AN ORDINANCE TRANSFERRING CERTAIN REAL PROPERTY OWNED BY
THE VILLAGE OF MOUNT PROSPECT
(Unimproved Thayer Street West of Rand Road)
WHEREAS, the Village has fee simple title to a certain thirty-three foot strip of
unimproved right of way, on Thayer Street, just west of Rand Road in the Village of
Mount Prospect (the "Property"); and
WHEREAS, this portion of unimproved Thayer Street is adjacent to a
development on Rand Road that is the subject of a redevelopment proposal at 801 East
Rand Road, put forward by Speed-GMX Mount Prospect, LLC (the "Redevelopment");
and
WHEREAS, the Redevelopment is brought before the Village concurrent with a
zoning map amendment and a conditional use for a planned unit development; and
WHEREAS, as part of this redevelopment proposal, the unimproved rights of
way to the north (Thayer Street) and to the south (East Henry Street) are included as
necessary land for the Redevelopment plans; and
WHEREAS, the Village is vacating that portion of East Henry Street adjacent to
the Redevelopment to Speed-GMX Mount Prospect, LLC, a Delaware limited liability
company (the "Grantee"); and
WHEREAS, the Property is a portion of the unimproved right of way that was
never dedicated to the Village, but instead transferred via deed in 1968; and
WHEREAS, in order for the Redevelopment to take advantage of the Property,
the Village needs to transfer title to the developer; and
WHEREAS, pursuant to its home rule authority, the Village of Mount Prospect
("Village") has the authority to sell or transfer real estate owned by it according to the
procedures adopted by the Village; and

WHEREAS, pursuant to Section 8.514 of the Village Code, certain conditions
must be met for a sale or transfer of Village -owned real property; and
WHEREAS, it is in the best interest of the Village of Mount Prospect that said
Property be transferred to the developer.
THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois:
SECTION 1: That the findings set forth above are incorporated by reference into
this Section 1 as if fully set forth herein.
SECTION 2: That the Property is legally described as follows:
THE NORTH 33 FEET OF THAT PART OF THE NORTH '/2 OF THE
SOUTHWEST '/4 OF THE SOUTHWEST '/4 OF SECTION 35,
TOWNSHIP 42 NORTH, RANGE 11 EAST OF THE THIRD
PRINCIPAL MERIDIAN, LYING WEST OF RAND ROAD
(EXCEPTING FROM SAID TRACT THE WEST 193.0 FEET
THEREOF).
Common Address: The south half of unimproved Thayer Street, 183.29 feet
west from Rand Road (801 East Rand Road, Mount
Prospect, Illinois)
SECTION 3: That the quit -claim deed proposed for transfer of the Property to the
buyer, "Speed-GMX Mount Prospect, LLC," is attached as Exhibit A to this Ordinance.
SECTION 4: That relieving the Village of the burden of maintenance and potential
liability associated with the Property is sufficient consideration for transfer of the
Property and no monetary costs are necessary. This price of ten dollars ($10.00) is fair,
reasonable and just according to the circumstances and nature of the Property.
SECTION 5: That the Property is no longer necessary, appropriate or required
for municipal use.

SECTION 6: That the Village Clerk is hereby and herewith instructed, to promptly
record a copy of this Ordinance certified as correct by the Clerk of said Village of Mount
Prospect with the Recorder of Deeds of Cook County, Illinois.
SECTION 7: That this Ordinance shall be in full force and effect upon and after
its adoption and approval as required by law.
ADOPTED this 1 7 t h day of April, 2018, by a roll call vote of the Corporate
Authorities as follows:
AYES: Grossi, Hatzis, Hoefert, Rogers, Saccotelli, Zadel
NAYS: None
ABSENT: None
APPROVED this 17th day of April, 2018, by the President of the Village
of Mount Prospect.
