HomeMy WebLinkAbout10/09/1993 Coffee with Council MinutesMr. & Mrs. Kinsella discussed their request for a modification to the
Building Code to allow two (2) air conditioner compressors to remain
in their side yard. This modification is required because they encroach
in the side yard by more than the 25% allowed by the code. Mr. Kinsella
gave a brief summary of the events leading to this request. He indicated
the approved architectural plans for his addition showed the compressors
on the side of the house but no dimensions were given to show distance
from the lot line. He was not aware of a problem with the placement
of the compressors until notified by the Village. Also his neighbor
complained about the location of the compressors and other items located
at the side of the house such as electrical boxes and service lines,
air vents and sprinkler controls. Village staff indicated they could
not grant the modification unless Mr. Kinsella received written
acceptance of the modification from his neighbor. Mr. Kinsella met
with the neighbor several times and thought he had approval a couple
of times but each time the approval was withdrawn. Mr. Kinsella is
requesting the Village Board consider his request for a modification
to the Building Code.
There was discussion by the trustees of side yard encroachments and
in this case the aesthetics of not only the compressors which were
in the side yard but also the presence of other items such as electrical
boxes and service lines, air vents and sprinkler controls all in the
same location and visible to the neighbor.
Trustee Hendricks stated his feelings against side yard encroachments
and the granting of variations but also noted that since staff had
approved the plans without requiring the dimension be shown for the
placement of the compressors he would consider approval of the
modification request.
Trustees Skowron and Wilks suggested a meeting be held with Mr. Kinsella
and the neighbors and a neutral party to try to reach a acceptable
compromise.
Trustee Skowron suggested the Village Manager and Mayor arrange such
a meeting and select a neutral party. Trustee Skowron and Wilks
indicated they would be willing to serve as the neutral parties.
The meeting was adjourned at 12:00 noon.
