OLD BUSINESS A. ZBA 33-V-91, 1623 Cedar Lane The Petitioner is requesting variations to allow a sideyard of 7 feet, rather than the required 10 feet; a rear yard setback of 7 feet, rather than the required 15 feet; and, a zero foot separation between the pool deck and house deck, in order to allow an existing above ground swimming pool and deck. The Zoning Board of Appeals recommended denying these requests by a vote of 2-4. At the request of the Petitioner,~this case was continued from the October 15th BOard meeting due to the fact that a 2/3 vote of~ the Village Board is required in order to override the Zoning Board of Appeals recommendation to deny and only 5 members were in attendance. B. ZBA 57-A-91 and ZBA 58-SU-91, 1028 S. Elmhurst Road 1. 1st reading of AN ORDINANCE AMENDING ARTICLE XVII OF CHAPTER 14 ENTITLED "ZONING ORDINANCE" OF THE VILLAGE CODE OF MOUNT PROSPECT This Ordinance amends the Zoning Ordinance to provide for non-ground mounted satellite antennas as a Special Use in a B-1 Shopping Center District. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit A) 2. 1st reading of AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 1028 SOUTH ELMHURST ROAD This Ordinance grants a Special Use to allow the installation of a roof-mounted satellite antenna on the Walgreen store located at 1028 S. Elmhurst Road. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit B) C. ZBA 60-V-91, 219 South Leonard l~t reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 219 S. LEONARD LANE This Ordinance grants a variation to allow a 2-1/2 foot side yard setback for a shed, rather than the required 5 feet. The Zoning Board of Appeals vote of 3-3 resulted in a recommendation to deny the request. (Exhibit C) D. ZBA 61-V-91, 1631 Greenwood Avenue 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 1631 GREENWOOD AVENUE This Ordinance grants variations to accommodate a circular driveway and to allow a 42% front yard lot coverage, rather than the permitted 35%. The Zoning Board of Appeals recommended granting these requests by a vote of 6-0. (Exhibit D) E. ZBA 62-V-91, 108 North Main Street 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 108 NORTH MAIN STREET This Ordinance grants variations to accommodate a circular driveway and to allow a 45.7% front y~rd lot coverage, rather than the 35% permitted. The Zoning Board of Appeals recommended granting these requests by a vote of 6-0. (Exhibit E) F. ZBA 63-V-91, 8 South Busse Road 1st reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 8 SOUTH BUSSE ROAD This Ordinance grants a variation to allow a 484 square foot shed, rather than the 120 square feet permitted. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit F) G. ZBA 64-SU-91, 501 W. Algonquin Road 1st reading of AN ORDINANCE AMENDING ORDINANCE NO. 4156, GRANTING A SPECIAL USE IN THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR THE ROGERS CORPORATE PARK This Ordinance amends Ordinance No. 4156 to allow the inclusion of additional property within the Planned Unit Development for Rogers Corporate Park on South Elmhurst Road. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit G) H. ZBA 65-SU-91, 400 East Blue Jay Court 1st reading of AN ORDINANCE AMENDING ORDINANCE NO. 4187, GRANTINGA SPECIAL USE IN THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR THE ORCHARD FIELD TOWNHOMES, 400 EAST RAND ROAD This Ordinance amends the site plan attached to Ordinance No. 41871to reflect patios on specific townhomes to encroach into the perimeter yard. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit H) IX. NEW BUSINESS A. ZBA 66-V-91, 215 South Hi Lusi The Petitioner is requesting variations to allow a room addition 8.75 feet and deck 5 feet from an existing detached garage. The zoning Board of Appeals recommended granting this request by a vote of 6-0. B. ZBA 67-V-91, 216 South Main Street The Petitioner is requesting variations to allow a driveway width of 33 feet, at the widest point. The Zoning Board of Appeals recommended granting this variation by a vote of 4-0. At the request of the Petitioner, this case will be presented to the Village Board for consideration at the November 19, 1991 meeting. C. ZBA 69-SU-91 and ZBA 70-SU-91, 606 W. Northwest Hwy~ The Petitioner, Citgo, is requesting an amendment to the Special Use! granted in Ordinance No. 2572 by modifying the slite plan to accommodate construction of a new convenience store building, gas pump islands and canopies, resulting in a minimum setback of 10 feet for the building and structures, rather than the required 30'; to allow a zero parking lot setback at the closest point,i rather than the required 30'; and, to allow 3 off-street parking spaces, rather than the required 8 spaces. The Zoning Board of Appeals recommended granting these requests by a vote of 4-0. D. Recommendations of the Safety Commission: 1. Request of residents for a 3-way STOP at Emerson and Milburn. The Safety Commission recommended denial by a vote of 7-0. 2. Request of resident for painted cross walks withinlthe Mount Prospect Plaza Shopping Center. The Safety Commission recommended contacting the owner of the property since this is private property. 3. Request of residents to delete the No Parking restriction on Sunday for the 200 block of South Pine Street, adjacent to St. Mark Church. The Safety Commission recommended denying the request. E. A RESOLUTION AUTHORIZING THE RELEASE OF SPECIFIED MINUTES OF EXECUTIVE SESSIONS This Resolution authorizes certain minutes of executive session~ to be released from confidentiality, as directed by the Village Board. (Exhibit J) F. 1st 'reading of AN ORDINANCE AMENDING ARTICLE VIII OF CHAPTER 8 ENTITLED "REAL ESTATE TRANSFER TAX" OF THE VILLAGE CODE This Ordinance establishes an exemption from the real estate transfer tax for anyone participating in the State of Illinois H.O.M.E. Program. (Exhibit K) G. Recommendation to accept private and public improvements installed in conjunction with 'Spot Not' the new car wash at River & Kensington Roads. H. Recommendation to accept private and public improvements installed in conjunction with the construction of Nicholas Office Building, 240 East Lincoln Street. X. VILLAGE I~m. NAGER'S REPORT A. Bid results: 1. Gasoline and diesel fuel B. Recommendation to retain consultant to evaluate storm water detention basins in the Kensington Center for Business C. Recommendation to retain consulting engineer relative to the reconstruction of Maple Street between Busse Avenue and Central Road. D. Recommendation to obtain soils tests, which are required in conjunction with the construction of the Fire and Police Station. XI. ANY OTHER BUSINESS XII. ADJOURNMENT
