Motion to authorize the Village Manger to sign the Intergovernmental Agreement between the Elk Grove Township Road District and the Village of Mount Prospect This intergovernmental agreement between the Elk Grove Township Road District (EGT) and the Village of Mount Prospect authorizes EGT to continue the road maintenance of certain recently annexed portions of Malmo Drive and Imperial Court. C. MOTION TO WAIVE THE 2nd (SECOND) READING AND ADOPT AN ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE OF MOUNT PROSPECT This ordinance decreases the number of"F-3" Liquor Licenses by One (1) Bar 145 MP LLC d/b/a Bar 145 at 34 S. PZ-25-16 908 Golfview Place-VARIATION- Exterior Side Yard 1st reading of AN ORDINANCE GRANTING VARIATIONS (EXTERIOR SIDE YARD) FOR PROPERTY LOCATED AT 908 GOLFVIEW PLACE, MOUNT PROSPECT, ILLINOIS This ordinance allows a Variation to allow a deck to encroach ten feet (10') into the required twenty foot (20') exterior side yard setback for property located at 908 Golfview Place. The Planning and Zoning Commission recommended approval of the request for Variation by a 5-0 vote. B. 1 st reading of AN ORDINANCE AMENDING CHAPTER 11 OF THE VILLAGE CODE OF MOUNT PROSPECT WITH REGARD TO CONFLICTS WITH CERTAIN HOME RULE COUNTY ORDINANCES This ordinance amends Chapter 11 of the Village Code of Mount Prospect allowing the Village, as a home rule municipality, to opt out of the new Cook County minimum wage and sick leave requirements. C. 1st reading of AN ORDINANCE AMENDING CHAPTER 18 ENTITLED Village Board Meeting-February 7,2017 Page 2 of 107 "TRAFFIC" OF THE VILLAGE CODE OF MOUNT PROSPECT This ordinance amends Chapter 18,Article XX, Schedule VI (18.2006) of the Village Code of Mount Prospect, to prohibit parking at all times along the south side of Highland Street between Emerson Street and Elm Street. The Transportation Safety Commission recommended approval of by a vote of 7-0. D. 1 st reading of AN ORDINANCE MAKING CERTAIN AMENDMENTS TO THE ANNUAL BUDGET ADOPTED FOR THE FISCAL YEAR JANUARY 1, 2016 AND ENDING DECEMBER 31, 2016 XI. VILLAGE MANAGER'S REPORT A. Presentation of the Joint Emergency Management System strategy for 2017 and an overview of the Everbridge Software communication tool. The Joint Emergency Management System (JEMS)was created in 2016 through Northwest Central Dispatch. Made up of ten local communities, JEMS was established to enhance standardization and coordination of emergency management. Everbridge Software is a tool used by the Village to effectively communicate with the community during emergency situations. B. A RESOLUTION AMENDING THE EMPLOYEE PERSONNEL MANUAL OF THE VILLAGE OF MOUNT PROSPECT This resolution amends Section VI, "Compensation and Benefits," letters B and Q of the Employee Personnel Manual by including an additional holiday and increasing longevity pay. C. Motion to accept bid results for water meter services in an amount not to exceed $94,000 D. Mayor Juracek presented for a first (1S) reading An Ordinance Amending Chapter 13, "Alcoholic Liquors" of the Village Code of Mount Prospect. This ordinance increases the number of Class "F-5" Liquor Licenses by one (1) Best Banquets, Inc. d/b/a Victoria in the Park located at 1700 S. Elmhurst Road. page 1 of 7 Village Board Meeting Minutes January 17, 2016 Village Board Meeting-February 7,2017 Page 5 of 107 Village Manager provided background information stating the applicant, Ted Mavrakis, has a deep- rooted background in the restaurant/hospitality industry. Mr. Mavrakis has met Village requirements and submitted all required documentation. Mr. Mavrakis was in attendance to provide additional information and respond to questions from the Board. Mr. Mavrakis stated he is a former resident and is happy to bring this business back to Mount Prospect. Banquet facility manager Joanna stated they already have appointments booked with prospective clients. The Mayor and Village Board expressed their support and appreciation for bringing Victoria in the Park back to town. Motion to amend the Employment Agreement between the Village of Mount Prospect and the Village Manager Mayor Juracek presented a motion to amend the Employment Agreement between the Village of Mount Prospect and the Village Manager initially approved in September, 2015. The amended agreement includes adjustments to Mr. Cassady's compensation based on exceptional leadership and completion of goals established in early 2016. The Board awarded a performance increase in the amount of five (5) percent. In addition, Mr. Cassady was awarded a one-time performance based bonus of$15,000 and will receive reimbursement for a term life insurance policy totaling $3,500. Public Comments Louis Goodman Mr. Goodman congratulated Mr. Cassady on a job well done. Mr. Cassady thanked the Board for their confidence and support and added he is thankful for being a part of a great team. He further stated his commitment to hitting the targeted goals set before him in 2017. (VBA 01-17) COMMUNICATIONS AND PETITIONS—CITIZENS TO BE HEARD Howard Richardson, WWII veteran, proudly presented a donation of three (3) Badaxx life-saving tools to the Mount Prospect Fire Department on behalf of VFW Post 1337. Joining Mr. Richardson from VFW Post 1337 were Joe Scanlon and Charles Ohm. Deputy Fire Chief John Dolan accepted this donation and expressed gratitude and appreciation for such a generous donation. OLD BUSINESS Mayor Juracek presented for a second (2nd) reading the following three (3) ordinances pertaining to the creation of the Prospect and Main Tax Increment Financing (TIF) District. At the regular meeting of the Village Board on December 20, 2016, a public hearing was held to discuss the creation of the Prospect and Main Tax Increment Financing District. The first (1st) readings of these ordinances were presented at a Special Meeting of the Village Board on January 10, 2017. A. 2nd reading of an Ordinance Designating the Village of Mount Prospect and Main Tax Increment Financing District Redevelopment Project Area. B 2nd reading of an Ordinance Approving the Village of Mount Prospect Prospect and Main Tax Increment Financing District Redevelopment Project Area Redevelopment Plan and Project C. 2nd reading of an Ordinance Adopting Tax Increment Financing for the Village of Mount Prospect Prospect and Main Tax Increment Financing District. Mayor Juracek stated tonight concludes many months of meetings and discussions pertaining to the creation of this TIF District. She stated she appreciates the community's involvement and the thoughtful discussions it generated and the important questions it raised. D. 2nd reading of an Ordinance Annexing Certain Property to the Village of Mount Prospect (1200 Dempster Street) Mayor Juracek presented for a 2nd (second) reading an Ordinance Annexing Certain Property to the Village of Mount Prospect(1200 Dempster Street) Village Manager Michael Cassady stated discussions regarding this annexation have been ongoing since March, 2016. Concern over the use of the property as a semi-truck trailer parking lot and given its close proximity to residential areas, the Village pursed annexation of this property in an effort to control it. This second reading has been deferred a number of times to continue discussion with United Airlines. The Village has maintained amicable relations with United Airlines throughout the annexation discussions and expects it to continue in the future. E. 1St reading of an Ordinance Annexing to and Zoning of Certain Property by the Village of Mount Prospect(1200 E. Algonquin Road) Mayor Juracek presented for a first reading an Ordinance Annexing to and Zoning of Certain Property by the Village of Mount Prospect. A public hearing was held at the December 20, 2016 Village Board to discuss the annexation of approximately 44 acres of property owned by United Airlines (UAL) in unincorporated Cook County located within the southern portion of the Village. The first reading of this ordinance was deferred to the January 17, 2017 Village Board meeting to continue discussions with United Airlines. Trustee Zadel, seconded by Trustee Polit, moved to waive the rule requiring two (2) readings of an ordinance. Trustee Hoefert, seconded by Trustee Saccotelli, move for approval of Ordinance No. 6297: ORDINANCE ANNEXING TO AND ZONING OF CERTAIN PROPERTY BY THE VILLAGE OF MOUNT PROSPECT (1200 E. ALGONQUIN ROAD) Upon roll call: Ayes: Hoefert, Matuszak, Polit, Rogers, Saccotelli, Zadel Nays: None Motion carried. NEW BUSINESS A. A Resolution in Support of LIT Industrial Limited Partnership at 601-609 Dempster Street, Mount Prospect, IL Making Application for Renewal of a Cook County Class 6B Designation Community Development Director Bill Cooney provided background information stating the 601 —609 Dempster building is a multi-tenant warehouse/distribution facility that is home to four tenants that employ over 220 individuals. LIT is requesting the Class 6b abatement to maintain their taxes at around $1.00 per square foot for their property. If the extension is not granted they estimate that their tax bill would rise to $2.50 per square foot. Similar properties in nearby Lake and DuPage County range from $1 to $1.50 per square foot. The renewal would be for an additional 12 years and would enable them to maintain existing tenants and competitively market their property against similar properties in neighboring counties. Mr. Cooney stated the petitioner, Andy Lowe, was in attendance to provide additional information and respond to questions from the Board. Mr. Lowe addressed the Board and thanked them for their consideration. Mr. Lowe provided the following information: page 5of7 Village Board Meeting Minutes January 17, 2016 Village Board Meeting-February 7,2017 Page 9 of 107 • Currently 100% leased to four tenants • Provide employment to over 220 people • Renewal of the 6b provides an attractive incentive for tenants wanting to expand • Brings more jobs to Mount Prospect Trustee Hoefert, seconded by Trustee Polit, moved for approval of Resolution No. 01-17 A RESOLUTION IN SUPPORT OF LIT INDUSTRIAL LIMITED PARTNERSHIP AT 601-609 DEMPSTER STREET, MOUNT PROSPECT, IL MAKING APPLICATION FOR RENEWAL OF A COOK COUNTY CLASS 6B DESIGNATION Upon roll call: Ayes: Hoefert, Matuszak, Polit, Rogers, Saccotelli, Zadel Nays: None Motion carried. VILLAGE MANAGER'S REPORT A. Motion to accept purchase of Interspiro surface supplied air system in an amount not to exceed $31,975.54. Mayor Juracek presented a request to accept purchase of Interspiro surface supplied air system in an amount of$31,975.54 Deputy Fire Chief John Dolan presented the Fire Department's request and answered questions from the Board. Chief Dolan stated that while instances requiring this system are rare, they are very dangerous. This system provides three unique features: • Continuous air supply • Continuous communication • Continuous contact Deputy Chief Dolan added the most important benefit of the system is the increased safety it will provide to our divers. Keeping divers safe will increase the likelihood of successful rescues. The equipment will be purchased directly from Interspiro since they are a sole source provider of the Surface Supplied Air system and there are no government purchasing programs available. Board Response Thanked the Fire Department for protecting our residents and this purchase is important to keep our first responders safe. Motion to accept 4-year proposal for the lease and maintenance of nine (9) multi-function copiers in an amount not to exceed $227,930. page 6 of 7 Village Board Meeting Minutes January 17, 2016 Village Board Meeting-February 7,2017 Page 10 of 107 Finance Director David Erb presented background information and answered questions from the Board. Mr. Erb stated the Village began the practice of leasing copiers fifteen (15) years ago. Leasing equipment is a cost effective way to avoid the high cost of long-term copier maintenance while allowing the customer to take advantage of new technology sooner. Nine copiers are scheduled to be replaced in 2017 and each department was asked to provide their function requirements for the new copiers; i.e. copy, print, fax and scan. The Village received quotes from two companies in the Chicagoland area that met the needs of the Village, Marco Technologies and Gordon Flesch Company. While both have outstanding reputations, Gordon Flesch Company returned the lowest overall cost for lease and maintenance of the nine copiers resulting in a savings of$26,530 based on the quote provided by Marco Technologies Trustee Zadel, seconded by Trustee Polit moved for approval to accept 4-year proposal for the lease and maintenance of nine (9) multi-function copiers in an amount not to exceed $227,930. (VBA 04-17) ANY OTHER BUSINESS Mayor Juracek announced there is still time to order tickets for the Centennial Celebration on February 4, 2017. The Mount Prospect Historical Society will present a reenactment and re-dedication of Village Green as Centennial Green with fireworks concluding the celebration on the evening of February 3rd Trustee Hoefert discussed the Gregory Street sidewalk improvements and suggested we meet with the neighborhood to discuss the project to keep residents informed. Comments from the Board pertaining to the new parking garage/deck questioned if the signs were too large for people driving smaller vehicles to see around. It was suggested that the enter/exit directional signs were confusing. ADJOURNMENT There being no further business to discuss Mayor Juracek asked for a motion to adjourn. Woodson initiated Negro History Week, which, in 1976, was expanded to the entire month of February to recognize and celebrate contributions of African-Americans to our nation's culture and history; and WHEREAS, throughout our Nation's History, African Americans from all walks of life have offered their talents to the betterment of American Society. Through their extraordinary accomplishments, these leaders helped bring our Nation closer to fulfilling its founding ideas; and WHEREAS, from the beginning of our Republic, free people of African descent have seen themselves as citizens, members of society, and therefore due equal rights. To honor the efforts of those who have fought for social justice in our nation, the 2017 Black History Month theme, "The Crisis in Black Education," focuses on the crucial role of education in the history of African Americans. Frederick Douglass, W.E.B. Du Bois, Martin Luther King, Jr., and Fanny Lou Hamer are all associated with the struggle for civil rights; and WHEREAS, throughout "Black History Month," we celebrate the many contributions African Americans have made to our Nation, and we are reminded of their courage in their struggle to change the hearts and minds of our citizens. NOW, THEREFORE, I, Arlene A. Juracek, Mayor of the Village of Mount Prospect, do hereby proclaim February, 2017 as "BLACK HISTORY MONTH" and I encourage all individuals to take advantage of opportunities to educate themselves and raise awareness and appreciation of the history and contributions of African-Americans to our great nation, while striving to eliminate even the most minute evidence of discrimination towards all individuals. 2017-01RD INTERGOVERNMENTAL AGREEMENT Between the Elk Grove Township Road District And the Village of Mount Prospect This Intergovernmental Agreement(the"Agreement")is made and entered into this 23`d day of January,2017 by and between the Village of Mount Prospect(the"Village"), a body politic and corporate of the State of Illinois and Elk Grove Township Road District, a unit of local government (hereinafter referred to as"EGT"). The Village and EGT are sometimes collectively referred to as the "Parties." RECITALS WHEREAS, the Constitution of the State of Illinois, 1970, Article VII, Section 10, authorizes units of local government to contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and WHEREAS, the Village and EGT are units of government within the meaning of the Constitution of the State of Illinois, 1970, Article VII, Section 10,having the power and authority to enter into an intergovernmental agreement; and WHEREAS, EGT has maintained certain portions of Malmo Drive and Imperial Court (the "Roads," see attached Exhibit A) that have been annexed into the Village's corporate boundaries so that the Village now has jurisdiction over the Roads and an obligation to maintain them; and WHEREAS, the Village and EGT believe it is mutually beneficial if EGT continues to maintain the Roads and include the mileage of the Roads in the mileage report it files with the county; and WHEREAS, the Village and EGT find it is in their interests to enter into an agreement whereby EGT shall maintain the Roads; and WHEREAS, the Village and EGT desire by this Agreement to set forth their respective obligations and responsibilities concerning the maintenance of the Roads; and NOW, THEREFORE, in consideration of the promises, covenants, terms and conditions set forth in this Agreement, the Parties hereto agree as follows: Section 1. Incorporation of Recitals. The above recitals are incorporated into this Agreement as if fully set forth herein. Section 2. Term of the A reement, This Agreement, which is a legal,valid and binding contract enforceable against both the Village and EGT, shall be for a five-year(5) term,beginning at the date when both Parties have approved and executed the Agreement. The Agreement shall be automatically renewable for additional 5 year terms unless either Party terminates the Agreement by giving written notice at least six (6)months in advance of the termination date. 1 Village Board Meeting-February 7,2017 Page 29 of 107 Section 3. Scope of Agreement. It is the intention of this Agreement to authorize EGT to provide certain road and roadside maintenance for those portions of the Roads that have been annexed into the Village's corporate boundaries, if and when specifically requested by the Village, and if and when such services are within the capabilities of EGT. All work shall be provided on an as-needed as determined by the Village and on an as-available basis as determined by EGT. The Village shall provide to EGT a list of work items as needed to be completed subject to scheduling by EGT. These services may include the following: street sweeping, snow and ice removal, pothole patching, full-depth bituminous pavement repairs, curb repairs, crack sealing, pavement marking, catch basin and inlet repair and cleaning, storm sewer cleaning, storm sewer outfall maintenance and repair. The scope of this Agreement shall not extend to nor include furnishing by EGT of towing,police or other code or related enforcement powers allocated to, and governed by, the Village, even if such services are required for the Roads. By mutual agreement of the Village and EGT, the Village may request, and EGT may agree to provide and, in such event, the Village shall pay for additional specialized services of EGT, in addition to the above cooperative services. Section 4. EGT Annual Miler a lie oat. EGT shall be able to include the distance of the Roads in its annual mileage report submitted to the County of Cook, Illinois. Section 6. Indemnification. The Village shall defend,indemnify and hold harmless EGT, and its officers, agents and employees, from all and any liability, losses, costs, damage or expense, or injury to person or property, including reasonable attorneys' fees, arising out of the execution of this Agreement, EGT's failure to perform any provisions of this Agreement, or the termination of this Agreement with its terms, with the exception of any liability, losses, costs, damage or expense, or injury to person or property arising out of or resulting from (1) the sole action, negligence, malfeasance, or misfeasance of the Village, or its officers, agents and employees in the performance or non-performance of any act pursuant to this Agreement; or (2) any claim by an employee, agent, or subcontractor of the Village. EGT shall defend, indemnify and hold harmless the Village, and its officers, agents and employees, from all and any liability, losses, costs, damage or expense, or injury to person or property, including reasonable attorneys' fees, arising out of or resulting from (1) the sole action, negligence, malfeasance, misfeasance, of EGT or its officers, agents or employees in the performance or non-performance of any act pursuant to this Agreement; or (2) any claim by an employee, agent or subcontractor of EGT. The Village and EGT acknowledge that each party shall, if requested by the other party, furnish the other with a current certificate of insurance or self-insurance evidencing their respective existing public liability, property damage and workmen's compensation insurance coverages at the time of the signing of this Agreement, and that during the term of this Agreement, each party will maintain not less than the same level of insurance coverage. 2 Village Board Meeting-February 7,2017 Page 30 of 107 Seection 7. B. Modification. This Agreement may not be altered,modified or amended except by a written instrument signed by both Parties. Provided, however, the Village and EGT agree that provisions required to be inserted in this Agreement by laws, ordinances, rules, regulations or executive orders are deemed inserted whether they appear in this Agreement and that in no event will the failure to insert such provisions prevent the enforcement of this Agreement. C. Force Mgiter'. Neither the Village nor EGT shall be liable for failing to fulfill any obligation under this Agreement to the extent any such failure is caused by any event beyond EGT's or the Village's control and which event is not caused by EGT's or the Village's fault or negligence. Such events shall include,but are not limited to, acts of God, acts or war or terrorism, fires, lightning, floods, epidemics or riots. D. Entire Al reement. This Agreement constitutes the entire agreement between the Village and EGT, merges all discussion between them and supersedes and replaces any and every other prior or contemporaneous agreement,negotiation,understanding,commitments and writings with respect to such subject matter hereof. E. Severabili_y. The following list is a summary of these findings: • A hardship due to the physical surroundings, shape, or topographical conditions of a specific property not generally applicable to other properties in the same zoning district and not created by any person presently having an interest in the property; • Lack of desire to increase financial gain; and • Protection of the public welfare, other property, and neighborhood character. Per the Petitioner, a hardship exists due to the unique features of the Subject Property and needs of the women who reside there. The Department of Human Services requires that the six intellectually and physically disabled women receive day training services, which are currently provided in the home. The Petitioner states that the construction of this deck would afford the women access to the outdoors at their home, which they cannot currently access due to the presence of shallow doorways and staircases. The Petitioner weighed several options, including the construction of a concrete ramp from the public sidewalk,building a ramp from the back door to the existing patio on the west side of the home, or constructing a patio on the north side of the property. The Petitioner states that these options are not feasible for the following reasons: because the deck would be too far from the restroom and house telephone, it would be insufficient in size, it would require that the house to be remodeled for entry and exit purposes, and it would be cost prohibitive. The Petitioner further states that the granting of the variations will not alter the essential character of the neighborhood, harm public welfare, or be injurious to other property improvements within the neighborhood. Staff has reviewed the Petitioner's request and finds that unique conditions exist that are not generally applicable to other property. Per the Petitioner's application, the property is a supported living home that houses six elderly women with intellectual and physical disabilities and provides services by employees in the home. The proposed deck would allow for access to the outdoors at their current home. The Petitioner considered alternative options but found them to be impractical given the unique use of the property. RECOMMENDATION Staff finds that the variation request meets the variation standards as listed in the Zoning Code and that granting such request would be in the best interest of the Village. The Subject Property functions as a family community residence for six elderly women with intellectual and physical disabilities. The Subject Property is a corner lot whose front yard is along Golfview Drive and exterior side yard is along Golfview Place. The Subject Property is zoned RI Single-Family Residence and borders the RI Single-Family Residence District on all sides. Mr. Shallcross stated that the Plat of Survey indicates that greenspace and a sidewalk currently exist between the driveway and the front of the home. The Petitioner proposes to remove the sidewalk and construct a twenty-four foot (24') wide by seventeen and a half foot (17.5') long deck with a handicap ramp. The proposed structure encroaches ten feet (10') into the required twenty foot (20') exterior side yard setback. Hearing no further questions for Staff, Chairman Donnelly swore in the Petitioner- Shawn Kirby 746 E. 156 Place South Holland, Illinois 60477. Mr. Kirby stated that he is with Search and gave a brief overview outlining Search's mission. He stated that the seven Search group homes are located in Mount Prospect and that their largest day training program is located in the Kensington Business Park. He further explained that they have been fortunate enough to receive several CDBG grants from the Village and praised the Community Development Department for their support. He thanked the Commission for their time and consideration. Chairman Donnelly asked if the residents come in and out daily from the home. Mr. Kirby explained that this site is unique in that the program is in house training for the individuals that live there. The elderly residents don't need to leave the home in order to dot he state mandated day training. Mr. Beattie asked if Search owned the home and if new residents will enter the home. Mr. Kirby stated that Search owns the home and as long as they are able to provide the services they will continue to accept new residents as spot become available. Commissioner Beattie asked the Petitioner if the condition to keep the deck unenclosed was an issue. Mr. Kirby stated that it was not an issue and that they would keep in unenclosed. Standards/Variation, A variation from the zoning regulations shall not be granted by Planning and Zoning unless findings of fact based on evidence is made in each specific case that affirms the following: 1. The conditions upon which an application for a variation are based are unique to the property for which the variation is sought and are not generally applicable to other property in the same zoning area; We are requesting a variance based on the unique needs of the ladies who reside there. This is a supported living group residence that is home to six elderly women with intellectual and physical disabilities. These ladies do not attend our Adult Learning Program located in the Kensington Business Park. Instead, we consider them "retired". The Department of Human Services still requires that they receive day training services, so we provide these services in their own home. The curriculum has a recreation and leisure focus more along the lines of community based senior support services. Unfortunately the shortcomings of the property, such as steps and a narrow back doorway, limit the residents'ability to enjoy the front or backyards. Through our variation request, we are trying to change this. We are seeking the Board's support to construct a large accessible deck on the front of 908 Golfview Place, which would afford the ladies access to the outdoors at their own home. 2. Because of the physical surroundings, shape or topographical conditions of the specific property or a specific hardship to the owner would result; We have considered three options to help the six ladies gain access to their yard.All three hove proven much too impractical and expensive. a. The first option we looked at is the construction of a patio on the north side of the garage. This is not an option as: It would be much too expensive and too far from the bathrooms and landline phone inside the house. Also, the addition of a patio on the property would be considered a permanent structure and would negatively affect the drainage of the property. It also could quite possibly negatively affect drainage for the neighbor to the north of 9078. Village Board Meeting-February 7,2017 Page 50 of 107 b. The second option was romping from the back door to the existing patio on the east side of the house. This is not an option because: • The back door is much too small to accommodate persons using wheelchairs, walkers and other assistive devices, • The existing patio is much too small to accommodate table and chair seating f or eight, and; • There are two steps down to the patio which would require a ramp down to the deck of at least 12 feet total and consume the entire size of the patio. c. The third option was a concrete ramp from the public sidewalk. The ramp would stretch approximately 54 feet and be much too costly. In addition, the ladies would have to walk a total distance of approximately 200 feet from the front door down around the corner. The public sidewalk that they would need to use is irregular and fraught with many tripping hazards. Again, the existing patio is way too far from the bathrooms inside the house and landline phone. Finally, the current patio would require the construction of railings for safety all around. Other reconfigurations of the patio/west side yard would require the relocation of three window wells, a whole house generator and the central air conditioning unit. 3. The purpose of the variation is not based upon desire to increase financial gain; Search is a not-for-profit,social service agency providing services to adults with intellectual disabilities in supported living and adult learning settings. There will be no financial gain by constructing the accessible deck and ramp. 4. The alleged difficulty or hardship is caused by this chapter and has not been created by any person having interest in the property; The deck and ramp will be used by the ladies who reside there. 5. The granting of the variation will not be detrimental to the public welfare or injurious to the other property or improvements in the neighborhood; Quite the opposite, the neighbors of 908 Golfview Place are fully supportive the ladies and our efforts to support them in our shared community. Terese DATE: January 25, 2017 RE: Cook County Ordinances on Sick Leave and Minimum Wage We were asked to provide a summary of the new requirements under the Cook County sick leave and minimum wage ordinances and an analysis of the Village of Mount Prospect's options for opting out of the new requirements. I. Cook County Sick Leave Ordinance On October 5, 2016 the Cook County Board of Commissioners approved an ordinance that establishes earned sick leave for employees in Cook County. The ordinance will take effect on July 1, 2017. The ordinance requires that employers with at least one employee with a place of business in Cook County must comply with the new requirements. A covered employee is one that in a particular two-week period performs at least two hours of work for an employer while physically present in Cook County. Covered employees are eligible for earned sick leave if they work at least 80 hours for an employer within a 120-day period. Covered employees will begin to accrue paid sick leave on the first calendar day after starting covered employment or on the date the ordinance goes into effect. For every 40 hours that the covered employee works after they begin accruing sick leave, he/she shall accrue one hour of earned sick leave. The accrued sick leave will cap at 40 hours of earned sick leave accrued per 12-month period. At the end of the 12-month period, a covered employee can carry over half of their unused sick leave (up to 20 hours max). The earned sick time may be used when the employee or an employee's family member is ill or injured or in order for the employee to receive medical care, treatment, diagnosis or preventative care or if the employee or family member is a victim of domestic violence. Family member includes child, spouse, parent, sibling, grandparent or 375066_1 Village Board Meeting-February 7,2017 Page 66 of 107 grandchild. The new requirements do not interfere with the rights of covered employees to enter into collective bargaining agreements with their employers. The ordinance can be waived in a collective bargaining agreement if done so clearly. If an employer violates the sick leave ordinance, the employee may recover damages in a civil action equal to three times the full amount of unpaid sick leave denied or lost by reason of the violation. The employee can also recover the interest on that amount owed. II. Cook County Minimum Wage Ordinance On October 26, 2016, the Cook County Board of Commissioners also approved an ordinance that establishes a minimum wage in Cook County. This ordinance also takes effect on July 1, 2017. Covered employees under this ordinance are defined that same as under the sick leave ordinance. However, employers are defined differently under this ordinance. For an employer to be covered, they must still employ at least one covered employee. However to qualify, an employer must maintain a business facility within Cook County and/or be subject to one or more of the license requirements in Chapter 54 of the Cook County Code. Under the ordinance, every qualifying employer shall pay no less than the wages set forth to each covered employee for each hour of work performed while physically present in Cook County. The ordinance sets forth the minimum hourly wage beginning July 1, 2017 as the greater of: minimum wage set by minimum wage law, minimum hourly wage set by the Fair Labor Standards Act or$10.00 per hour. The amount per hour then increases by one dollar per hour each year according to the ordinance for the next three years, up to $13.00 per hour. The ordinance also specifies the minimum hourly wage for occupations that receive gratuities. Employers who fail to follow the Cook County requirements as to minimum wage are subject to fines of$500-$1,000 for each offense and for each date that the violation continues. III. The Village of Mount Prospect's Options The Village of Mount Prospect, as a home rule municipality, can draft an ordinance opting out of the new Cook County minimum wage and sick leave requirements within the boundaries of the municipality. The ordinance would be to amend the Village Code in order to clearly define the sick leave and minimum wage regulations that apply to employers in the Village of Mount Prospect. The Code would be amended to state that 375066_1 Village Board Meeting-February 7,2017 Page 67 of 107 employers within the Village must comply with all federal and/or state laws and regulations regarding minimum hourly wage and paid sick leave and that no additional obligations with regard to paid sick leave or minimum hourly wages shall apply, including any additional obligations adopted by the Cook County Board of Commissioners. There are some limitations in terms of the reach of an ordinance passed by the Village to opt out of the Cook County requirements. The first limitation is on businesses taking advantage of the 6B tax classification incentives. Under section 74-74 of the County Code, as amended by the minimum wage ordinance, any business seeking a property tax incentive from the County is required to submit an affidavit or certification that the applicant pays a wage that meets the Cook County minimum wage ordinance requirements. At this time, the same does not apply to the sick leave requirements imposed by Cook County. Therefore, even if Mount Prospect enacts an opt-out ordinance, if a business is seeking a 6B tax classification in the Village of Mount Prospect, the business will still need to comply with the Cook County ordinance as to minimum wage requirements. Another potential limitation is that if there is a business that has a place of business within the Village that also has business in another village in Cook County; that business could still be subject to the minimum wage/sick leave ordinances if the other village does not opt out of the ordinances. ORDINANCE AMENDING CHAPTER II OF THE VILLAGE CODE OF MOUNT PROSPECT WITH REGARD TO CONFLICTS WITH CERTAIN HOME RULE COUNTY ORDINANCES WHEREAS, the Village of Mount Prospect ("Village"), as a home rule unit of local government as provided by Article VII, Section 6 of the Illinois Constitution of 1970, has the authority to exercise any power and perform any function pertaining to its government and affairs except as limited by Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, on October 5, 2016, the County of Cook Board of Commissioners adopted an ordinance that requires employers in "Cook County" to provide a minimum number of paid sick days to employees ("Cook County Paid Sick Leave Ordinance"); and WHEREAS, on October 26, 2016, the County of Cook Board of Commissioner adopted an ordinance creating a minimum wage for employers in "Cook County" ("Cook County Minimum Wage Ordinance"); and WHEREAS, the Village of Mount Prospect finds that these Cook County Ordinances place an undue burden on employers within the Village of Mount Prospect given the current rights of employees available under Federal and State law; and WHEREAS Article VII, Section 6(c) of the Illinois Constitution provides that if a home rule county ordinance conflicts with an ordinance of a municipality, the municipal ordinance shall prevail within its jurisdiction; and WHEREAS, pursuant to its home rule powers, the Village of Mount Prospect finds it in the best interest of the Village to amend the Village Code to clearly define the sick leave and minimum wage regulations that apply to employers located in the Village of Mount Prospect. Information: The Transportation Safety Commission transmits their recommendation to approve a traffic calming project along Highland Street between Main Street (Route 83) and Rand Road that includes parking regulations, signage, pavement markings and curb extensions. If approved by the Village Board of Trustees, the Engineering Division will develop construction drawings and incorporate the project into this year's street resurfacing program. The Transportation Safety Commission also transmits an ordinance recommendation to prohibit parking at all times along the south side of Highland Street between Emerson Street and Elm Street. A traffic accident on Highland Street between Maple Street and Elm Street involving a vehicle and pedestrian prompted a traffic study performed by the Engineering Division. On September 2, 2016, a child ran across the street midblock in front of a vehicle and was struck. The low speed/impact collision did not result in any significant injuries to the child. Nearby residents, however, voiced their concerns that vehicles often speed on Highland Street between Main Street (IL Route 83) and Rand Road, and use it as a cut through to avoid the Rand-Elmhurst-Kensington intersection. The Engineering Division was tasked to gather vehicular volume and speed data on Highland Street to determine if the street qualifies for traffic calming measures per the Village's Neighborhood Traffic Calming Program. The recorded average speeds of 24 & 26 mph along Highland Street (two study spots) fall below the minimum 30 mph to qualify for traffic calming measures. The recorded 85th percentile speeds of 29 & 31 mph also fall below the minimum 34 mph. Highland Street, therefore, does not qualify for traffic calming measures based on recorded speeds. Village Board Meeting-February 7,2017 Page 71 of 107 The average daily traffic volumes of 1568 & 1752 vehicles along Highland Street (two study spots) exceed the minimum 1000 vehicles to qualify for traffic calming measures. The peak hour traffic volumes of 182 & 217 vehicles also exceed the minimum 120 vehicles. However, since Highland Street is considered a collector street, traffic calming measures are only considered if a high pedestrian generator is adjacent to the street. Typically, this is a school, church or park where enhancing pedestrian safety is the primary goal of a traffic calming project. In this case, Maplecrest Townhomes does generate pedestrian activity, particularly with owners parking on Highland Street. While Maplecrest Townhomes is not a high pedestrian generator, given the high density of residents on a short stretch of roadway, it would be appropriate to consider measures that would enhance pedestrian safety and alert motorists of the residential surroundings. On-street parking is evident but minimal throughout the day. Evenings and weekends tend to see more on-street parking compared to weekday mornings and afternoons. A majority of the on-street parking appears to be associated with the Maplecrest Townhomes. The two inner blocks (between Emerson Street & Elm Street) experience more on-street parking on the north side of the street adjacent to the multi-family properties. Based on Staff's observations, on-street parking could be limited to one side of the street without impacting the neighborhood. There have been only four recorded crashes since 2011 along Highland Street. Two crashes involved parked vehicles, one was construction-related, and one was the vehicle-pedestrian accident that prompted this study. There have been no crashes involving two moving vehicles or crashes that would raise concerns at a particular intersection. Overall, the crash frequency along Highland Street is low. As part of the study, surveys were sent to 36 residential and business properties along Highland Street between Main Street and Rand Road to solicit their input on this issue. A total of 9 surveys (25%) were returned to the Village primarily expressing concerns of speeding and cut through traffic. The issue was presented at the January 9, 2017 Transportation Safety Commission Meeting. Two residents were in attendance. To enhance pedestrian safety, the Commission recommends prohibiting parking along the south side of Highland Street between Emerson Street and Elm Street. To reduce cut through traffic, the Commission recommends installing NO THRU TRAFFIC signs at both ends of the street. To reduce speeds above the speed limit, the Commission recommends installing appropriate signs and pavement markings. To increase STOP sign compliance and enhance pedestrian safety, the Commission recommends installing curb extensions (bump-outs) on Highland Street at Maple Street. The total construction cost is estimated at $10,000.00. And finally, the Commission requested that a post-study be performed after implementation and a time of Village Board Meeting-February 7,2017 Page 72 of 107 enforcement by the Police Department. The results would be presented to the Commission for information and discussion. Alternatives: 1. Accept the recommendation of the Transportation Safety Commission. 2. Discretion of the Village Board. Budget Impact: This proposed expenditure will require the expenditure of approximately $10,000 to construct recommended improvements including signage, pavement markings, and curb modifications. Recommendation: By a vote of 7-0, the Transportation Safety Commission recommends to approve the traffic calming project as described above and shown on the attached conceptual plan, and approve the following for ordinance: prohibit parking on the south side of Highland Street between Emerson Street and Elm Street at all times (Section 18.2006). Overall, the crash frequency along Highland Street is low. 5) Recommendations Highland Street is a collector street and, as such, traffic should not be diverted to other neighborhood streets. However, engineering measures could be implemented to make motorists more aware of the residential surroundings and enhance pedestrian safety. And while the traffic data showed typical speeds for a residential street, engineering measures could have a secondary benefit of slowing the higher individual vehicle speeds. 1. Limit on-street parking to one side of the street — Highland Street experiences above average traffic volume for a neighborhood street (although typical for a collector street) as it has direct connection to Route 83 and Rand Road. It also experiences consistent on-street parking, primarily because of Maplecrest Townhomes. To limit pedestrians in the roadway walking to and from parked vehicles, it is recommended to only allow on-street parking on the side of the street that experiences more parking. For the two outer blocks, it would be the south side of the street. For the two inner blocks, it would be the north side of the street. This alternating pattern may also slow vehicle speeds through intersections as travel lanes shift. 2. Install bump-outs at the Highland Street & Maple Street intersection — Curb extensions or "bump-outs" are an effective traffic calming measure to enhance pedestrian and vehicle safety at an intersection. They are used to slow traffic, reduce the crossing distance for pedestrians, increase Stop sign compliance, and prevent on-street parking near the intersection to improve visibility. The Village has installed several bump-outs with success including on Burning Bush Lane, Wheeling Road, and Lincoln Street. 3. Narrow the travel lanes with pavement markings — With limited on-street parking and no pavement markings, motorists may perceive wide travel lanes that can lead to higher vehicle speeds. Narrowing the travel lanes to 10' with a combination of a yellow centerline and a white parking line can confine vehicles to a limited space resulting in slower speeds. Lincoln Street and Meier Road are examples of streets that have seen lower vehicles speeds after adding a yellow centerline and white parking lines. Install signs & pavement markings to slow traffic and remind motorists of the residential surroundings—The word SLOW painted on each travel lane and a corresponding SLOW sign in advance of the multi-family properties would remind motorists of the residential surroundings. Similar SLOW signs have been installed on See Gwun Avenue with a positive effect of reducing vehicle speeds. Additional Stop signs or lowering the speed limit are not recommended based on the results of the traffic data and crash reports. 5. Install signs to deter cut through traffic in the neighborhood — NO THRU TRAFFIC signs at Rand Road and at Main Street can reduce the traffic volume on Highland Street. Such signs are not enforceable by the Police Department but have shown to be effective at other locations in the Village. 6. Continue Police Department enforcement of the speed limit and Stop signs, and utilize the speed feedback trailer to slow traffic — Periodic education and enforcement efforts are effective in maintaining safe driver behavior. They can be done before and after a traffic calming project. 6) Discussion Vice Chairperson Morgan asked Traffic Engineer Lawrie to present the Engineering Division's report. Traffic Engineer Lawrie provided the Commission with background information on this issue and stated the Engineering Division's recommendations. Commissioner Prosperi raised a concern with alternating the parking restrictions from block to block. He asked if motorists would have sufficient distance to adjust to the shifting centerline through an intersection. Traffic Engineer Lawrie said that it did meet standard design guidelines. Commander Smith also expressed concern with the shifting centerline. Commissioner Prosperi suggested restricting parking along the south side of the street for all four blocks to provide a consistent centerline alignment. Traffic Engineer responded the proposed design tried to minimize residents crossing the street to get to their vehicles based on the current parking pattern. He concurred restricting parking to the same side of the street would eliminate the shifting centerline concern. Commission members noted that on-street parking was primarily along the two interior blocks adjacent to Maplecrest Townhomes and questioned whether parking regulations were necessary along the two outer blocks. In particular, Commission members did not want to eliminate parking in front of the Moose Lodge if their parking lot could not accommodate all of their patrons. Mark Wesby, 122 E. Highland Street, thanked the Commission for discussing the issue. He commented the Moose Lodge parking lot is not typically full. Traffic Engineer Lawrie said throughout the study, which included observations during the evening, staff did not see the parking lot full. Commission members agreed that on-street parking associated with the Moose Lodge may only be seen during special events. There was general consensus to not add parking regulations on the two outer blocks. The Commission discussed the proposed bump outs at the Highland Street & Maple Street intersection. Traffic Engineer Lawrie said their purpose is to prevent vehicles from parking close to the intersection making pedestrians crossing the street more visible. They also shorten the crossing distance for pedestrians. Traffic Engineer Lawrie pointed out that one of the concerns from the resident survey was motorists not stopping at the STOP signs. He said the bump outs allow the STOP signs to be moved closer to a driver's line-of-sight often increasing STOP sign compliance. Commissioner Keane expressed his support for them. TSC Meeting Page 5 of 6 January 9,2017 Village Board Meeting-February 7,2017 Page 78 of 107 The Commission discussed the timeframe for implementing any changes and their desire to monitor the effect afterwards. Traffic Engineer Lawrie responded any recommendations from the Commission would next be presented to the Village Board for their consideration. With their approval, the Engineering Division would then develop construction drawings and incorporate the project into the street resurfacing program this summer. A post-study would be performed in the future and the findings presented to the Commission. Commissioner Keane made a recommendation to approve the following: 1. Prohibit parking on the south side of Highland Street between Emerson Street and Elm Street at all times. 2. Install pavement markings as proposed on Highland Street between Emerson Street and Elm Street. 3. Construct bump outs at the intersection of Highland Street and Maple Street. 4. Install NO THRU TRAFFIC and SLOW signs as proposed. 5. Continue enforcement of the speed limit and STOP signs by the Police Department. 6. Perform a post-study after implementation and present the findings to the Commission. The motion was seconded by Commissioner Prosperi. The motion was approved by a vote of 7-0. COMMISSION ISSUES At the last meeting, Chairperson Kuehlthau reported a sight obstruction at the intersection of Route 83 & Henry Street. Traffic Engineer Lawrie reported that the tree in question has been trimmed to improve the visibility for motorists. Ordinance 6229, adopted December 15, 2015, established the annual budget for the year ending December 31, 2016. Ordinance 6243 adopted on April 19, 2016 had provided for amendment#1 of the 2016 budget. Each year the Village prepares budget amendments impacting revenues and/or expenses to the current year's budget. The first of these amendments is typically prepared in Spring and amends the budget for carry-over items from the prior year's budget. Accounts adjusted in the first amendment are typically for capital projects started in the previous year but not completed. Amendments brought forward later in the year adjust the budget for material variations in revenues and expenditures resulting from extraordinary or unanticipated events. These amendments are necessary to comply with the Budget Officer Act. A proposed ordinance amending the 2016 annual budget is attached for the Board's consideration. In total, this amendment increases the budget for revenues by $10,888,662 and increases the budget for expenditures by $10,936,783. Adjustments to revenues in this amendment are being made to various taxes, permit fee and bond proceeds accounts and impact a number of different operating and capital funds. Of the $10.9 million total increase in revenue accounts, $9.1 million is attributed to the refunding of Series 2006 Library bond issue. General Fund revenues expected to come in higher than budget include Sales Tax ($1,250,000), Use tax ($150,000) and the Real Estate Transfer Tax ($125,000). Receipts from the Telecommunication Tax are Village Board Meeting-February 7,2017 Page 82 of 107 expected to come in below budget by $125,000. Adjustments increasing total expenditures by $10.9 million are being made to various personnel, contractual service and debt service accounts. There is one significant budget increase to note which impacts the Debt Service Fund. In addition to recording the receipts from the refunding, there also is a need to record the payment on the refunded bonds and financing costs. The total amendment related to the refinancing is $9.1 million. Other notable changes to the budget for expenditures include adjustments to the CDBG Fund totaling $151,000, general and special legal counsel accounts in the General Fund totaling $300,000, personnel adjustments of $375,000. The attached Ordinance details the recommended changes to the budget listing the impacted Funds and individual accounts therein. Alternatives: 1. Adopt the budget amendment Ordinance. 2. Information: The Joint Emergency Management System (JEMS) was created in early 2016 through Northwest Central Dispatch. Ten local communities opted into an agreement to work together in establishing a committee with the goal of enhancing standardization and coordination of emergency management between all parties. The subscribers include Mount Prospect, Arlington Heights, Buffalo Grove, Elk Grove Village, Hoffman Estates, Inverness, Palatine, Rolling Meadows, Schaumburg, and Streamwood. Also, the subscribers agreed to hire a Joint Emergency Management Coordinator. Mick Fleming was hired in the first quarter of 2016 and will be present on February 7th to give a brief overview of his accomplishments and strategy. In late 2009, the Village acquired Everbridge Software to establish a tool to communicate with the community during small and large scale emergencies. Everbridge allows us the ability to quickly and reliably reach residents, staff and emergency personnel, over any device, during both public safety threats and routine community events. Critical situations require information to be shared quickly and effectively with residents no matter how they choose to receive information. Information: A request of the Board's consideration of a Resolution authorizing the approval of the following updates to the Village's Employee Personnel Manual. The Village's longevity pay schedule and amounts have remained the same since at least 1983. The last review of the paid holiday schedule was December 2012 and no changes were implemented. Attached are the changes to be effective and incorporated in the Employee Personnel Manual for non-union employee groups effective January 1, 2017. These changes were also implemented in the Fire Union contract which was ratified by the Village Board on Tuesday, August 16, 2016, but these changes were not yet shown in the Employee Personnel Manual. We continue to strive for consistency across benefits in employee groups. The Patrol Officers Union is currently in negotiations and Police Sergeants Union will begin negotiations after the Patrol Officers union contract is complete. Alternatives: 1 . Adopt the resolution approving Christmas Eve as a recognized and paid Village Holiday along with increasing the Longevity Pay by $200.00 per continuous years' of service which is in five (5) year increments. 2. Budget Impact: This is supplemental information related to the full-time equivalent earnings line item in the 2017 budget as previously discussed at the November 15, 2016 Village Board meeting. The cost of providing the additional holiday is $35,852 based on current salary. This cost is already built into the 2017 budget. Of this amount, only $4,800 is considered new money. Information: In order to limit water loss or unaccounted water consumption in the Village-owned potable water distribution system; Public Works performs water meter testing, water meter replacements, and meter repairs on a scheduled basis. This work generally requires access to water meters installed behind locked doors on private property. As a consequence; it is often necessary to schedule appointments with property owners prior to performing this task. In addition to this work; inspections of sump pumps and storm water conveyances installed on private property are also performed. These inspections are required by Village Code and are pursuant to the Village's Long-Term Maintenance obligations under the Metropolitan Water Reclamation District of Greater Chicago (MWRDGC) Sewer Ordinance. The MWRDGC requires that the Village inspect at least 2% of all single family homes each year. Also planned in this effort is the identification of the type of pipe material used in the water service as this is a new State law being implemented by the Illinois Department of Public Health. All of this work will be scheduled in one appointment to reduce the inconvenience to the property owner. The Village has awarded multi-year water meter testing, replacement and repair contracts since 1985. The clear water inspection of sump pumps and downspouts was added in 1999. The Village aggressively converted water meter accounts to the new automated water meter reading (AMR) system over the past four years and at the same time replaced the bulk of the older water meters with new. Basically, any water meter older than seven (7) years was replaced. The newer meters had only an AMR endpoint installed on to the existing meter. Village Board Meeting-February 7,2017 Page 100 of 107 In the past, the water meter replacement program changed out approximately 800- 900 meters annually. Since the AMR work was completed, the number of water meters to be replaced each year has been reduced to 200-300 meters. Approximately 300 properties will be targeted annually for the MWRDGC clear water inspections under this contract. Additionally, approximately 120 commercial water meters are annually tested for accuracy in accordance with national standards. Staff prepared a detailed set of specifications for each of the efforts and requires the contractor maintain unit pricing for the three-year contract period. No price increases will be allowed during the contract. The successful contractor is required to be a licensed plumbing contractor in the State of Illinois and to employ properly licensed plumbers to perform the work. A Request for Proposals (RFP) was sent to five (5) area firms that perform this type of work. HBK Water Meter Services, Inc. of Rolling Meadows and Calumet City Plumbing of Calumet City responded. Proposals were received on January 23, 2017. The unit pricing was extended for the 2017 planned work is denoted in Attachment A. The estimated total cost for 2017 based on the proposed fees and the projected quantities: Firm Cost HBK Water Meter Service $85,462 Calumet City Plumbing $194,433 HBK Water Meter Service, Inc. has been the Village's water meter replacement contractor and meter testing service provider for previous contracts and has an outstanding record of service with the Village. HBK Water Meter Service, Inc. has previously performed all of the tasks outlined in a satisfactory manner. Sufficient funds exist in the current Budget. The available funding for year one (2017) of the three-year contract for the tasks under this bid is $164,166. The contract award for year 2018 and 2019 will be limited to annual funding levels approved by the Village Board. In the estimated total costs are fees of approximately $15,000 for commercial water meter testing and repairs that will be reimbursed to the Village from the commercial accounts as allowed by the Village Code. Staff is recommending an approximate 10% contingency be added to the award to adjust for the actual quantities tested, inspected and or repaired during the Village Board Meeting-February 7,2017 Pagel 01 of 107 year. This contingency will bring the contract award amount to $94,000. Alternatives: 1. Accept proposal for water meter services submitted by HBK Water Meter Service, of Rolling Meadows, Illinois. 2. Information: Last year, a Watermain Asset Replacement Program was prepared by Burns & McDonnell Engineering Company which ranked sections of the Village's watermain needing replacement based on analysis of a number of parameters, most importantly number of breaks and capacity issues. One of the highest ranked sections of watermain in terms of needing replacement is the existing 6" diameter main on Elm Street between Central Road and Thayer Street. This 1,300' long section of watermain has had numerous breaks and is in need of upsizing to our minimum size of 8" diameter to provide the desired capacity. Village staff is seeking at this time to enter into a contract with a consulting firm for design and construction engineering to facilitate construction this year. As permitted by the Qualification Based Selection process, the Village solicited Statement of Qualifications from six (6) engineering consulting firms to provide design and construction engineering services for the watermain project. Each firm was asked to submit as part of their proposal the following information: 1. Resumes of key personal and related experience on similar type projects 2. Summary of the firm's approach to the project 3. Staff hour estimate for major phases of work 4. Project schedule Tasks that were identified to be performed included: Design Engineering • Topographic survey • Preparation of construction plans, specifications and cost estimates • Obtain all necessary permits/approvals from affected agencies Village Board Meeting-February 7,2017 Page 104 of 107 • Bidding assistance • Attend meetings • Any additional tasks recommended by the consultant Construction Engineering • Provide construction staking • Provide construction inspection and supervision • Attend construction meetings • Prepare pay estimates, punch-list and as-built drawings The consulting firms' Statement of Qualifications were reviewed on the basis of their understanding of our goals and their methodology of the design process. They were rated (with a maximum score of 100 points) according to these specific categories: project team, relevant experience, project approach, project schedule, and projected work hours to complete the required tasks. The rankings are: Firm Ranking Hancock Engineering 96 points Baxter & Woodman 92 points Burns & McDonnell 90 points ESI Consultants 90 points HR Green 89 points K-Plus Engineering 84 points Following conversations with Hancock Engineering Company to discuss the project in greater detail and checking their references, Village staff determined that Hancock Engineering Company was the preferred consulting firm. Village staff requested a cost proposal from Hancock Engineering Company to perform the tasks as identified in the Request for Statement of Qualifications. They submitted a not to exceed cost of $29,000 based on 242 hours for design engineering and $46,500 based on 414 hours for construction engineering. The total cost of $75,500 based on 656 hours averages out to a rate of $115/hour. The cost for engineering services for the 2016 Whitegate Watermain Replacement Project was $113/hour. It is the opinion of Village staff that the hours allotted are reasonable and the rate is competitive and comparable to rates of recent projects. Hancock Engineering has satisfactorily provided consulting engineering services on projects for the Village of Mount Prospect, most recently the 2016 Whitegate Watermain Replacement Project and the 2015 Northwest Highway Streetscape Improvements.
