. • Design standard will be further developed • There is a $200/year annual fee or "rent" per small wireless facility • Annual inspections protocols already in place will be followed • Right-of-way definition includes utility easements • As need for small cell wireless facilities increase, amendments to Chapter 14 (Zoning)of the Village Code will be needed. VILLAGE MANAGER'S REPORT 8.1 Motion to accept joint purchasing bid results for the purchase of one (1) 75f000 LBS. In -Ground, Truck Lift in an amount not to exceed $147,403.97. Public Works Director Sean Dorsey presented background information, staff recommendation and answered questions from staff. Mr. Dorsey stated the public works facility maintains two (2) in -ground lifts in the vehicle maintenance area. Both lifts ire approaching thirty (30) years of service and funds are available to replace one of the lifts. The other lift is scheduled for replacement in 2019. The average, '• life expectancy is twenty (20) years. Due to staff's ittention to effective maintenance of these lifts, they have exceeded their life span. However, maintenance issues have increased recently, causing down time and increased repair costs. The proposed new lift offers increased lift capacity of 75,000 lbs.; the existing has a lift capacity of 54,000 lbs. Motion by Paul Hoefert, second by Michael Zadel to accept the Sourcewell joint purchasing bid result (contract award #061015 -RRL) and authorize the purchase and installation of one (1) new Rotary model 10210C, 75,000 lbs. power unit with motors and requisite accessories, from Rotary Lift, of Madison, IN. at a cost not to exceed $147,403.97.
