Information
The Illinois Department of Transportation (IDOT) has scheduled resurfacing of Central Road between Arlington Heights
Road and Rand Road. Central Road is owned by the State of Illinois. The section of roadway between Arthur Avenue
and Rand Road is within the corporate limits of the Village of Mount Prospect. Primarily, the scope of work will include
milling the existing pavement, resurfacing, spot curb replacement, structure adjustments, minor storm sewer repairs,
and pavement striping. No street reconstruction or full-depth pavement repairs are anticipated.
The bid opening for this project is scheduled for April 27, 2018. Construction is expected to start this summer and be
completed by the end of the year. The scope of work includes grinding off the existing asphalt, installing new asphalt
surface, intermittent curb replacement, sidewalk ramp improvements, pavement striping, and structure adjustments.
The total estimated project cost is $2,790,855.
The contract for this work will be let and administered by IDOT. However, it contains a number of elements that
require Village financial participation including brick paver sidewalk work, a pedestrian crossing signal installation at
the intersection of Central Road and Arthur Avenue, and pavement widening on Mount Prospect Road.
Brick Paver Sidewalk Ramps
The proposed improvements will include removal and replacement of existing American with Disabilities Act (ADA) -
required sidewalk ramps in the downtown area. Many of these existing ramps are comprised of decorative brick
pavers installed as part of Village streetscape projects. Although fairly new (installed in the 1990s and early 2000s),
these ramps do not comply with current ADA sidewalk ramp slope and detectable warning requirements.

When IDOT performs roadway improvements, they require sidewalk ramps be brought into compliance with current
federal standards.
Normally, IDOT bears the full cost of replacing concrete sidewalk ramps. However, they do not pay for
upgraded materials such as brick pavers. Local agencies are required to pay for material and design upgrades (i.e.
anything other than a standard concrete sidewalk).
Because brick pavers are utilized at some of the intersections in the project area, the Village is required to pay the
differential cost of replacing sidewalk ramps and approaches with brick pavers instead of concrete. If the Village
declines to participate in this manner, the existing bricks will be removed and replaced with standard concrete
sidewalk. Attachment A contains a map depicting impacted intersections.
Pedestrian Crossing Signal
In addition, IDOT has agreed to include pedestrian signal crossing upgrades at Central Road and Arthur Avenue
pursuant to a joint request from the Village of Arlington Heights and the Village of Mount Prospect. Previously,
Arlington Heights, and the Village entered into an intergovernmental agreement (IGA) defining the scope of work and
distribution of costs for these improvements. Pursuant to the terms of this agreement, the Village will serve as the
lead local agency initially responsible for the cost of construction. One-third (1/3) of costs expended on these
improvements will be recovered from the Village of Arlington Heights upon project completion. For reference, a copy
of the Arlington Heights IGA is attached (Attachment B).
Originally, the premise of the IGA with Arlington Heights assumed the improvements would be constructed as a stand-
alone project. Accordingly, the scope of work included installation of pedestrian signals, signage, and pavement
markings as well as requisite curb, pavement, and sidewalk ramp necessary to construct the project consistent with
federal standards. Attachment C is a construction drawing depicting proposed improvements.
However, because IDOT has agreed to incorporate this work into the larger Central Road project, the State of Illinois
will now assume cost for much of the curb, pavement, and sidewalk ramp modifications. Consequently, the Villages
of Arlington Heights and Mount Prospect will only be responsible for signal installation and some minor concrete
flatwork. As lead local agency, the Village is initially responsible for these costs. One-third (1/3) of funds expended
will be recovered from the Village of Arlington Heights when work is completed.
Mount Prospect Road Resurfacing and Pavement Widening
Finally, IDOT has also agreed to include Village requested improvements to Mount Prospect Road in their project. The
section of Mount Prospect Road between Rand Road and a point approximately 200' north of the Busse Avenue
intersection is owned and maintained by the Village. The southern remainder of the roadway is owned and
maintained by the Cook County Department of Transportation and Highways.
The Mount Prospect section is slated for resurfacing this year as part of the Village's Street Resurfacing Program.
Planned work includes milling and resurfacing of the pavement, spot curb replacement, structure adjustments, and
pavement striping. Staff also proposes to widen the roadway south of Central Road to accept two through lanes of
south bound traffic from the Rand Road intersection. Peak hour traffic observations suggest that this modification will
help alleviate queue congestion in the roadway section between Rand Road and Central Road.
No widening is planned for the section between Rand Road and Central Road. Resurfacing of this section will be
included. Widening this section may ultimately prove viable. As such, the notion is under consideration as part of the
Village's Central/Rand/Mount Prospect Road Phase 1 Intersection Study. However, the requisite engineering,
property acquisition, and traffic signal modifications necessary to effect such an improvement prohibit inclusion in
IDOT's imminent Central Road project.
Attachment D depicts the proposed work. These improvements are intended to be an interim upgrade to a portion of
the intersection.
The Village will be responsible for all pavement resurfacing and widening costs on Mount Prospect Road including
replacement of a traffic signal arm necessary to properly align the signals for southbound Mount Prospect Road at
Central Road. Inclusion of this work in the IDOT project offers the Village an opportunity to realize cost savings from
economies of scale, limit repeated traffic disruptions at the Central Road intersection, and avoid assumption of
maintenance responsibilities for the traffic signals during construction.
Intergovernmental Agreement
In order for the referenced work to be included in IDOT’s project, the agency has prepared an intergovernmental
agreement to establish our share of the cost. The cost to include required brick work, Central/Arthur pedestrian signal
installation, and Mount Prospect Road pavement widening work is $316,791. A spreadsheet detailing the distribution
of costs between the federal government, State of Illinois, and the Village is enclosed as Attachment E. A copy of the
proposed intergovernmental agreement with IDOT is Attachment F.

In addition, the agreement requires the Village pass a funding resolution, referenced as an exhibit in the agreement.
This resolution affirms the Village has appropriated sufficient funds to pay for our share of the cost of the
improvements.
Alternatives
1. Authorize the Mayor to sign an intergovernmental agreement with IDOT for construction expenses related to the
resurfacing of Central Road and pass a resolution affirming funding for this expenditure.
2. Action at discretion of Village Board.
Staff Recommendation
Staff recommends that the Village Board authorize the Mayor to enter into an intergovernmental agreement with
IDOT for costs associated with Central Road resurfacing work. Staff also recommends that the Village Board pass a
resolution verifying the availability of funds for this purpose in an amount of $316,791.

This Intergovernmental Agreement (the "Agreement") is made and entered into by and
between the Village of Mount Prospect ("Mount Prospect"), a municipal corporation of the State
of Illinois, and the Village of Arlington Heights ("Arlington Heights"), a municipal corporation
of the State of Illinois. Mount Prospect and Arlington Heights are sometimes collectively
referred to as the "Parties."
RECITALS
WHEREAS, the Constitution of the State of Illinois, 1970, Article VII, Section 10,
authorizes units of local government to contract or otherwise associate among themselves in any
manner not prohibited by law or ordinance; and
WHEREAS, the provisions of the Intergovernmental Cooperation Act, (5 ILCS 220/1 et
seq.), authorize and encourage intergovernmental cooperation; and
WHEREAS, Mount Prospect and Arlington Heights are units of government within the
meaning of the Constitution of the State of Illinois, 1970, Article VII, Section 10, having the
power and authority to enter into an intergovernmental agreement; and
WHEREAS, in order to ensure the safety of pedestrians and the motoring public, Mount
Prospect and Arlington Heights wish to make pedestrian safety improvements at the intersections
of Central Road and Arthur Avenue and Central Road and Bosch Driveway; and
WHEREAS, the improvement is described as additional pedestrian signals and
appurtenances to provide a complete crossing system at both intersections, sidewalks, Americans
with Disabilities Act ("ADA") compliant sidewalk ramps and crosswalk pavement markings
(hereinafter called "Project"); and
WHEREAS, Mount Prospect and Arlington Heights, by this instrument, desire to
memorialize their respective obligations and responsibilities toward plan development,
engineering, construction and funding, as well as future maintenance responsibilities of the
completed Project; and
NOW THEREFORE, in consideration of the promises, covenants, terms and conditions
set forth in this Agreement, the Parties hereto agree as follows:

SECTION 1. INCORPORATION OF RECITALS
The above recitals are incorporated into this Agreement as if fully set forth herein.
SECTION 2. rERIM AND TERMINATION
This Agreement between Mount Prospect and Arlington Heights shall not become effective
unless authorized and executed by authorized representatives of both municipalities. This
Agreement is a legal, valid and binding agreement, enforceable against both Mount Prospect and
Arlington Heights in accordance with its terms. This Agreement shall terminate upon
completion of the Project.
SECTION 3. PROJECT FUNDS
3.1 Mount Prospect's Share of the Project. Mount Prospect's share of the expenses for the
Project shall be equal to 33% of the total costs of the Project that consist of design
engineering, construction engineering and construction costs and is estimated as $25,740.
3.2 Arlington Heights' Share of the Project. Arlington Heights' share of the expenses for the
Project shall be equal to 67% of the total costs of the Project that consist of design
engineering, construction engineering and construction costs and is estimated as $52,260.
3.3 Cost Estimates, The Mount Prospect share and the Arlington Heights share are more
fully described in the Funding Breakdown for the Project which is incorporated and
attached hereto as Exhibit A. The funding Breakdown is only an estimate and does not
limit the financial obligations of the parties as described in §§ 3.1 and 3.2, above.
SECTION 4. PROJECT REVIEW AND APPROVAL
The Project will require review and approval from the Illinois Department of Transportation
("IDOT"). A permit from IDOT will be needed prior to construction and such permit will be
issued to Mount Prospect as the Lead Agent for the Project.
SECTION 5. ENGINEERING CONSULTANT AND CONTRACTOR
5.1 An engineering consultant will need to be retained for the Project and a contractor will be
needed for Project construction.
5.2 The engineering consultant will provide professional services for developing plans and
specifications for the Project, incorporating the pedestrian signal timing into the overall
traffic signal timing program, obtaining necessary approvals from IDOT, providing a
construction cost estimate, assisting with the bid process and providing construction
inspection.

5.3 The contractor shall manage the construction activities related to the Project and meet all
the requirements set forth by IDOT and Mount Prospect and/or Arlington Heights and
included in the engineering plans and specifications.
SECTION 6. MOUNT PROSPECT'S RESPONSIBILITIES
6.1 Mount Prospect as the Lead Agent. Mount Prospect shall act as the Lead Agent for the
Project. As the Lead Agent, Mount Prospect will have oversight for the plan
development phase of the Project, the bid process and procedures, and the constriction
phase.
6.2 Engineering Consultant and Contractor. Mount Prospect will secure the engineering
consultant and the contractor who shall perform the services described in Section 5
above, with the input and concurrence of Arlington Heights. Mount Prospect shall have
the sole expense for the costs of any Request for Proposals ("RFP") and/or bidding
processes required to secure the services of the engineering consultant and the contractor
for the Project.
6.3 Design En ineering. Mount Prospect shall conduct design engineering and prepare the
Project construction plans, specifications, estimates and contract documents, with the
input and concurrence of Arlington Heights, and obtain the necessary approvals,
including from IDOT.
6.4 Payment of Engineering Consultant and Contractor. Mount Prospect shall pay the
engineering consultant and the Project contractor directly.
6.5 Constriction. Mount Prospect shall provide constriction engineering and ensure that the
Project is built in accordance with approved design plans, specifications and a
construction contract.
6.6 Equipment. All pedestrian signal equipment shall be of the type and brand that is
acceptable to IDOT. Mount Prospect shall be responsible for securing IDOT approval for
the pedestrian signal equipment. One copy of all approved catalog cuts shall be furnished
to IDOT prior to installation.
6.7 As -Built Drawings. Mount Prospect shall furnish IDOT as -built construction drawings
prior to the Final Inspection of the Project.
6.8 Invoicing and Reimbursement. Mount Prospect shall invoice Arlington Heights and seek
reimbursement for its share of the expense for the Project design engineering,
constriction engineering and constriction.
6.10 Public Notification of the Project. Mount Prospect and Arlington Heights shall each
coordinate and control public notification of the Project scope, timing and duration for its
community through methods of communication such as village newsletters, websites, etc.
SECTION 7. ARLING'T'ON HEIGHTS' RESPONSIBILITIES
7.1 Engineering Consultant. Arlington Heights shall provide input with the selection of the
engineering consultant who will perform the duties described in Section 5, above.
7.2 Plan Development. Arlington Heights shall provide input with all decisions pertaining to
the development of Project plans.
7.3 Project Construction, Arlington Heights shall provide input with all decisions pertaining
to Project construction.
7.4 Bid Process. Arlington Heights shall provide input with all decisions pertaining to bid
process for the Project.
7.5 Final Inspection. Arlington Heights shall participate in the Final Inspection of the Project
once construction is completed.
7.6 Payments to Mount Prospect. Mount Prospect shall pay the costs for Project design
engineering, construction engineering and construction directly. Mount Prospect shall
send Arlington Heights an invoice for its share of the Project costs within 90 days of
completion of the three phases: design engineering, construction engineering, and
construction. Arlington Heights shall pay Mount Prospect within 90 days after receipt of
said invoices from Mount Prospect.
SECTION 8. MAINTENANCE
8.1 Ownership of Traffic Signals at the Intersections. IDOT owns the traffic signals at the
intersections of Central Road and Arthur Avenue and Central Road and Bosch Driveway,
including pedestrian signals and it shall own the pedestrian signals installed as part of the
Project.
8.2 Maintenance at the Central Road and Arthur Avenue Intersection. IDOT oversees
maintenance of the traffic signals, including the pedestrian signals, at the Central Road
and Arthur Avenue intersection and pays 100% of the maintenance costs. This
arrangement shall continue with regard to the pedestrian signals that are part of the
Project.
8.3 Maintenance at the Central Road and Bosch Driveway Intersection. IDOT oversees
maintenance of the traffic signals, including the pedestrian signals, at the Central Road
and Bosch Driveway intersection and Mount Prospect reimburses IDOT 100% of the
maintenance costs on a quarterly basis. This arrangement shall continue with regard to
the pedestrian signals that are part of the Project.

SECTION 9. INDEMNIFICATION AND INSURANCE
Indemnification and Insurance. The maintenance of the traffic signals, including those installed
as part of the Project, shall be conducted by IDOT pursuant to an existing agreement between the
Parties and IDOT for ongoing maintenance of designated intersections in Mount Prospect and
Arlington Heights over which IDOT has jurisdiction. All applicable indemnification and
insurance provisions set forth in the current existing maintenance agreement(s) between IDOT
and Mount Prospect and Arlington Heights shall be in frill force and effect with regard to the
maintenance of the traffic signals, including those installed as part of the Project, at the
intersections of Central Road and Arthur Avenue and Central Road and Bosch Driveway.
SECTION 10. GENERAL PROVISIONS
10.1 Governing Law and Venue. This Agreement shall be interpreted under, and governed by,
the laws of the State of Illinois, without regard to conflicts of laws principles. Any claim,
suit, action, or proceeding brought in connection with this Agreement shall be in the
Circuit Court of Cook County and each Party hereby irrevocably consents to the personal
and subject matter jurisdiction of such court an waives any claim that such court does not
constitute a convenient and appropriate venue for such claims, suits, actions or
proceedings.
10.2 Default. Mount Prospect shall be in default hereunder in the event of a material breach
by Mount Prospect of any term or condition of this Agreement including, but not limited
to, a representation or warranty, where Mount Prospect has failed to cure such breach
within 30 days after written notice of breach is given to Mount Prospect by Arlington
Heights, setting forth the nature of such breach. Failure of Arlington Heights to give
written notice of breach to Mount Prospect shall not be deemed to be a waiver of
Arlington Heights' right to assert such breach at a later time. Upon default by Mount
Prospect, Arlington Heights shall be entitled to exercise all available remedies at law and
in equity, including but not limited to tennination of this Agreement upon 30 days' notice
to Mount Prospect.
Arlington Heights shall be in default hereunder in the event of a material breach by
Arlington Heights of any term or condition of this Agreement including, but not limited
to, a representation or warranty, where Arlington Heights has failed to cure such breach
within 30 days after written notice of breach is given to Arlington Heights by Mount
Prospect, setting forth the nature of such breach. Upon default by Arlington Heights,
Mount Prospect shall be entitled to exercise all available remedies at law and in equity,
including but not limited to termination of this Agreement upon 30 days' notice to
Arlington Heights.
10.3 Modification. This Agreement may not be altered, modified or amended except by a
written instrument signed by both Parties. Provided, however, the Parties agree that
provisions required to be inserted in this Agreement by laws, ordinances, rules,
regulations or executive orders are deemed inserted whether or not they appear in this

Agreement and that in no event will the failure to insert such provisions prevent the
enforcement of this Agreement.
10.4 Binding Successors. Mount Prospect and Arlington Heights agree that their respective
successors and assigns shall be bound by the terms of this Agreement.
10.5 Force Majeure. Neither Mount Prospect nor Arlington Heights shall be liable for failing
to fulfill any obligation under this Agreement to the extent any such failure is caused by
any event beyond such Party's control and which event is not caused by such Party's
fault or negligence. Such events shall include, but not be limited to, acts of God, acts of
war, fires, lightning, floods, epidemics or riots.
10.6 Notices. Unless otherwise specified, any notice, demand or request required under this
Agreement must be given in writing at the addresses set forth below by any of the
following means: personal service, overnight courier or first class mail.

10.7 Entire Agreement. This Agreement constitutes the entire agreement between Mount
Prospect and Arlington Heights, merges all discussion between them and supersedes and
replaces any and every other prior or contemporaneous agreement, negotiation,
understanding, commitments and writing with respect to such subject matter hereof.

A RESOLUTION APPROVING AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE
VILLAGES OF ARLINGTON HEIGHTS AND MOUNT PROSPECT
BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF ARLINGTON HEIGHTS:
SECTION ONE: A certain intergovernmental agreement by and between the Villages of
Arlington Heights and Mount Prospect, dated August 18, 2014, related to the constriction of
pedestrian signal safety improvements on Central Road at Arthur Avenue and Bosch Driveway, a
true and correct copy of which is attached hereto, be and the same is hereby approved.
SECTION TWO: The Village President and Village Clerk are hereby authorized and
directed to execute said intergovernmental agreement on behalf of the Village of Arlington
Heights.
SECTION THREE: This Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law and the agreement shall be recorded in the
Office of the Recorder of Cook County, Illinois.

A RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND
THE VILLAGE OF ARLINGTON HEIGHTS FOR THE CONSTRUCTION AND MAINTENANCE
OF PEDESTRIAN CROSSING IMPROVEMENTS AT THE INTERSECTIONS OF
CENTRAL ROAD AND ARTHUR AVENUE AND CENTRAL ROAD AND BOSCH DRIVEWAY
WHEREAS, the Village of Mount Prospect is a home rule unit of government pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the provisions of the Intergovernmental Cooperation Act, (5 ILCS 220/1 et seq.,) authorizes
and encourages intergovernmental cooperation; and
WHEREAS, the Village of Mount Prospect and the Village of Arlington Heights are units of government
within the meaning of the Constitution of the State of Illinois, 1970 Article VII, Section 10, having the power
and authority to enter into an intergovernmental agreement; and
WHEREAS, in order to ensure the safety of pedestrians and the motoring public, the Village of Arlington
Heights and the Village of Mount Prospect wish to make pedestrian safety improvements at the
intersections of Central Road and Arthur Avenue and Central Road and Bosch Driveway; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have deemed that the best
interests of the Village will be served by entering into the Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE
POWERS:
SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby authorize and direct the
Mayor to execute the Intergovernmental Agreement between the Village of Mount Prospect and the Village
of Arlington Heights for pedestrian safety improvements at the intersections of Central Road and Arthur
Avenue and Central Road and Bosch Driveway attached hereto and made a part of this Resolution as
Exhibit "A."
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and
approval in the manner provided by law.

AGREEMENT
This Agreement entered into this _______day of __________________, 2018 A.D., by and
between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF
TRANSPORTATION hereinafter called the STATE, and the VILLAGE OF MOUNT PROSPECT of
the State of Illinois, hereinafter called the VILLAGE.
WITNESSETH:
WHEREAS, the STATE in order to facilitate the free flow of traffic and ensure safety to the motoring
public, is desirous of improving FAU Route 1300, Central Road from Arlington Heights Road to US
12/Rand Road, STATE Section (1618&1819.1)RS, STATE Job No.: C-91-438-16, State Contract
Number 62D20, by resurfacing, pedestrian ramp improvements, pavement patching, curb and
gutter repair, drainage structure adjustments and cleaning, installation of thermoplastic pavement
markings and raised reflective pavement markers and performing all other work necessary to
complete the improvement in accordance with the approved plans and specifications; and
WHEREAS, the VILLAGE requests installation of Tactile / Detectable Warnings and Detectable
Warnings (Special) at various locations within the village limits, construction of new sidewalk at the
southwest corner of Central Road and Arthur Avenue, traffic signal improvements at Central Road
and Arthur Avenue and at Central Road and Mount Prospect Road, resurfacing of Mount Prospect
Road, upgrading pedestrian ramps to current ADA standards and the installation of brick paver
sidewalk in lieu of concrete; and
WHEREAS, the STATE has agreed to the VILLAGE’s request; and
WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit
to the VILLAGE residents and permanent in nature.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto
agree as follows:
1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and
specifications, receive bids and award the contract, furnish engineering inspection during
construction and cause the improvement to be built in accordance with the approved plans,
specifications and contract.
2. The STATE agrees to pay for all right of way, construction and engineering cost subject to
reimbursement by the VILLAGE as hereinafter stipulated.
3. It is mutually agreed by and between the parties hereto that the estimated cost and cost proration
for this improvement is as shown on Exhibit A attached hereto and made a part hereof.
4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost for
this improvement, a copy of which is attached hereto as Exhibit B and made a part hereof.
5. The VILLAGE agreesthat upon award of the contract for this improvement, the VILLAGE will pay to
the STATE in a lump sum from any funds allotted to the VILLAGE an amount equal to 80% of its
obligation incurred under this AGREEMENT, and will pay to said STATE the remainder of the
obligation (including any non-participating costs on FA Projects) in a lump sum, upon completion of
the project based upon final costs.
6. The VILLAGE further agrees to pass a supplemental resolution to provide necessary funds for its
share of the cost of this improvement if the amount appropriated in Exhibit B proves to be
insufficient, to cover said cost.
7. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb, as
constructed, or the construction of additional entrances, private or commercial, along Central Road
without the consent of the STATE.
8. The VILLAGE shall exercise its franchise rights to cause private utilities to be relocated, if required,
at no expense to the STATE.
9. The VILLAGE agrees to cause its utilities installed on right of way after said right of way was
acquired by the STATE or installed within the limits of a roadway after the said roadway’s
jurisdiction was assumed by the STATE, to be relocated and/or adjusted, if required, at no
expense to the STATE.
10. Upon final field inspection of the improvement and so long as Central Road is used as a STATE
Highway, the STATE agrees to maintain or cause to be maintained the median, the through traffic
lanes, the left-turn lanes and right turn lanes and the curb and gutter, stabilized shoulder and
ditches adjacent to those traffic lanes and turn lanes.
11. Upon final field inspection of the improvement, the VILLAGE agrees to maintain or cause to be
maintained those portions of the improvement which are not maintained by the STATE, including
new and existing sidewalks, new brick sidewalks, new curb ramp improvements and special
detectable warnings, parkways, crosswalk and stopline markings and VILLAGE owned utilities
including appurtenances thereto.
12. The VILLAGE further agrees to continue its existing maintenance responsibilities on all side road
approaches under its jurisdiction, including all left and right turn lanes on said side road
approaches, up to the through edge of pavement of Central Road. Drainage facilities, if any, at
the aforementioned side roads located within the STATE right-of-way shall be the joint
maintenance responsibility of the STATE and the VILLAGE unless there is an agreement
specifying different responsibilities.
13. The VILLAGE has adopted a resolution, will send a letter, or sign the Plan Approval page which is
part of this document, prior to the STATE advertising for the work to be performed hereunder,
approving the plans and specifications as prepared.
14. Upon acceptance by the STATE of the traffic signal work included herein the responsibility for
maintenance and energy shall continue as shown in the existing Master Agreement between the
STATE and the VILLAGE effective July 1, 2011.
15. Under penalties of perjury, the VILLAGE certifies that its correct Federal Tax Identification number
is 36-6006011 and it is doing business as a GOVERNMENTAL ENTITY, whose mailing address is

Obligations of the STATE and the VILLAGE will cease immediately without penalty or further payment
being required if, in any fiscal year, the Illinois General Assembly or Federal funding source fails to
appropriate or otherwise make available funds for this contract.
This AGREEMENT and the covenants contained herein shall be null and void in the event the contract
covering the construction work contemplated herein is not awarded within the three years subsequent to
execution of the agreement.
This Agreement shall be binding upon and to the benefit of the parties hereto, their successors and
assigns.

WHEREAS, the VILLAGE OF MOUNT PROSPECT has entered into an AGREEMENT with the STATE
OF ILLINOIS for the improvement of FAU Route 1300, known as Central Road, State Section (1618 & 1819.1)
RS and
WHEREAS, in compliance with the aforementioned AGREEMENT, it is necessary for the VILLAGE to
appropriate sufficient funds to pay its share of the cost of said improvement.
NOW THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of One Hundred
Three Hundred Sixteen Thousand Seven Hundred Ninety One Dollars ($316,791.00), or so much thereof as
may be necessary, from any money now or hereinafter allotted to the VILLAGE, to pay its share of the cost of
this improvement as provided in the AGREEMENT; and
BE IT FURTHER RESOLVED, that upon award of the contract for this improvement, the VILLAGE will
pay to the STATE in a lump sum from any funds allotted to the VILLAGE an amount equal to 80% of its
obligation incurred under this AGREEMENT, and will pay to said STATE the remainder of the obligation in a
lump sum, upon completion of the project based on final costs.
