HomeMy WebLinkAboutOrd 5041 08/17/1999 ORDINANCE NO. 5041 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT AND GRANTING A CONDITIONAL USE AND VARIATION TO PROPERTY COMMONLY KNOWN AS 408 EAST RAND ROAD Passed and approved by the President and Board of Trustees the 17th day of August, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 18th day of August, 1999 vwl/ 8/7/99 8/10/99 ORDINANCE NO. 5041 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT AND GRANTING A CONDITIONAL USE AND VARIATION TO PROPERTY COMMONLY KNOWN AS 408 EAST RAND ROAD WHEREAS, Kristine Matz (hereinafter referred to as Petitioner), has filed an application to rezone certain property generally located at 408 E. Rand Road (hereinafter referred to as Subject Property); and WHEREAS, the Subject Property is legally described as follows: That part of the SEN of the NE¼ of Section 34, Township 42N, Range 11East of the Third Principal Meridian, lying east of Rand Road, described as follows: Beginning at a point on the east line of Rand Road, 242.32 feet southeasterly of the intersection of the said east line of Rand Road and the north line of said SE¼ of the NE¼ of Section 34, thence east 525.61' to an iron stake, thence south 88' to an iron stake, thence west 469.52' to the easterly side of Rand Road, thence northwesterly along the east line of Rand Road 104.61', in Cook County, Illinois; and WHEREAS, Petitioner has requested the Subject Property be rezoned from R-1 (Single Family Residence) District to B-1 (Business Office) District; and WHEREAS, a public hearing was held on the requests for rezoning, Conditional Use, and Variation being the subject of ZBA Case No. 22-99, before the Zoning Board of Appeals of the Village of Mount Prospect on the 22r~ day of July, 1999, pursuant to due and proper notice thereof having been published in the Mount Prospect Journal and Topics on the 7th day of July, 1999; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the requests being the subject of ZBA 22-99 and have determined that the best interests of the Village of Mount Prospect would be served by granting said requests. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. ~ That the Official Zoning Map of the Village of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying the property being the subject of this Ordinance from Rol to B-1 (Business Office) District. BA 22-99 Page 2/2 SECTION THREE: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use, as provided in Section 14.203.F.7 of the Village Code, to allow the establishment of a 53-space stand alone parking lot. SECTION FOUR: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation, as provided in Section 14.203.C.7 of the Village Code, to allow the parking lot to encroach into the required inter,or side yard to within five (5) feet of the south properbj line as shown on the attached Site Plan, hereby made a part hereof as Exhibit "A". SECTION FIVE: That the amendments being the subject of this Ordinance are subject to the following conditions: 1. Provide five (5) handicap accessible parking spaces in the closest accessible locations within the existing parking lot on the funeral home property; 2. Replace the proposed wood fence with a hedge and remove the hedge currently existing along adjacent property; 3. Provide right-of-way improvements required by the Development Code, including street lighting improvements and all landscaping requirements, except street trees, for the entire frontage of the two subject parcels; SECTION SIX: That the Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
