HomeMy WebLinkAboutOrd 5068 12/21/1999 ORDINANCE NO. 5068 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 555 BUSINESS CENTER DRIVE Passed and approved by the President and Board of Trustees the 21 st day of December, 1999 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of December, 1999 vwl 12/10/99 ORDINANCE NO. 5068 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 555 BUSINESS CENTER DRIVE WHEREAS, Insignia/ESG (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 555 Business Center Drive hereinafter referred to as Subject Property), legally described as: Lot 8 in Kensington Center, Phase One, being a Subdivision in the East ½ of Section 34, and the West ¼ of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioner seeks a Variation from Sections 14.2217.B to reduce the required side setback from ten feet (10') to four feet (4') to allow for the widening of driveway; and WHEREAS, a Public Hearing was held on the variation requested being the subject of ZBA Case No. 33-99 before the Zoning Board of Appeals of the Village of Mount Prospect on the 11th day of November, 1999, pursuant to due and proper notice thereof published in the Daily Herald on the 27th dayof October, 1999; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 33-99; and WHEREAS, the President and Board of Trustees of the Village have given consideration to the request herein and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. Page 2/2 ZBA 33-99 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.2217.B to permit a reduction in the required side setback from 10 feet (10') to four feet (4') to allow for the widening of a driveway. SECTION THREE: In accordance with the provisions of Section 14.2217.B of Chapter 14 of the Village Code, the variation granted herein shall be null and void unless a permit is issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FOUR: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form in the manner provided by law.
