Adopt the ordinance annexing the subject properties.
The Village is pursuing the annexation of approximately 40 acres of industrial and commercial property in unincorporated
Cook County located at the southern border of the Village. The Village has notified all property owners impacted by this
action and all public agencies as required by state statutes.
The subject properties are located in the area along the north and south sides of Oakton Street, predominately east of the
Higgins Creek. The area consists of 37 individually owned parcels and over 70 businesses that have addresses on Oakton
Street, Weiler Road and Elizabeth Drive.
The Village is pursuing the annexation of this property so that it can provide local services to these properties and to
eliminate inefficient service provision by the county to this pocket of unincorporated land. In addition, the Village will zone
the property I1 Limited Industrial which is the most compatible zoning district with the existing land uses in this area.
The property adds over $14 million in new equalized assessed value to the Village's tax base, thereby reducing the tax
burden to other taxpayers in the Village. Annexing the property also provides the Village with greater control of the long-
term redevelopment of the property moving forward.
Per state statutes, the Village is required to pay the Elk Grove Rural Fire Protection District (EGRFPD) a gradually reduced
percentage of the property taxes that they currently receive from the subject properties over the following five years.
The Village must pay the EGRFPD their full levy in year one, 80% in year two, 60% in year three, 40% in year four and
20% in year five. The Village has negotiated a modified payment schedule that provides the EGRFPD with these
payments over a three year period rather than five. The following chart provides an estimate of the required EGRFPD
payment and the amount of property taxes that the Village will receive from the annexation of these properties over that
same time period.

Staff held an open house on May 9th for all property owners and tenants in this area to further explain the impact of the
annexation on their operations and to answer any questions that they had on this matter. Feedback from the attendees
was valuable, and included discussion related to the potential for water service (as these properties are currently served
by well water), potential street resurfacing, various required inspections, licensing, and permitting, and tax implications for
the property owners. Staff reinterated to the attendees the benefits of annexation, such as Village -provided emergency
service, efficiencies in licensing and permitting, and the potential for future infrastructure improvements.
Please forward this memorandum and attachments to the Village Board for their consideration at the May 16th Village
Board meeting. Staff will be in attendance to answer any questions related to this matter.

AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF MOUNT
PROSPECT

Elizabeth Drive, 125 Elizabeth Drive, 2445 East Oakton Street, 113 Weiler Road,
145 Weiler Road, 2425 East Oakton Street, 105 Weiler Road, 130 Weiler Road, 145
Hamilton Road, 2461 East Oakton Street, 2525 East Oakton Street, 2537 East
Oakton Street in Arlington Heights, Illinois, 2420 Oakton Street, 2340 Oakton
Street, 555 West Carboy Road in Mount Prospect, Illinois, 2501 East Oakton
Street, 2531 East Oakton Street in Elk Grove Village, Illinois)
WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code (65 ILCS
5/7-1-13), the Village of Mount Prospect ("Village") has the authority to annex property
surrounded by the Village, which is less than 60 acres in size; and
WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, notice of
the contemplated annexation and zoning of the territory once annexed as 1-1: Limited
Industrial District was published in the Daily Herald, a newspaper of general circulation
in the territory hereinafter described, on May 4, 2017; said date being at least ten (10)
days prior to passage of this Ordinance; and
WHEREAS, notice of the contemplated annexation also was sent by certified
mail to each taxpayer of record in the territory hereinafter described on April 28, 2017;
and
WHEREAS, it is in the best interest of the Village of Mount Prospect that said
territory be annexed to and become part of the Village.
THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois:
SECTION 1: That the findings set forth above are incorporated by reference into
this Section 1 as if fully set forth herein.
SECTION 2: That this President and Board of Trustees further find as follows:
(a) The territory described in Section 3 of this Ordinance contains less
than sixty (60) acres and is wholly bounded by the Village of Mount
Prospect.
(b) Such territory is not within the corporate limits of any municipality, but
is contiguous to the Village of Mount Prospect, Cook County, Illinois, a
municipality existing under the laws of the State of Illinois.
(c) Notice that the corporate authorities of the Village of Mount Prospect
are contemplating the annexation of such territory and the zoning of
the territory once annexed as 1-1: Limited Industrial District has been
published not less than ten (10) days prior to passage of this
Ordinance as required by Section 7-1-13 of the Illinois Municipal Code
(65 ILCS 5/7-1-13).
SECTION 3: That the territory is legally described as follows:

THE SOUTH HALF OF THE SOUTHWEST QUARTER OF THE
SOUTHEAST QUARTER OF SECTION 23, EXCEPT THE SOUTH 50.00
FEET, TOGETHER WITH THE NORTH HALF OF THE SOUTHWEST
QUARTER OF THE SOUTHEAST QUARTER OF SECTION 23 LYING
EAST OF THE WEST LINE OF LOT 16 AND SOUTH OF THE SOUTH
LINE OF LOT 16 IN ELMHURST — ALGONQUIN INDUSTRIAL PARK
UNIT NO. 3 ACCORDING TO THE PLAT THEREOF RECORDED AS
DOCUMENT NO. 20409121, IN COOK COUNTY, ILLINOIS.

QUARTER OF THE NORTHEAST QUARTER OF SECTION 26, EXCEPT

Be and the same is hereby annexed to the Village of Mount Prospect, Cook County,
Illinois, all in conformance with and as shown on the plats and maps of annexation of
said territory prepared by a registered land surveyor of the State of Illinois, attached
hereto and made a part hereof as EXHIBIT A.
SECTION 4: That the Village Clerk is hereby and herewith instructed, to
promptly record with the Recorder of Deeds of Cook County, Illinois:
(a) A copy of this Ordinance certified as correct by the Clerk of said
Village of Mount Prospect; and
(b) The plats of the land included in this annexation, as required by law,
said plats to be attached to the aforesaid certified copy of this
Ordinance.
And to send a certified copy of this Ordinance, within 30 days of adoption, to the Cook
County Election Department/Commission, by certified or registered mail.
SECTION 5: The new boundary of the Village of Mount Prospect shall extend to
the far side of any adjacent right-of-way, provided said right-of-way is not currently
located within the corporate limits of another municipality, and shall include all of every
right-of-way within the area annexed hereby.
SECTION 6: That this Ordinance shall be in full force and effect upon and after
its adoption and approval as required by law.
