AN ORDINANCE GRANTING A VARIATION AND AMENDING ORDINANCE NO. 4963
RELATIVE TO A PLANNED UNIT DEVELOPMENT FOR PROPERTY
LOCATED AT 3032-3034 WEST ALGONQUIN ROAD
WHEREAS, Adel Sotolongo, agent for Dearborn Villas, L.L.C. (hereinafter referred to as
Petitioner) has filed a petition to amend the Planned Unit Development being the subject
of Ordinance No. 4963, for a Conditional Use with respect to property at 3032-3034 West
Algonquin Road (hereinafter referred to as the Subject Property), and legally described as
follows:
Lot 1 in Insignia Place, being a resubdivision of the West 229.10' of Lot 2 (except
the North 703.70') in Edward Busse's Division of Part of the SE ¼ Section 15
and the NE ¼ of Section 22 in Township 41North, Range 11 East of the Third
Principal Meridian, in Cook County, Illinois;
and
WHEREAS, Petitioner seeks an amendment to the Planned Unit Development being the
subject of Ordinance No. 4963 to allow the construction of one deck on each of the
existing twenty-two (22) duplex units, and a Variation to allow lot coverage of 51% of the
subject property; and
WHEREAS, a Public Hearing was held on the requests being the subject of ZBA Case
No. 32-99 before the Zoning Board of Appeals of the Village of Mount Prospect on the
28th day of October, 1999, pursuant to proper legal notice having been published in the
Mount Prospect Daily Herald on the 11~ day of October, 1999; and
WHEREAS, the Zoning Board of Appeals has submitted its findings on the proposed
Variation and amendment to a Planned Unit Development to the President and Board of
Trustees; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined that the best interests of the Village of Mount Prospect would be attained by
granting the requests in ZBA 32-99.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of
fact by the President and Board of Trustees of the Village of Mount Prospect.

SECTION TWO: Ordinance No. 4963, passed and approved on September 15, 1998, is
hereby amended by granting a Conditional Use to allow the construction of one wood
deck with a maximum dimension of ten feet by twelve feet (10' x 12') on each of the
existing twenty-two (22) duplex units as shown on the attached Exhibit "A."
SECTION THREE: Ordinance No. 4963, passed and approved on September 15,
1998, is hereby amended by granting a Variation to allow lot coverage of 51% of the
subject property.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
