A. ACCOLADES
Mayor Juracek welcomed Boy Scout Robi Roy from Troop 160 who is working on his Citizenship in
the Community Merit Badge.
Proclamation: "Arbor Day" April 29, 2016
Mayor Juracek presented the proclamation to Public Works Director Sean Dorsey. Mr. Dorsey thanked
the Mayor and Village Board for their continued support of the Village's forestry program and extended an
invitation to the Arbor Day celebration and tree planting Friday, April 29th at 9:30 am; Forest View
Elementary School, 1901 Estates. In addition to the students, teachers and staff, members of the Mount
Prospect Garden Club will participate in the event.

Mayor Juracek presented for a first (1S) reading An Ordinance Amending Chapter 13, "Alcoholic Liquors,"
of the Village Code of Mount Prospect. This ordinance increases the number of Class "F-3" liquor
licenses by one (1) Sabchan, Inc. d/b/a Summertime Restaurant located at 1132 South Elmhurst Road.
The Class "F-3" liquor license provides for the full service of alcohol in a restaurant with a lounge.
Village Manager Michael Cassady provided background information stating the applicant, Mr. Saburo
Araki, is seeking a Class "F-3" liquor license for a new restaurant, Summertime Restaurant. Mr. Araki has
met Village requirements and submitted all required documentation. In addition, Mr. Araki met with staff
to review the Village's rules and regulations, including the Village's particular sensitivity to the sale of
alcohol to minors and clearly intoxicated individuals.
Mr. Araki was in attendance to provide additional information and respond to questions from the Village
Board. The restaurant will operate as a tea room/music lounge serving lunch and dinner; Japanese
cuisine. Mr. Araki anticipates the restaurant will open in late June of this year.
The Mayor and Village Board expressed their support and appreciation for choosing to locate his
restaurant in Mount Prospect.

OLD BUSINESS
A. An Ordinance Annexing Certain Property to the Village of Mount Prospect
1. Motion to accept Letter of Understanding and authorization for the Village Manager to execute —
United Airlines Annexation
2.2 nd reading of An Ordinance Annexing Certain Property to the Village of Mount Prospect
Mayor Juracek stated the first (1S) reading of the ordinance authorizing annexation of the property located
at 1200 Dempster Street was held at the March 16, 2016 Village Board meeting; the Village Board
approved deferral of the second (2nd) reading of the ordinance until the April 19th Village Board meeting.
United Airlines (UAL) had requested deferral of this item until after the Village and United Airlines
representatives had an opportunity to meet to discuss annexation of the UAL property.
Village Manager Cassady provided background information regarding the Village's initial decision to
pursue forced annexation. The proposed use of the subject property for overnight truck/trailer parking
presented safety concerns to the Mount Prospect community. To prevent the proposed use and gain
control of land usage of the subject property the Village determined it was in its best interest to pursue
forced annexation. United Airlines and the Village have since met to discuss the annexation and status
of the United Airlines property. Both parties are committed to working together in a mutually beneficial
manner. To facilitate this process, A Letter of Understanding between the Village and United Airlines
was drafted for Village Board approval and the second (2nd) reading of the ordinance under consideration
would be deferred until the August 16, 2016 Village Board meeting. The Letter of Understanding includes
a commitment from United Airlines not to use the 1200 Dempster lot as overnight for parking
trucks/trailers.
Mr. Andrew Scott, United Airlines attorney was in attendance; he thanked the Mayor and Village Board for
the opportunity to work with the Village and looks forward to future discussions regarding the UAL
property.

Public Comments
Ms. Carol Neufeld addressed the Village Board regarding her safety concerns with the proposed use of
the 1200 Dempster Street as truck parking lot. She was pleased the Village Board took appropriate steps
to prevent its use as a parking lot.
Mayor Juracek asked for a motion to accept the Letter of Understanding and authorization for Village
Manager Cassady to execute.

NEW BUSINESS
A. 1 st reading of An Ordinance Making Certain Amendments to the Annual Budget Adopted for the Fiscal
Year Commencing January 1, 2015 and Ending December 31, 2015.
Mayor Juracek presented for a first (1st) reading An Ordinance Making Certain Amendments to the
Annual Budget Adopted for the Fiscal Year Commencing January 1, 2015 — December 31, 2015.
Finance Director Dave Erb presented the proposed amendment stating the ordinance provides for the
third (3rd) and final amendment to the 2015 budget. This is a carryover amendment from the 2015
budget. In total the proposed amendment increases the Village budget for revenues by $268,730 and
increases expenditures by $381,304.
This ordinance does not approve new expenditures; expenditures were previously approved with passage
of 2015 budget.

B. 1st reading of An Ordinance Making Certain Amendments to the Annual Budget Adopted for the Fiscal
Year Commencing January 1, 2016 and Ending December 31, 2016.
Mayor Juracek presented for a first (1st) reading An Ordinance Making Certain Amendments to the
Annual Budget Adopted for the Fiscal Year Adopted for the Fiscal Year Commencing January 1, 2016 —
December 31, 2016. This is the first (1S) amendment to the 2016 Budget.
Finance Director Dave Erb presented the proposed amendment stating the ordinance provides for the
first (1S) amendment to the 2016 budget. This amendment adjusts original budget figures to reflect carry-
over projects from the prior year. In total the proposed amendment increases the budget for expenditures
by $4,224,118. The increase in expenditures totaling $4.2 million primarily consist of capital projects
budgeted in the Capital Improvement Fund, Downtown Redevelopment Fund, Street and Flood
Construction Funds , Motor Fuel Tax Fund, Water and Sewer Fund, Village Parking Fund and Vehicle
Replacement and Vehicle Maintenance Funds. Of the $4.2 million, $1.3 million is for carryovers in the
Water and Sewer Fund.

VILLAGE MANAGER'S REPORT
Village Manager Cassady stated the Public Works Department had two (2) items to present for the Village
Board's consideration. At the Mayor's encouragement both projects were bid through the Municipal
Partnering Initiative (MPI). MPI is a regional collective of municipalities that jointly procures a range of
commodities, services and projects to better leverage economies of scale. Public Works Director Sean
Dorsey worked with the Village Manager in participating in the joint bid process; this is the first (1S) time
the Village has participated in the joint bids. Staff determined the Municipal Partnering Initiative joint bid
provides for the most competitive and cost effective means to procure services.
A. Motion to accept joint bid results for concrete flatwork in an amount not to exceed $133,000.
Public Works Director Sean Dorsey presented background information including; 1) scope of work 2)
proposal process and 3) staff recommendation.
The proposed contract provides for concrete flatwork services following emergency repairs of
underground utilities including water main and sewer repairs as well as concrete flatwork for the Shared
Cost Sidewalk Program. The Shared Cost Sidewalk Program is a public/private initiative in which the
Village and private property owners participate in the cost of sidewalk replacement. Participants in this
year's program can have sidewalk replaced at the rate of $68 per square.
The Village of Glenview is administering the bid. Five (5) bids were received; lowest cost bidder is
Schroeder & Schroeder, Inc., Skokie in the amount of $123,475. The contract is for a 1 -year agreement
in 2016 with an option to extend the contract for two (2) additional extensions for 2017 ad 2018.
As contract quantities are estimates, staff recommends authorizing the award up to the available budget
in order to facilitate quantity variances. Staff further recommends accepting the Municipal Partnering
Initiative joint bid for concrete flatwork and award a one-year contract to Schroeder & Schroeder, Inc. of
Skokie, Illinois in an amount not to exceed $133,000 in 2016. Staff also requests Village Board
authorization to extend the contract to a second (2nd) and third (3rd) year provided the MPI collectively
elects to do so.
In response to questions from the Village Board, Mr. Dorsey provided the following:
■ Isabella project — white markings indicate where curb, sidewalk and in some cases driveway aprons
are to be removed. Part of the street resurfacing project.
■ Informational fliers are dropped off at residences where work is being done.
■ Flatwork — substantial savings through MPI. Three (3) mobilizations are allowed — does not believe
work will pile up.
■ Some work may take longer than others; in those cases temporary surface will be placed to remove
hazard.

amount not to exceed $133,000 for 2016 from Schroeder &Schroeder, Inc. and authorization to extend
the contract to a second (2nd) and third (3rd) year (VBA 24-16)

B. Motion to accept joint purchasing bid for sewer lining in an amount not to exceed $679,413.
Public Works Director Sean Dorsey presented background information including; 1) scope of work 2)
proposal process and 3) staff recommendation.
The contract work entails rehabilitating existing sewer main segments by inserting a cured -in-place
(CIPP) liner inside a host pipe segment. The scope of work in this year's project includes 8,452 lineal feet
of category 5 pipe; category 5 pipes are pipes in the worst condition as assessed by the 2015 combined
sewer study.
The CIPP contract is a joint bid through the MPI; this bid is administered by the Village of Arlington
Heights. Five (5) bids were received, the contract was awarded to the lowest cost bidder; Hoerr
Construction of Peoria. The engineer's estimate for the Village of Mount Prospect project is $1,125,114.
The bid from Hoerr, at $617,648 is well below that estimate.
Staff recommends including a 10% contingency in the award of this project to facilitate unforeseen
circumstances and variances in quantities. The total recommended project award, including contingency
is $679,413 ($617,648 + $61,765 for a total of $679,413). Staff recommends accepting the results from
the Municipal Partnering Initiative joint bid for Cured -In -Place Sewer Lining and awarding a contract to
Hoerr Construction, Inc. of Peoria, Illinois in an amount not to exceed $679,413.
In response to questions from the Village Board, Mr. Dorsey provided the following:
■ Category 5 is the worst.
■ In 2005 eliminated all the category 5 pipe but in the last ten (10) years categories 2 and 3 have
degraded.
■ Not necessarily more expensive to do category 5 repairs.
■ Useful life of pipe — 50-70 years.
■ 1/3 of Village pipes are lined — lengthy program before completion.
■ Does not believe condition of soil has impact on pipes.

■ MPI a good process.

"NATIONAL PUBLIC WORKS WEEK"
May 15-21, 2016
WHEREAS, the services provided by the Public Works Department in our community are an integral
part of our citizens' everyday lives; and
WHEREAS, the support of an understanding and informed community is vital to the efficient operation
of a public works system and its many programs relating to water, sewers, streets and highways, public
buildings, public grounds, solid waste collection, recycling, trees, and snow removal; and
WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design and
construction are dependent upon the efforts and skills of public works employees; and
WHEREAS, the efficiency of the qualified and dedicatedpersonnel who staff public works departments is
materially influenced by the people's attitude and understanding of the importance of the work they
perform; and
WHEREAS, the Mount Prospect Public Works Department will have an Open House on Saturday, May
14, 2016, between the hours of 9:00 a.m. and 1:00 p.m., to acquaint the residents of Mount Prospect with
the many services provided by the Public Works Department.
NOW, THEREFORE, I, Arlene A. Juracek, Mayor of the Village of Mount Prospect, do hereby proclaim
the week of May 15-21, 2016 as
"NATIONAL PUBLIC WORKS WEEK"
in the Village of Mount Prospect and I call upon all citizens and civic organizations to acquaint
themselves with the various services provided by the Mount Prospect Public Works Department to assure

PROCLAMATION
"PREECLAMPSIA AWARENESS MONTH"
MAY, 2016
WHEREAS, preeclampsia is a dangerous condition of pregnancy that can, in its
severest form, lead to maternal and/or infant mortality or premature birth with
significant health risks for the mother and baby; and
WHEREAS, more than 350,000 cases of preeclampsia are diagnosed in America
every year with 25% classified as severe; and
WHEREAS, every 6 minutes of every day in America, a pregnant woman and her
baby face life threatening consequences because of preeclampsia; and
WHEREAS, globally, preeclampsia and other hypertensive disorders of pregnancy
are a leading cause of maternal and infant illness and death, with conservative
estimates claiming these disorders are responsible for 76,000 maternal and
500,000 infant deaths each year; and
WHEREAS, public awareness of the symptoms of preeclampsia (spikes in maternal
blood pressure, sudden swelling of face, feet, and hands, severe upper abdominal
pain, blurred vision) can help women recognize the condition and seek appropriate
medical care; and
WHEREAS, many citizens of Illinois have joined with the Preeclampsia Foundation
to raise public awareness in order to minimize maternal and infant illness and death
due to preeclampsia.
NOW, THEREFORE, BE IT RESOLVED, THAT I, Arlene A. Juracek, Mayor of the
Village of Mount Prospect, do hereby proclaim May to be

mission to reduce maternal and infant illness and death due to preeclampsia and
other hypertensive disorders of pregnancy. Along with the Preeclampsia

PROCLAMATION
"NATIONAL POLICE WEEK"
May 15 - 21, 2016
WHEREAS, there are more than 900,000 sworn law enforcement officers serving in
communities across the United States, including the members of the Mount Prospect
Police Department; and
WHEREAS, on average, one law enforcement officer is killed every 58 hours in the
line of duty; and
WHEREAS, since the first recorded death in 1791, more than 20,000 law
enforcement officers in the United States have made the ultimate sacrifice and been
killed in the line of duty; and
WHEREAS, the names of these dedicated public servants are engraved on the walls
of the National Law Enforcement Officers Memorial in Washington D. C., and
WHEREAS, each year new names of fallen heroes are being added to the National
Law Enforcement Memorial, including 128 officers killed in 2015 and 1,739 officers
killed in the past 10 years; and
WHEREAS, the service and sacrifice of all Illinois officers killed in the line of duty will
be honored during the Memorial Ceremony at the Illinois Capitol on May 5, 2016,
Peace Officer Memorial Day in Illinois; and
WHEREAS, the service and sacrifice of all officers killed in the line of dut� will be
honored during the National Law Enforcement Officers Memorial Fund's 28t Annual
Candlelight Vigil, on the evening of Friday, May 13, 2016; and
WHEREAS, the Candlelight Vigil is part of National Police Week, which takes place
this year on May 15th — 21St; and
WHEREAS, May 15th is designated as National Peace Officers' Memorial Day, in
honor of fallen officers and their families.
NOW, THEREFORE, I, Arlene A. Juracek, Mayor of the Village of Mount Prospect,
do hereby proclaim the week of May 15 - 21, 2016 as
"NATIONAL POLICE WEEK"
in the Village of Mount Prospect and publicly salute the service of law enforcement
officers in our community and in communities across the nation. And, I call upon all
individuals to recognize the dedicated men and women of the Village of Mount
Prospect Police Department for their efforts to maintain our peaceful community and
to also remember the fallen or disabled members of law enforcement agencies
throughout our country.

Information:
The petitioner is requesting an additional extension of the conditional use permit and
variations that were originally approved by ordinance # 5692 on May 20, 2008. The
petitioner previously was granted extensions in 2013 (ordinance # 6077) and 2015
(ordinance # 6199). Rize Properties LLC has entered into a contract to purchase
the property from the petitioner (Paul Swanson Associates) and intends to begin
construction this summer. The approvals for this project expire June 4, 2016,
therefore a further extension is necessary to allow the 3 -unit townhome project to be
co nstructed.

The petitioner is requesting an additional extension of the conditional use permit and variations that
were originally approved by ordinance # 5692 on May 20, 2008. The petitioner previously was granted
extensions in 2013 (ordinance # 6077) and 2015 (ordinance # 6199). The approvals for this project
expire June 4, 2016 therefore a further extension is necessary to allow the 3 -unit townhome project to
be constructed.
Rize Properties LLC (Rize) has entered into a contract to purchase the property from the petitioner
(Paul Swanson Associates) and intends to begin construction this summer. Village Code requires that
the project be "substantially underway" within twelve months of the zoning approvals or they expire.
Rize has indicated that while they intend to pursue constructing the project immediately they will not be
substantially underway by June 4th
Rize would prefer a one-year extension, but given the amount of time that has transpired (8 years) staff
is recommending that the Village Board approve extending the ordinance for 6 -months. The 6 -month
time frame is sufficient to give Rize the opportunity to be substantially underway and complete this
project in a timely manner.
Please forward this memorandum and attachments to the Village Board for their review and
consideration at their May 3 d meeting. Staff will be at that meeting to answer any questions related to
this matter.

Dear Bill:
As you are aware, my company, Rize Properties LLC, is under contract to purchase the property at 309-
317 W. Prospect Ave from Paul Swanson Associates. We are interested in constructing townhouses on
the'property similar to the plans that were previously approved by the Village. We are also exploring
some modifications to the plans, which, if pursued, will require time to develop plans and work through
the approval, process_
I understand that the conditional use permit per Ordinance No. 5692, as previously granted to the
current owner, is set to expire June 4. Given this, I am requesting an extension to the effective date of
the conditional use permit so as to allow sufficient time for project development. I am requesting an
extension of at least six months, but would prefer a one-year extension if possible.
Our contract to purchase the property from the current owner is contingent upon on receiving this
extension. Please let me know what you will need from me to request this extension from the Village
Board.

A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE
WITH THE DOWNTOWN MOUNT PROSPECT MERCHANTS ASSOCIATION
TO CONDUCT WEEKLY CAR SHOWS
WHEREAS, the Village of Mount Prospect supports the summer "Blues Mobile Cruise Night" car shows
held in the commuter parking lots; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have determined that
the best interests of the Village would be served by entering into a Grant of License between the Village
and the Downtown Mount Prospect Merchants Association in order to conduct the annual Car Shows
from May 14, 2016 through September 24, 2016.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby
authorize the execution of a Grant of License to the Downtown Mount Prospect Merchants Association
to conduct the Car Show on Union Pacific Railroad property, which property is leased by the Village

Union Pacific Railroad Company. This License is subject to the following conditions:
1. The term of the License shall be from May 14, 2016 through September 24, 2016.
2. This License shall be revocable at any time by the corporate authorities of the Village of
Mount Prospect if the licensee or any vendor is in violation of state or local laws or this Grant
of License.
3. Within ten (10) days of the execution of this Grant of License, the licensee shall submit to
the Village Manager a pro forma revenue and expense statement setting forth certification
fees and estimated revenues, expenses, management fees, if any, and the proposed
disposition of potential net revenues.
4. Prior to November 30, 2016, the licensee shall issue a written report to the Village Manager
outlining the financial aspects of running the Car Show, problems encountered in the year
2016 season, along with proposed solutions, proposals for improving the Car Show and the
outlook for the future of the Car Show.
5. The licensee shall possess a Certificate of Insurance for public liability insurance in an
amount of not less that $1,000,000 per occurrence naming both the Village of Mount
Prospect and the Union Pacific Railroad Company as additional insured.
6. The licensee/grantee shall not discriminate against any employee, applicant, volunteer,
authorized vendor or event participant because of race, color, religion, sex, sexual
orientation, marital status, national origin or ancestry, citizenship status, age, physical or
mental handicap unrelated to ability, military status or an unfavorable discharge from military
service.

HOLD HARMLESS
WHEREAS, DOWNTOWN MOUNT PROSPECT MERCHANTS ASSOCIATION ("GRANTEE") has
requested permission of the corporate authorities of the Village of Mount Prospect, ("GRANTOR")
to operate a Car Show within the parking lots located on the Union Pacific Railroad property, located
both east and west of Main Street/Elmhurst Road; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect did adopt
Resolution No. on May 3, 2016, entitled "A Resolution Authorizing Execution of a License to the
Downtown Mount Prospect Merchants Association to Conduct the Annual Car Show in the Village".
NOW, THEREFORE, upon the mutual covenants and agreements hereinafter set forth and other
good and valuable consideration, the receipt of sufficiency of which are hereby acknowledged, the
GRANTOR has granted a Grant of License to GRANTEE to operate a Car Show within the parking
lots located on the Union Pacific Railroad property, located on both the east and west sides of Main
Street/Elmhurst Road, which license is conveyed, however, subject to the following terms,
covenants and conditions:
The GRANTOR may at any future time after the date hereof revoke the License referenced
herein and without notice to the GRANTEE and without cost to either the GRANTOR or
his/her successors or assigns.
2. Upon such revocation of said License by the GRANTOR, and with written notice of said
revocation to the GRANTEE, the GRANTEE shall cease operation of said Car Show.
3. GRANTEE shall at all times, and under all circumstances, indemnify, protect, and save
harmless the GRANTOR, its grantees, licensees, agents, lessees and invitees, from and
against any and all damages, losses, claims, demands, actions, and causes of action
whatsoever (including any reasonable costs, expenses, and attorneys' fees which may be
incurred in connection therewith) whether or not the claim, demand or other action asserted
by meritorious, and which results from or is alleged to arise as a result of the activity being
the subject of this Agreement.
4. GRANTOR shall not be liable to GRANTEE, her grantees, licensees, agents, lessees, or
invitees for any damages or injuries (including death) to any person thereof except to the
extent that injuries or damages are caused by the negligent, willful, or malicious misconduct
of GRANTOR.
5. Any notice herein provided to be given shall be deemed properly given if in writing and
delivered personally or mailed to the GRANTOR at:

A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE
WITH THE MOUNT PROSPECT LIONS CLUB
TO CONDUCT A FARMERS' MARKET
WHEREAS, the Village of Mount Prospect supports the annual Farmers' Market held in the commuter
parking lots; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined
that the best interests of the Village would be served by entering into a Grant of License between the
Village and the Mount Prospect Lions Club in order to conduct the annual Farmers' Market from June
12 through October 30, 2016.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS A HOME RULE MUNICIPALITY:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby
authorize the execution of a Grant of License to the Mount Prospect Lions Club to conduct the Farmers'
Market on Union Pacific Railroad property, which property is leased by the Village and under the control
of said Village, a copy of the Grant of License is attached hereto and hereby made a part of as Exhibit
"A"
SECTION TWO: The Village has granted a Grant of License to the Mount Prospect Lions Club to
operate a farmers' market subject to the terms, covenants and conditions of the Hold Harmless
Agreement, attached hereto and hereby made a part of this Resolution as Exhibit "B".
SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and

Exhibit "A"
GRANT OF LICENSE
The Village of Mount Prospect hereby grants a license to the MOUNT PROSPECT LIONS CLUB
(licensee) for the purpose of operating a Farmers' Market on the parking lots located at the Union
Pacific Railroad property located both east and west of Main Street/Elmhurst Road, which property
is currently leased by the Village of Mount Prospect from the Union Pacific Railroad Company. This
License is subject to the following conditions:
The term of the License shall be from June 12 through October 30, 2016.
2. Each vendor operating at the Farmers' Market shall possess a Certificate of Public Liability
Insurance in an amount not less than $100,000 per occurrence and shall execute a Hold
Harmless Agreement, a copy of which is attached hereto and hereby made a part of as
Exhibit "B".
3. This License shall be revocable at any time by the corporate authorities of the Village of
Mount Prospect if the licensee or any vendor is in violation of state or local laws or this Grant
of License.
4. The licensee must issue written rules applicable to all vendors and must certify each vendor
as qualified prior to the vendor's participation in the Market. The licensee shall ensure all
applicable Village food code regulations (Chapter 12 of the Mount Prospect Village Code)
are followed and enforced. The licensee shall cooperate fully with duly authorized Village
employees for enforcement of Village codes including but not limited to prequalification, spot
inspections, etc.
5. Within ten (10) days of the execution of this Grant of License, the licensee shall submit to
