The Village is pursuing the annexation of the Birch Manor condominiums that are located in unincorporated Cook County.
The property is surrounded by incorporated areas of the Village. The Village has notified all property owners impacted by
this action and all public agencies as required by state statutes.
The subject property is located at the northwest corner of Dempster Street and Linneman Avenue. The 18 -acre parcel is
improved with 288 residential condominium units that are located in eight, 36 -unit buildings that encircle a large
common area. Amenities include tennis courts, a playground, and basketball and volleyball courts.
The Village is pursuing the annexation of this property so that it can provide local services to the owners of these units
and to eliminate inefficient service provision by the county to this pocket of unincorporated land. The property adds
approximately $4.2 million in new equalized assessed value to the Village's tax base, thereby reducing the tax burden to
other taxpayers in the Village.
Per state statutes, the Village is required to pay the Elk Grove Rural Fire Protection District (EGRFPD) a gradually reduced
percentage of the property taxes that they currently receive from the subject properties over the following five years.
The Village must pay the EGRFPD their full levy in year one, 80% in year two, 60% in year three, 40% in year four and
20% in year five. The Village has negotiated a modified payment schedule that provides the EGRFPD with these
payments over a three year period rather than five. The following chart provides an estimate of the required EGRFPD
payment and the amount of property taxes that the Village will receive from the annexation of Birch Manor over that
same time period.

WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code (65 ILCS
5/7-1-13), the Village of Mount Prospect ("Village") has the authority to annex property
surrounded by the Village, which is less than 60 acres in size; and
WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, notice of
the contemplated annexation was published in the Daily Herald, a newspaper of general
circulation in the territory hereinafter described, on February 10, 2017; said date being
at least ten (10) days prior to passage of this Ordinance; and
WHEREAS, notice of the contemplated annexation also was sent by certified
mail and hand delivered to each taxpayer of record in the territory hereinafter described
on February 3, 2017; and
WHEREAS, it is in the best interest of the Village of Mount Prospect that said
territory be annexed to and become part of the Village.
THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois:
SECTION 1: That the findings set forth above are incorporated by reference into
this Section 1 as if fully set forth herein,

said territory prepared by a registered land surveyor of the State of Illinois, attached
hereto and made a part hereof as EXHIBIT A.
SECTION 4: That the Village Clerk is hereby and herewith instructed, to
promptly record with the Recorder of Deeds of Cook County, Illinois:
(a) A copy of this Ordinance certified as correct by the Clerk of said
Village of Mount Prospect; and
(b) The plats of the land included in this annexation, as required by law,
said plats to be attached to the aforesaid certified copy of this
Ordinance.
And to send a certified copy of this Ordinance, within 30 days of adoption, to the Cook
County Election Department/Commission, by certified or registered mail.
SECTION 5: The new boundary of the Village of Mount Prospect shall extend to
the far side of any adjacent right-of-way, provided said right-of-way is not currently
located within the corporate limits of another municipality, and shall include all of every
right-of-way within the area annexed hereby.
SECTION 6: That this Ordinance shall be in full force and effect upon and after
its adoption and approval as required by law.

The Village of Mount Prospect has been engaged in an annexation initiative involving properties currently surrounded
by the Village in the area of Dempster Street and Algonquin Road. The attached map shows the Birch Manor
neighborhood to be the last remaining unincorporated pocket in this immediate area. State statute authorizes
municipalities to forcibly annex properties less than 60 acres in area when surrounded by an incorporated area. The
Village is following through on a standing request from Cook County leadership to annex when possible
unincorporated areas to ensure adequate public safety services are afforded to residents and businesses.
The Village of Mount Prospect is uniquely positioned to provide enhanced life safety and customer services to
residents of Birch Manor. Mount Prospect strives to be responsive to its residents while providing an extensive and
efficient range of services, as described both in this document and on our website [www.mountprospect.org]. In
recent weeks you have received notices of our proposed annexation. We hosted a well -attended open house for Birch
Manor owners and residents on February 151h at the Rec Plex to provide information relative to the annexation.
Several staff representatives were present from the Mount Prospect Public Library and Village departments, including
Police, Fire, Human Services, Public Works, Finance, Community Development and the Village Managers Office, to
provide residents with information on Village services and answer
questions regarding the proposed annexation. While some residents
expressed concern for increased costs associated with incorporation
(a range from $46 to $67 annually for full library and Village
services), many residents were encouraged by the vast services they
will receive as Mount Prospect incorporated customers.
The Village Board of Trustees met on Tuesday, February 215, to
consider the ordinance of annexation. The board took comment
from both staff and residents; it was noted by the trustees and
Mayor that more time should be granted to allow for greater
discussion between staff and Birch Manor residents. Although the
second reading of the ordinance will be on the March 7, 2017
Village Board agenda, the board will continue the matter to the April
5, 2017 meeting to allow for this additional time. There will be no
presentation or discussion at the March 7,h meeting; this item is on
the agenda as a formal procedure to announce the continuation to
the April 5, 2017 date.

The Village prohibits the use of grills on balconies made of combustible material. However, this is not a
violation in unincorporated Cook County, so the Village will not enforce our local restriction. However, we
strongly caution the Association Board to review liability insurance requirements to verify this practice is
authorized and covered. The Fire Department strongly encourages grilling to be prohibited from balconies.
The Fire Department also reviewed the parking lot and fire hydrants layout on site. The parking lot may
require additional striping and fire lane signage once the parking lot is restriped. Existing parking
configurations will not be impacted. The fire hydrants located on site will need minor additional maintenance.
Village staff will work with the Association Board on these maintenance issues.
Policc Pauction; Among the most significant upgrades residents will see is enhanced police protection and
crime free housing programs for rental properties from the Mount Prospect Police Department. Birch
Manor will be included in Beat 3160, which includes the southeast section of our community (Beat Map
attached). The department now has permanent beats so you will be meeting officers and supervisors assigned
to your neighborhood. The Village supports Police Department staffing that allows for emergency response
and crime prevention and investigation activities from upwards of 20 sworn officers and supervisors
including command staff during shifts. In evening shifts a Special Operations Unit is deployed to ensure
additional Police services are provided during peak periods. The Village has embraced community policing to
enhance safety and security of stakeholders. We look forward to working as your advocates to ensure a high
quality of life for residents.
• Addressing. The Village will not require you to change or update your address in any way due to the
annexation.
• Waste Disposal. The Village participates in a municipal solid waste disposal contract with Republic Services.
A representative from our Public Works Department is in contact with your property manager regarding
options for solid waste disposal and recycling. If you have questions regarding waste disposal, please contact
our Public Works Department at 847/870-5640.
• Water Service. Your water provider is currently Illinois American. Village staff is researching the feasibility of
providing Birch Manor with water service and will keep the property manager informed on the status.
• Building. Any new buildings or additions to existing structures, renovations, or demolitions, will now require
permits and inspections through the Village of Mount Prospect Community Development Department. A
good rule of thumb is if it involves adding, moving, or exposing water, gas, electricity or walls, it will likely
need a permit. The Village's website contains detailed information on the sign regulations, building permit
and inspection requirements. For more information on building permit requirements, call 847/870-5675.
• Prrr)gr y — atintenargc . All property within Village limits, including buildings, structures, and the surrounding
site, are required to be maintained to the minimum property maintenance standards adopted by the Village.
For example, all buildings and structures are to be maintained in safe and sanitary manner to protect the
public health. The Village has staff on hand to address property maintenance violations that may be found
throughout the Village. For more information on property maintenance, visit our website or call 847/870-

Rental Properties. The Village participates in a Crime Free Housing Program per Village ordinance. In brief,
the ordinance states that the owner of any building or dwelling unit which is rented must obtain a residential
operator's license. Furthermore, a residential operator's licenses shall not be issued until the landlord, or
designated agent, has attended and successfully completed the Crime Free seminar sponsored by the Village
of Mount Prospect. New landlords (or agents) have sixty (60) days to successfully complete the Crime Free
seminar. Failure to do so may result in fines and possible loss of their license to rent. The expanded Crime

AN ORDINANCE AMENDING CHAPTER 14 "ZONING" OF THE VILLAGE CODE OF MOUNT
PROSPECT, ILLINOIS
WHEREAS, the Village of Mount Prospect is a home rule municipality as defined by
Article VII, § 6 of the Illinois Constitution of 1970; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire
to make certain amendments to the Village Code of Mount Prospect as set forth below; and
WHEREAS, pursuant to the authority granted under the Illinois Municipal Code and in
accordance with home rule authority granted to home rule municipalities, the President and
Board of Trustees of the Village of Mount Prospect approve the amendments as set forth below.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: Section 14.318 "Fences and Walls," of Article III, "General Provisions," to
Chapter 14, "Zoning," to the Mount Prospect Village Code shall be removed in its entirety and
shall be replaced in its entirety as follows:
14.318: FENCES AND WALLS
General Provisions: It shall be unlawful to construct, erect or replace any fence without
first obtaining a permit from the community development department. The permit may be
granted only if the proposed fence is in compliance with the provisions of this code. For
the purposes of this section, freestanding walls shall be considered fences.
A. Height And Location;
Separation: Where existing drainage patterns would not be adversely impacted, a
maximum of two inch (2") separation shall be maintained between the fence and the
finished grade to provide for adequate drainage. Fences located across drainage swales
shall be a maximum of six inches (6") above finished grade, unless the village engineer
requires a larger separation. Fences shall not be permitted in floodway areas as
designated on FEMA's flood boundary and floodway map.
2. Sight Triangle: No fence greater than three feet (3') in height shall be placed within a
sight triangle so as to obstruct or limit the line of sight for a motorist, cyclist, or
pedestrian.
3. Encroachment: All fences shall be entirely on private property. Fences may not encroach
on adjoining lots or public rights of way.
B. Construction:
1. Fences may be constructed of wood, chainlink, masonry, aluminum, wrought iron,
composite, or similar materials and shall be constructed so that only a smooth finished
side faces an abutting lot or road.
2. It shall be unlawful to maintain or construct any fence composed in whole or part of
barbed wire or with any similar materials designed to cause injury to person, or any wire
charged with electrical current, anywhere within the village except to protect industrial
property, in which case, barbed wire must be at least six feet (6') above sidewalk and
extend inward of property.
3. Fences used for the purpose of screening outdoor storage, mechanical or utility
equipment in commercial and industrial districts shall be of solid style. Fences may be
constructed of wood, masonry, or other material subject to approval by the director of
community development.
All other fences may be open style except where adjacent to residential property, in
which case, the fence must be a solid style.
4. Grades at property lines shall not be altered due to fence construction unless a grading
plan is submitted to and approved by the community development director.
5. Temporary construction, safety, and silt fencing may be permitted only as part of a
construction project for which a current building permit exists. Temporary construction,
safety, and silt fencing shall be removed'upon completion of the construction project.
SECTION 2: Subsection C (4) of Section 14.504, "Standards For Planned Unit
Developments," of Article V, "Planned Unit Development," to Chapter 14, "Zoning," to the Mount
Prospect Village Code shall be amended to read as follows:
4. In residential planned unit developments the maximum number of dwelling units allowed
per acre shall not exceed forty eight (48) units per acre for developments incorporating
senior housing or assisted living facilities.
SECTION 3: Land Use Table 1: "Residential and Recreational Zoning Districts," of Section
14.604, "Land Use Tables," of Article VI, "Zoning Districts," to Chapter 14, "Zoning," to the
Mount Prospect Village Code shall be removed in its entirety and replaced in its entirety as
follows:
