MAYOR'S REPORT A. 2nd reading of AN ORDINANCE AMENDING CHAPTER 13 ENTITLED "ALCOHOLIC LIQUOR DEALERS" OF THE VILLAGE CODE OF MOUNT PROSPECT This Ordinance establishes regulations for the operation of beer gardens. (Exhibit A) B. 2nd reading of AN ORDINANCE AMENDING ARTICLE XV ENTITLED PROPERTY MAINTENANCE CODE OF CHAPTER 21 OF THE VILLAGE CODE OF MOUNT PROSPECT This Ordinance .~stablishes the requir~ement to board-up vacant structures with material similar to that of the major portion of the building. (Exhibit B) C. Authorize administration to defend the law suit filed by the Elk Grove Rural Fire Protection District against the Village. VIII. OLD BUSINESS A. 2nd reading of AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 22 OF THE VILLAGE CODE This Ordinance &stablishes regulations governing downspouts. (Exhibit C) B. 2nd reading of AN ORDINANCE AMENDING ARTICLE XV OF CHAPTER 21 OF THE VILLAGE CODE This Ordinance amends the Property Maintenance Code relative to gutters and downspouts. (Exhibit D) C. ZBA 83-V-89, 805 S. Elmhurst Road 1st reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 805 S. ELMHURST ROAD This Ordinance grants a variation to allow a circular driveway and to permit impervious coverage of 52% rather than the 35%. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit E) D. ZBA 85-SU-89, 1731 W. Pheasant Trail 1st reading of AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY K~OWNAS 1731 W. PHEASANT TRAIL This Ordinance grants a Special Use in order to operate a day care home. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit F) E. ZBA 86-SU-89, 1201 North Ardyce Lane 1st reading of AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 1201 N. ARDYCE LANE This Ordinance grants a Special Use in order to allow a family care home to house 6 individuals instead of 5 as permitted. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit G) F. ZBA 66-SU-89 and ZBA 67-V-89, 1500 S. Elmhurst Road 1. 1st reading of AN ORDINANCE AMENDING THE SPECIAL USE AND GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS THE VENTURE STORE, 1500 SOUTH ELM}{URST ROAD This Ordinance amends the Planned Unit Development the Venture Property by relocating 2 outlots which will house 2 drive-thru, fast- food restaurants; a 20,000 square foot addition to the existing Venture building; variations to allow a 20 foot parking lot setback instead of the required 30 feet along Elmhurst & Dempster Roads; and, a zero foot parking lot setback instead of the required 20 feet on the west and north property lines. Also included in this Ordinance is the requirement to execute a Restrictive Covenant relative to the installation of public improvements. The Zoning Board of Appeals recommended approving these requests. (Exhibit H) IX. NEW BUSINESS A. Dr. Dreessen, Mount Plaines Animal Hospital Request for modifications from the Development Code (Chapter 16) for property located at 888 East Northwest Highway. The Petitioner is requesting waiving requirements for: storm water detention in thenew parking lot; curb and gutter around the perimeter of the parking lot; parkway trees on Northwest Highway; and, to permit the existing 10 foot wide sidewalk on Northwest Hwy. rather than the required width of 7 feet. The Plan Commission recommended denying these requests. B. 1st reading of AN ORDINANCE AMENDING CHAPTER 12 OF THE VILLAGE CODE FOOD CODE This Ordinance amends Articles I and III of Chapter 12 which brings the local regulations into conformance with State regulations. (Exhibit J) C. 1st reading of AN ORDINANCE AMENDING CHAPTER 18 (TRAFFIC CODE) This Ordinance amends our local regulations governing handicapped parking spaces to require the presence of the handicapped person when utilizing parking spaces designated for the handicapped as well as increasing the fine from $50.00 to $100 (Exhibit K) D. A RESOLUTION SUPPORTING EMERGENCY AID IN PUBLIC WORKS This Resolution reaffirms our intent to cooperate with other municipalities in providing Public Works services during emergency situations. (Exhibit L) E. A RESOLUTION IN SUPPORT OF PLANNED MUTUAL AID PROGRAM FOR PUBLIC WORKS PROJECTS This Resolution reaffirms our participation in mutual aid forlprojects involving our Public Works Department. (Exhibit M) F. A RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN VILLAGE AND FOREST RIVER FIRE PROTECTION DISTRICT This Resolution authorizes execution of the annual agreement to provide emergency services to this Fire Protection District. (Exhibit N) G. A RESOLUTION AUTHORIZING EXECUTION OF A T.R~SE AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND FRANCIS CADILLAC FOR PROPERTY COMMONLY KNOWN AS 11 SOUTH PINE This Resolution authorizes the Village to lease the former Public Works facility to Francis Cadillac. Adoption is conditioned upon acceptance by Francis Cadillac. (Exhibit O) X. VILLAGE MANAGER'S REPORT A. 2nd reading of AN ORDINANCE AMENDING THE 1989/90 BUDGET FOR THE VILLAGE OF MOUNT PROSPECT (Exhibit P) B. Claims administrator for insurance C. Authorization for Donohue & Associates to prepare supplemental study, specifications and cost estimates relative to the rehabilitation of the Public Safety Building. D. Authorize Planning and Zoning to hire a facilitator to conduct a strategic planning sessions to %denti~y options.for downtown development in con]unction with the rehabilitation or relocation of the Public Safety Building. E. Request to accept proposal to conduct soil borings in conjunction with the 1990 resurfacing ~' project. F. A RESOLUTION APPROPRIATING MOTOR FUEL TAX FUNDS This Resolution authorizes the appropriation of $8,000 for the soil borings necessary for the 1990 surfacing project. (Exhibit Q) G. Request to waive the bidding procedure and authorize consultant to study the Operation and Maintenance procedures for Public Works equipment. This is a specialized study and qualified consultants limited. H. Request authorization to pay the Frediani Group $7,970.85 as the Village's portion of the cost involved with the installation of parking spaces within the Old Orchard Colony Development, pursuant to the Consent Decree.
