MAYOR'S REPORT
A. Accolades
Proclamation: School's Open Safety Week, August 21-27, 2016
Mayor Juracek presented the proclamation to Police Chief Tim Janowick. Chief Janowick encouraged all
Mount Prospect residents to drive safely and cautioned drivers to be especially cognizant of traffic laws
specific to school zones.
B. Board of Fire and Police Commissioners — 2015 Annual Report
Michaele Skowron, Chair of the BOFPC presented the 2014 Annual Report. Ms. Skowron provided a
detailed overview of 2015 activities which reflected the four (4) areas of authority granted the BOFPC by
village code and state statute: 1) hiring process 2) promotion process for first level supervisors 3)
discipline and 4) termination.
Mayor Juracek thanked Ms. Skowron for the excellent report and acknowledged the significant
commitment of the BOFPC members; a busy year that required extensive time and effort.

The Village of Mount Prospect BOFPC is a civilian board who serves for the good of the community and
does so without compensation. BOFPC members also include Mr. Chuck Bennett, Mr. Mark Busse, Ms.
Jackie Hinaber and Mr. Jim Powers.
C. 1St reading of An Ordinance Amending Chapter 13 (Alcoholic Liquors) of the Mount Prospect Village
Code.
Mayor Juracek presented for a first (1S) reading An Ordinance Amending Chapter 13 (Alcoholic Liquors)
of the Mount Prospect Village Code. This ordinance amends Chapter 13 (Alcoholic Liquors) by deleting
an "F-2" liquor license issued to FSAS LLC d/b/a Arnie Salerno's Pizzeria located at 1716 East
Kensington Road. The restaurant is under new ownership.

OLD BUSINESS
A. Public Meeting and Public Hearing
Mayor Juracek stated this public hearing and public meeting, called pursuant to proper legal notice having
been published in the Daily Herald on August 6, 2016, is to consider the annexation and zoning
designation of [11 (Limited Industrial)] territory within unincorporated Cook County to the Village of Mount
Prospect.
Mayor Juracek called the Public Hearing to order at 7:24 pm to consider the zoning designation of 11
(Limited Industrial) for the territory within unincorporated Cook County being considered for annexation
into the Village of Mount Prospect. Mayor Juracek explained the Public Hearing is for the zoning
designation but the ordinance to be considered is for both the annexation and zoning designation.
Village Manager Michael Cassady provided background information regarding the properties located at
1105 E. Algonquin Road, 1901 S. Busse Road, 1801 S Busse Road, 1690 W. Imperial Court, 1691 W.
Imperial Court, 1911 S. Busse Road, 1907 S. Busse Road, 1660 W. Kenneth Drive, 302 W. Kenneth
Drive, 505 W. Kenneth Drive, 1600 W. James Drive and 1650 James Drive; approximately 27 acres. The
subject properties are improved with a variety of industrial and retail uses; the Village's 11 Limited
Industrial is the most compatible zoning district with the existing uses in this area. Village staff have met
with the property owners to discuss concerns relative to their business operations under Cook County
regulations versus Village regulations. The Village has assured the owners the 11 zoning would not impact
their current operations; Village will honor special uses. Village Manager Cassady also highlighted the
life safety and financial benefits the businesses would receive as part of the Village.
Public Comment

In response to Mr. Goodman's question regarding the cost to the Village to annex the properties, Mr.
Cassady cited the state statute requiring the Village to pay the Elk Grove Fire Protection District.
Mr. Joseph Gattuso — attorney for 1650 James LLC and 1105 LLC
Mr. Nick Stanford — attorney
On behalf of their respective clients Mr. Gattuso and Mr. Stanford requested the Village defer
consideration of the annexation/zoning ordinance. Both believe annexation agreements can and should
be reached before annexation occurs. The business owners and attorneys believe it is in their business
interest to have a written agreement that provides legal assurance they will be allowed to operate under
the same conditions currently allowed under Cook County 13 zoning regulations.
Village Attorney, Lance Malina and Village Manager Cassady provided the following in response to
questions from the Village Board:

■ Businesses affected by annexation would prefer to keep status quo with unincorporated Cook
County.
■ Village's allowance of legal, non -conforming status provides greater leniency than Cook County 13
regulations.
■ Annexation without written agreement will not impair business.
■ Would not be favored nation — each business would need to negotiate their own agreement.
■ Deferral of the annexation is not a simple matter; changes property.
■ Regarding notifications; two separate plats could increase number of plats and agreements
Mr. Don Mackey— Imperial Court Business Owner
Mr. Mackey expressed his concerns with the proposed annexation. He believes the cost to his business
will increase if it is brought into the Village.
Village Board Comments
■ Village is on record that businesses will be granted legal, non -conforming status under annexation; no
impact to business operations.
■ Fair to provide assurance to businesses that existing operations will not be impacted by annexation.
■ Conditions not brought in under annexation will be subject to conditional uses and variations.

Mayor Juracek called for a recess at 8:09 p.m.; Mayor Juracek resumed the August 16, 2016 Village
Board meeting at 8:14 p.m.
B 2nd reading of An Ordinance Annexing Certain Property to the Village of Mount Prospect
This ordinance authorizes the annexation of certain property located at the southeast corner of Linneman
Road and Dempster Street of unincorporated Cook County, 1200 Dempster. This item was deferred from
the April 19, 2016 Village Board meeting until the August 16, 2016 Village Board meeting by a vote of 6-0.
Mayor Juracek stated staff has requested deferral of this item to the October 18, 2016 Village Board
meeting, to continue discussions with United Airlines.

NEW BUSINESS
A. A Resolution in Support of an Extension of a Cook County Class 6b Extension for DP Realty Partners
LLC located at 2200 South Busse Road.
Mayor Juracek presented a Resolution in Support of an Extension of a Cook County Class 6b Extension
for DP Realty Partners LLC located at 2200 South Busse Road.
Community Development Director William Cooney provided background information including Irv's
Luggage/Executive Essentials business history, occupant of 2200 South Busse Road, Cook County Tax
Abatement program, staff recommendation and responded to questions from the Village Board. The
renewal would be for an additional 12 years and would enable Irv's Luggage/Executive Essentials to
maintain their operations in Mount Prospect. Mr. Cooney added the Village has worked with Irv's in
resolving all signage issues; the business is in compliance.
The Class 6b incentive reduces the assessment level for qualified manufacturing and
warehouse/distribution facilities from 25% to 10% for the first ten (10) years, 15% for year eleven (11) and
20% in year twelve (12).
Mr. Wein, owner of Irv's, was in attendance to provide additional information and respond to questions
from the Village Board. Mr. Wein thanked the Village Board for their support of his business as well as
the Class 6b incentive. He stated with the volume of sales through the internet makes this a challenging
time for retailers.
Village Board Comments
■ Supports Class 6b tax incentive important tool for businesses; allows businesses to stay in Mount
Prospect.
■ Business creating jobs and revenue; occupancy versus vacant structure is benefit to Village.
■ Thanked Mr. Wein for choosing to stay in Mount Prospect.

VILLAGE MANAGER'S REPORT
A. A Resolution to Approve a Contract Agreement Between the Village of Mount Prospect, Illinois and
the Mount Prospect Fire Fighters Union Local 4119 International Association of Fire Fighters (Term of
January 1, 2016 through December 31, 2018)
Village Manager Cassady presented a Resolution to Approve a Contract Agreement Between the Village
of Mount Prospect, Illinois and the Mount Prospect Firefighters Union Local 4119 International
Association of Firefighters (Term of January 1, 2016 through December 31, 2018). Village Cassady
provided background information regarding the negotiation process, terms of the three (3) year
agreement and recognized the fire personnel (Firefighters Dale Steward, Joe Knoll, Brad Peterson and
Steve Slobe), Deputy Fire Chief John Dolan and Village administration involved in negotiations. The
contract described as a win/win agreement includes a two per cent wage increase as well as shift in
insurance costs to employees.
On behalf of Fire Chief Brian Lambel, Deputy Fire Chief John Dolan, extended their thanks to the Village
Board, Village Administration and all involved in the negotiation process. Deputy Chief Dolan recognized
Administrative Analyst Alexander Bertolucci for his outstanding work on the contract agreement.

A RESOLUTION TO APPROVE A CONTRACT AGREEMENT BETWEEN THE

FIREFIGHTERS UNION LOCAL 4119 INTERNATIONAL ASSOCIATION OF

ANY OTHER BUSINESS
Trustee Hoefert requested updates on property maintenance issues of three (3) residential properties on
Rand Road and the status of the development of the old Tri-State property. Community Development
Director William Cooney stated two (2) of the properties on Rand have been sold and the third has a sale
pending. Community Development inspectors monitor the properties daily to ensure compliance. The
developers of the old Tri-State have yet to break ground. He maintains regular contact with developer for
status reports.
Trustee Polit announced the Saturday, August 20th Blues Mobile Car Show will feature Auto Barn VW
and have live music from Rosie and the Riveters.

PROCLAMATION
Ovarian Cancer Awareness Month
SEPTMEMBR, 2016
WHEREAS, ovarian cancer is the fifth leading cause of cancer -related
deaths among women and accounts for more deaths than any other
gynecologic cancers; and
WHEREAS, the American Cancer Society estimates that 21,290 women
will be diagnosed with ovarian cancer in 2016, with more than half of
those women over the age of 62; and
WHEREAS, recognition of the warning signs are essential to an early
detection and effective treatment; and
WHEREAS, the symptoms of ovarian cancer include abdominal pain and
pelvic pain, difficulty eating and frequent urination; and
WHEREAS, the early symptoms of ovarian cancer are commonly
overlooked, public awareness and knowledge are essential to getting a
diagnosis before the cancer worsens; and
WHEREAS, organizations such as the National Ovarian Cancer
Coalition focus on informing the public through their advocacy of cancer
screening tests, public health fairs and the Run/Walk to Break Silence on
Ovarian Cancer; and
WHEREAS, it is critical that those affected by ovarian cancer have the
proper resources and access to health care to prevent, detect, treat and
ultimately defeat ovarian cancer and all cancers;
NOW, THEREFORE, I, Arlene A. Juracek, Mayor of the Village of
Mount Prospect, Illinois, do hereby proclaim

CONSTITUTION WEEK, SEPTEMBER 17TH - SEPTEMBER 23RD, 2016
CONSTITUTION DAY AND CITIZENSHIP DAY, SEPTEMBER 17, 2016
WHEREAS, our Founding Fathers, in order to secure the blessings of liberty for themselves
and their posterity, did ordain and establish a Constitution for the United States of America;
and
WHEREAS, at the culmination of months of deliberation, debate and compromise, on
September 17, 1787, the Constitution of the United States of America was signed; and
WHEREAS, this document, crafted by these early patriots enshrines our enduring faith in the
notion that being a citizen is about more than circumstances of birth -- we are bound together
by our beliefs, our unalienable rights, and the idea that we must accept certain obligations to
one another and to future generations; and
WHEREAS, The Fourteenth Amendment (Amendment XIV) to the United States Constitution
which greatly expanded the protection of civil rights to all Americans was adopted on July 9,
1868; and
WHEREAS, the Constitution embodies the equal treatment and equal rights of all citizens, by
birth or naturalization; and
WHEREAS, September 17, 2016, marks the 229th anniversary of the signing of the
Constitution of the United States of America by the Constitutional Convention; and
WHEREAS, through all its changes over the years, the Constitution's foundation has

WHEREAS, Constitution Day and Citizenship Day are celebrated on September 17th each
year during the celebration of Constitution Week, September 17th through September 23rd;

WHEREAS, the adoption of the Constitution and the independence guaranteed to American
Citizens, whether by birth or by naturalization, should be celebrated by appropriate
ceremonies and activities during Constitution Week.
NOW, THEREFORE, I, Arlene A. Juracek, Mayor of the Village of Mount Prospect do hereby
proclaim:
September 17, 2016, as Constitution Day and Citizenship Day, and
September 17 through September 23, 2016 as Constitution Week

Item VIII. B.: MOTION TO ACCEPT BID FOR VILLAGE HALL PARKING
GARAGE INTERIOR PAINTING IN AN AMOUNT NOT TO EXCEED

Information:
The proposed contract award provides for interior painting services at the Village
Hall Parking Garage (30 South Emerson Street).
The Village's building maintenance program is structured such that all Village
facilities are monitored and assessed on an ongoing basis to determine proper
intervals for maintenance. Proper maintenance is critical to ensure optimal
functionality, longevity of service, and an attractive appearance. The Village Hall
Parking Garage is in a condition that warrants the re -painting of all interior walls,
ceilings, doors, parking bumpers, pipes, pipe hangers, etc. This facility was last
painted upon completion of construction in 2003.
Staff proposes to perform this work in multiple phases over the course of the next 3-
5 years. This year's proposed work area includes the lower level of the parking
garage (parking spaces 1-75). All surfaces will be cleaned, primed as necessary,
and repainted with two (2) coats of off-white (color will match existing) industrial latex
paint. The stairwell lobby adjacent to this area will also be painted. In addition, the
garage floor will also be power washed and cleaned.
Inspections performed by staff indicate that this area is in the worst condition.
Painting of remaining surfaces (spaces 76 through 383) will be scheduled as future
projects.
Given the scale and scope of the project, as well as the need to have all work
performed during overnight hours to minimize user impact, staff elected to
prosecute the work utilizing a painting contractor secured through competitive
bidding. The proposed contract is for a one (1) year term. Staff anticipates that all
work will be completed within 45 days of notice to proceed.

Upon completion of the work, staff will re -stripe parking stalls and re -lamp lighting
fixtures.
Staff prepared necessary bid documents. Seven (7) painting contractors were sent
invitations to bid and a public notice was placed in a local paper and on the Village
website as required by the Village's Purchasing Policy. The following four (4) bids
were publicly opened on August 24, 2016 at 1:00pm:

The lowest cost bidder is Muscat Painting & Decorating (Muscat Painting) of East
Dundee, IL. Muscat Painting provided a list of references per the requirements of
the bid. All references were called with all responding that Muscat Painting has
successfully completed work of this scale and scope in an exceptional manner. All
references would hire Muscat Painting in the future if given the opportunity.
Staff is requesting a 10% contingency ($4,487) to address any unforeseen issues.
A 10% contingency would bring the project award total to $49,365 (the $44,878 base
bid plus the 10% contingency of $4,487).
Alternatives:
1. Accept lowest cost, responsible bid for Village Hall Parking Garage Interior
Painting Project.
2. Discretion of the Village Board.
Budget Impact:
This proposed award will require the expenditure of $49,365 from the Capital
Improvement Fund. Sufficient funds exist in the current budget.
Recommendation:
Staff recommends accepting the lowest responsible bid from Muscat Painting &
Decorating, of East Dundee, Illinois for the Village Hall Parking Garage Interior
Painting project in an amount not to exceed $49,365.

MONITORING IN AN AMOUNT NOT TO EXCEED $29,060

Information:
As part of our long term maintenance commitments to the Metropolitan Water
Reclamation District of Greater Chicago (MWRDGC), the Village is required to
monitor wet weather (clear water) flows in our separate sanitary sewer system.
The separate sanitary sewer system (see Attachment A) is not designed to collect or
convey substantial amounts of wet weather flow. If these sewers become inundated
with rain water during storm events, sewer surcharges or basement back-ups can
occur.
Flow monitoring these sewers during moderate rain events can help identify defects
or improper connections that introduce excessive clear water before they become
problematic. Examples of defects that can contribute excess clear water include
cracks or joint separations in pipe, defective manhole lids or risers, and poor service
line connections. Improper connections include storm sewer interconnects or sump
pump discharge connections.
Sewers with high flows can be examined more closely with closed circuit television
inspection and smoke testing. Identified defects can be corrected in a variety of
ways including pipe lining, asset replacement, and code enforcement of private
property defects.
Staff lacks the equipment and technical resources to perform this work in-house.
Therefore, outside consultants are utilized to perform the work. The scope of work
includes the provision and installation of the monitoring gear, data collection, and the
creation of a final report summarizing the season and calculation of the wet weather
peaking factors.
All of this work will be performed between September 15 and November 30, 2016.
This proposed contract is for 2016 work only.

For 2016, five (5) separate sanitary sewer basins are to be monitored. These basin
locations are depicted in Attachment B.
A Request for Proposals (RFP) was sent to area consulting engineers who have
performed these services for the Village or for the MWRDGC in the past. Three (3)
area firms with experience in sanitary sewer flow monitoring responded including
Burns & McDonnell of Downers Grove, Illinois, Baxter & Woodman of Crystal Lake,
Illinois, and ADS Environmental of Huntsville, Alabama.
Proposals were reviewed by engineering and water/sewer maintenance staff.
Evaluation criterion included responsiveness of proposal, proposed schedule,
experience, proposed staff assignments and utilization of technology. Following are
the results of staff's evaluation:

The highest rated firm is Baxter & Woodman Consulting Engineers. Baxter &
Woodman is familiar with the Village's sanitary sewer system and is familiar with the
requirements of the MWRDGC. The firm has previously performed this type of
work for the Village and other MWRDGC communities. All of their work has been
satisfactory.
Baxter & Woodman has proposed a fee of $29,060 for the work. This fee includes
the cost of equipment rental (flow monitors), installation, data collection, analysis,
and final report generation. They intend to apply 200 hours of senior engineer work
to the project which equates to a reasonable and competitive $145 hourly rate.
Alternatives:
1. Accept recommended proposal for Sewer Flow Monitoring.
2. Discretion of the Village Board.
Budget Impact:
This proposed award requires the expenditure of $29,060 from the Water/Sewer
Enterprise Fund. Sufficient funds exist in the current budget.
Recommendation:
Staff recommends accepting the proposal from Baxter & Woodman Consulting
Engineers of Crystal Lake, Illinois for Sewer Flow Monitoring in an amount not to
exceed $29,060.

REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED

Information:
Earlier this year, a Watermain Asset Replacement Program was prepared by Burns
& McDonnell Engineering Company which ranked sections of the Village's
watermain needing replacement based on analysis of a number of parameters, most
importantly number of breaks and capacity issues. One of the highest ranked
sections of watermain in terms of needing replacement is the existing 6" main on
Whitegate Drive between We Go Trail and Cathy Lane. This 800' long section of
watermain has had numerous breaks and is in need of upsizing to provide the
desired capacity. To correct this problem, staff proposes to replace the existing
undersized 6" water main with a larger, 8" diameter pipe installed by directional
boring to minimize the disruption to the parkway. Attachment A depicts the project
area.
Plans and bid documents for this project were prepared by Hancock Engineering
Co., consulting engineers of Westchester, Illinois and a public notice was placed in
the newspaper. Twenty-five (25) construction firms picked up bid documents and
eleven (11) submitted bids. The bids were opened and read aloud on August 25,
2016.
Each of the bidders submitted a bid bond in the amount of 10% of the total bid as
required in the bid proposal packet. All bids were checked for accuracy. One minor
error was found in one bid but it did not affect either of the 2 low bidders or the
order of the bids. All bidders correctly signed their bids and bid bonds. Below is a

The low bidder, Lampignano & Son Construction Co., is qualified to complete the
work involved with this project and meets the requirements of the contract
documents. Lampignano & Son Construction Co. has worked on many previous
Village projects and their work has been satisfactory. They are currently working as
the underground and concrete subcontractor on the Village's 2016 Street
Resurfacing program.
Staff recommends including a 10% contingency in the project award to allow for
quantity variances and unanticipated underground conflicts. In this instance, a 10%
contingency added to the lowest cost bid would result in a total contract award of
$274,065 (Base Bid: $249,150 + 10% Contingency: $24,915 = Total Recommended
Award: $274,065).
Alternatives:
1. Accept lowest cost bid for 2016 Watermain Replacement Project.
2. Discretion of the Village Board.
Budget Impact:
This proposed award will require the expenditure of $274,065 from the Water/Sewer
Enterprise Fund. Sufficient funds exist in the current budget.
Recommendation:
Staff recommends that the low bidder, Lampignano & Son Construction Company
of Arlington Heights, Illinois be awarded the contract for the 2016 Watermain
Replacement Project in an amount not to exceed $274,065.
