AN ORDINANCE GRANTING AN EXCEPTION FROM
THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY
LOCATED AT 301 SOUTH I-OKA AVENUE
WHEREAS, St. Raymond de Penafort Parish (hereinafter referred to as the Petitioner) is
the owner of the property generally located at 301 S. I-Oka Avenue (hereinafter referred
to as Subject Property) and legally described as follows:
Part of the Southeast Quarter of the Northeast Quarter of Section 11, Township 41
North, Range 11 East of the Third Principal Meridian, in the Village of Mount
Prospect, Cook County, Illinois
and
WHEREAS, the Petitioner has requested an exception to Section 16.403.C.4.a of the
Development Code requiring a twenty-foot (20') utility easement along the rear property
line.
WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the
request for an exception from Section 16.403.C.4.a of Chapter 16 (Development Code) for
the Subject Property at their regular meeting on November 3, 1999, said request being the
subject of PC 04-99 and by a unanimous vote recommended to the President and Board
of Trustees of the Village to grant the exception from Chapter 16 as requested; and
WHEREAS, the Plan Commission has forwarded its recommendation being the subject of
PC 04-99 to the President and Board of Trustees of the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: That an exception to the Section 16.403.C.4.a of the Development Code
(Chapter 16), requiring a twenty-foot (20') utility easement along the rear property line
is hereby granted, as shown on the Site Plan, a copy of which is attached hereto and
hereby made a part hereof as Exhibit "A."

SECTION THREE: Except for the exception granted herein, all other requirements of said
Development Code shall apply to the subject property.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
