AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF MOUNT
PROSPECT
(1200 East Algonquin Road, Mount Prospect, Illinois.)
WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code (65 ILCS
5/7-1-13), the Village of Mount Prospect ("Village") has the authority to annex property
surrounded by the Village, which is less than 60 acres in size; and
WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, notice of
the contemplated annexation and zoning of the territory once annexed as 1-1: Limited
Industrial District was published in the Daily Herald, a newspaper of general circulation
in the territory hereinafter described, on December 8, 2016; said date being at least ten
(10) days prior to passage of this Ordinance; and
WHEREAS, notice of the contemplated annexation and zoning of the territory as
1-1: Limited Industrial District also was sent by certified mail and hand delivered to each
taxpayer of record in the territory hereinafter described on December 2, 2016; and
WHEREAS, it is in the best interest of the Village of Mount Prospect that said
territory be annexed to and become part of the Village and that the territory be zoned as
1-1: Limited Industrial District upon annexation.
THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
/illage of Mount Prospect, Cook County, Illinois:
SECTION 1: That the findings set forth above are incorporated by reference into
its Section 1 as if fully set forth herein.
SECTION 2: That this President and Board of Trustees further find as follows:
(a) The territory described in Section 3 of this Ordinance contains less
than sixty (60) acres and is wholly bounded by the Village of Mount
Prospect.
(b) Such territory is not within the corporate limits of any municipality, but
is contiguous to the Village of Mount Prospect, Cook County, Illinois, a
municipality existing under the laws of the State of Illinois.
(c) Notice that the corporate authorities of the Village of Mount Prospect
are contemplating the annexation of such territory and zoning the
territory as 1-1: Limited Industrial District has been published not less
than ten (10) days prior to passage of this Ordinance as required by
Section 7-1-13 of the Illinois Municipal Code (65 ILCS 5/7-1-13).
SECTION 3: That the territory is legally described as follows:
P.I.N.: 08-23-100-018-0000
LOT 1 IN FREIDRICH BUSSE JR. DIVISION OF LAND IN SECTION 23, TOWNSHIP
41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING
TO THE PLAT THEREOF RECORDED FEBRUARY 20, 1911 AS DOCUMENT NO,
4709799, EXCEPT THAT PART LYING WEST AND NORTH OF A BOUNDARY
COMMON WITH LOT 1 IN BLUE SKY SUBDIVISION AS RECORDED MAY 5, 2014
AS DOCUMENT NO. 1415616048 AND DESCRIBED AS FOLLOWS: BEGINNING AT
THE NORTHEAST CORNER OF SAID LOT 1; THENCE SOUTH 01 DEGREES 43
MINUTES 29 SECONDS EAST, 445.00 FEET; THENCE SOUTH 88 DEGREES 16
MINUTES 31 SECONDS WEST, 520.20 FEET; THENCE SOUTH 01 DEGREES 43
MINUTES 29 SECONDS EAST, 557.94 FEET TO THE NORTHERLY LINE OF
ALGONQUIN ROAD AS DEDICATED PER DOCUMENT NO. 11195786 RECORDED
FEBRUARY 2, 1933 FOR A POINT OF TERMINUS, IN COOK COUNTY, ILLINOIS.
Common Addresses: 1200 East Algonquin Road, Mount Prospect, Illinois.
Be and the same is hereby annexed to the Village of Mount Prospect, Cook County,
Illinois, all in conformance with and as shown on the plats and maps of annexation of
said territory prepared by a registered land surveyor of the State of Illinois, attached
hereto and made a part hereof as EXHIBIT A.
SECTION 4: That the Village Clerk is hereby and herewith instructed, to
promptly record with the Recorder of Deeds of Cook County, Illinois:
(a) A copy of this Ordinance certified as correct by the Clerk of said
Village of Mount Prospect; and
(b) The plats of the land included in this annexation, as required by law,
said plats to be attached to the aforesaid certified copy of this
Ordinance.
And to send a certified copy of this Ordinance, within 30 days of adoption, to the Cook
County Election Department/Commission, by certified or registered mail.
SECTION 5: The new boundary of the Village of Mount Prospect shall extend to
the far side of any adjacent right-of-way, provided said right-of-way is not currently
located within the corporate limits of another municipality, and shall include all of every
right-of-way within the area annexed hereby.
SECTION 6: The territory upon annexation into the Village of Mount Prospect
shall be zoned 1-1: Limited Industrial District.
SECTION 7: The Village acknowledges that the Owner of the territory, United
Airlines, Inc., uses, or may use in the future, the territory in part for temporary, overnight
accommodations for Owner employees, trainees, service providers, contractors,
retirees, family members and invitees of the foregoing. Owner shall be permitted to
continue such use and shall be permitted to provide accommodations to such persons,
including for a nominal fee, notwithstanding the Village's annexation of the territory, as a
legal, non -conforming use.
SECTION 8: That this Ordinance shall be in full force and effect upon and after
its adoption and approval as required by law.
ADOPTED this 17th day of January, 2017, by a roll call vote of the Corporate
Authorities as follows:
AYES: Hoefert, Matuszak, Polit, Rogers, Saccotelli, Zadel
NAYS: None
ABSENT: None
APPROVED this 17th day of January, 2017, by the President of the Village of
Mount Prospect.
