INVOCATION Trustee Rogersgave the Invocation. MINUTES Trustee Polit, seconded by Trustee Rogers,moved to approve the minutes of the regular Village Board meeting held August 2, 2016. MAYOR’S REPORT A.Accolades Proclamation: School’s Open Safety Week, August 21-27, 2016 Mayor Juracek presented the proclamation to Police Chief Tim Janowick. Chief Janowick encouraged all Mount Prospect residents to drive safely and cautioned drivers to be especially cognizant of traffic laws specific to school zones. B.Board of Fire and Police Commissioners –2015 Annual Report Michaele Skowron,Chair of the BOFPC presented the 2014 Annual Report. Ms. Skowron provided a detailed overview of 2015 activities which reflected the four (4) areas of authority granted the BOFPC by village code and state statute: 1) hiring process 2) promotion process for first level supervisors 3) discipline and 4) termination. Mayor Juracek thanked Ms. Skowron for the excellent report and acknowledged the significant commitment of the BOFPC members; a busy year that required extensive time and effort. 1 page of 7 Village Board Meeting MinutesAugust 16,2016 The Village of Mount Prospect BOFPC is a civilian board who serves for the good of the community and does so without compensation. This ordinance amendsChapter 13 (Alcoholic Liquors) by deleting an “F-2” liquor licenseissued to FSAS LLC d/b/a Arnie Salerno’s Pizzeria located at 1716 East Kensington Road. The restaurant is under new ownership. This ordinance amends Chapter 13 (Alcoholic Liquors) by deleting an “F-3” liquor license issued to Canta Napoli Ristorante, Inc. d/b/a Canta Napoli located at90 East Busse Avenue. The restaurant is under new ownership. OLD BUSINESS A.Public Meeting and Public Hearing Mayor Juracek stated this public hearing and public meeting, called pursuant to proper legal notice having been published in the Daily Herald on August 6, 2016, is to consider the annexation and zoning designation of \[l1 (Limited Industrial)\] territory within unincorporated Cook County to the Village of Mount Prospect. Mayor Juracek called the Public Hearing to order at 7:24 pm to consider the zoning designation of l1 (Limited Industrial) for the territory within unincorporated Cook County being considered for annexation into the Village of Mount Prospect. Mayor Juracek explainedthe Public Hearing is for the zoning designation but the ordinance to be considered is for both the annexation and zoning designation. Village Manager Michael Cassady provided background information regarding the properties located at 1105 E. Algonquin Road, 1901 S. Busse Road, 1801 S Busse Road, 1690 W. Imperial Court, 1691 W. Imperial Court, 1911 S. Busse Road, 1907 S. Busse Road, 1660 W. Kenneth Drive, 302 W. Kenneth Drive, 505 W. Kenneth Drive, 1600 W. James Drive and 1650 James Drive; approximately 27 acres. The subject properties are improved with a variety of industrial and retail uses; the Village’s l1 Limited Industrial is the most compatible zoning district with the existing uses in this area. Village staff have met with the property owners to discuss concerns relative to their business operations under Cook County regulations versus Village regulations. The Village has assured the owners the l1 zoning would not impact their current operations; Village will honor special uses. Village ManagerCassady also highlighted the life safety and financial benefits the businesses would receive as part of the Village. Public Comment Mr. Louis Goodman 310 North School In response to Mr. Goodman’s question regarding the cost to the Village to annex the properties, Mr. Cassady cited the state statute requiring the Village to pay the Elk Grove Fire Protection District. Mr. Joseph Gattuso –attorneyfor 1650 James LLC and 1105 LLC Mr. Nick Stanford –attorney On behalf of their respective clients Mr. Gattuso and Mr. Stanford requested the Village defer consideration of the annexation/zoning ordinance. Both believe annexation agreements can and should be reached before annexation occurs. The business owners and attorneys believe it is in their business interest to have a written agreement that provides legal assurance they will be allowed to operate under the same conditions currently allowed under Cook County l3 zoning regulations. Village Attorney, Lance Malina and Village Manager Cassady provided the following in response to questions from the Village Board: 4 page of 7 Village Board Meeting MinutesAugust 16,2016 Businesses affected by annexation would prefer to keep status quo with unincorporated Cook County. Village’s allowance of legal, non-conforming status provides greater leniency than Cook County l3 regulations. Annexation without written agreement will not impair business. Would not be favored nation –each business would need to negotiate their own agreement. Deferral of the annexation is not a simple matter; changes property. Regarding notifications; two separate plats could increase number of plats and agreements Mr. Don Mackey –Imperial Court Business Owner Mr. Mackey expressed his concerns with the proposed annexation. He believesthe cost to his business will increase if it is brought into the Village. Village Board Comments Village is on record that businesses will be granted legal, non-conforming status under annexation; no impact to business operations. Fair to provide assurance to businesses that existing operations will not be impacted by annexation. Conditions not brought in under annexation will be subject to conditional uses and variations. Trustee Hoefert, seconded by Trustee Polit, moved for approval of Ordinance No. 6264: AN ORDINANCE ANNEXING TO AND ZONING OF CERTAIN PROPERTY BY THE VILLAGE OF MOUNT PROSPECT Mayor Juracek called for a recess at 8:09 p.m.; Mayor Juracek resumed the August 16, 2016 Village Board meeting at 8:14 p.m. nd B.2reading of An Ordinance Annexing Certain Property to the Village of Mount Prospect This ordinance authorizes the annexation of certain property located at the southeast corner of Linneman Road and Dempster Street of unincorporated Cook County, 1200 Dempster. This item was deferred from the April 19, 2016 Village Board meeting until the August 16, 2016 Village Board meeting by a vote of 6-0. NEW BUSINESS A.A Resolution in Support of an Extension of a Cook County Class 6b Extension for DP Realty Partners LLC located at 2200 South Busse Road. Mayor Juracek presentedaResolution in Support of an Extension of a Cook County Class 6b Extension for DP Realty Partners LLC located at 2200 South Busse Road. Community Development Director William Cooney provided background information including Irv’s Luggage/Executive Essentialsbusiness history, occupant of 2200 South Busse Road, Cook County Tax Abatement program, staff recommendation and responded to questions from the Village Board. The renewal would be for an additional 12 years and would enable Irv’s Luggage/Executive Essentials to maintain their operations in Mount Prospect.Mr. Cooney added the Village has worked with Irv’s in resolving all signage issues; the business is in compliance. TheClass 6b incentive reduces the assessment level for qualified manufacturing and warehouse/distribution facilities from 25% to 10% for the first ten (10) years, 15% for year eleven (11) and 20% in year twelve (12). Mr. Wein, owner of Irv’s, was in attendance to provide additional information and respond to questions from the Village Board. Mr. Wein thanked the Village Board for their support of his business as well as the Class 6b incentive. He stated with the volume of sales through the internet makes this a challenging time for retailers. Village Board Comments Supports Class 6b tax incentive important tool for businesses; allows businesses to stay in Mount Prospect. Business creating jobs and revenue;occupancy versus vacant structureis benefit to Village. Thanked Mr. Wein for choosing to stay in Mount Prospect. Trustee Hoefert, seconded by Trustee Rogers, moved to approve Resolution No. 30-16: A RESOLUTION IN SUPPORT OF AN EXTENSION OF A COOK COUNTY CLASS 6B EXTENSION FOR DP REALTY PARTNERS LLC FOR PROPERTY LOCATED 2200 SOUTH BUSSE ROAD Upon roll call: Ayes: Hoefert, Polit, Rogers, Saccotelli Nays: None Motion carried. 6 page of 7 Village Board Meeting MinutesAugust 16,2016 VILLAGE MANAGER’S REPORT A.A Resolution to Approve a Contract Agreement Between the Village of Mount Prospect, Illinois and the Mount Prospect Fire Fighters Union Local 4119 International Association of Fire Fighters (Term of January 1, 2016 through December 31, 2018) Village Manager Cassady presented a Resolutionto Approve a Contract Agreement Between the Village of Mount Prospect, Illinois and theMount Prospect Firefighters Union Local 4119 International Association of Firefighters (Term of January 1, 2016 through December 31, 2018). Village Cassady provided background information regarding the negotiation process, terms of the three (3) year agreement and recognized the fire personnel (Firefighters Dale Steward, Joe Knoll, Brad Peterson and Steve Slobe),Deputy Fire Chief John Dolan and Village administration involved in negotiations. The contract described as a win/win agreement includes a two per cent wage increaseas well as shift in insurance costs to employees. On behalf of Fire Chief Brian Lambel, Deputy Fire Chief John Dolan, extended their thanks to the Village Board, Village Administration and all involved in the negotiation process. Deputy Chief Dolan recognized Administrative Analyst Alexander Bertolucci for his outstanding work on the contract agreement. Trustee Hoefert, seconded by Trustee Saccotelli, moved to approve Resolution No. 31-16: A RESOLUTION TO APPROVE A CONTRACT AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS AND THE MOUNT PROSPECT FIREFIGHTERS UNION LOCAL 4119 INTERNATIONAL ASSOCIATION OF FIREFIGHTERS (TERM OF JANUARY 1, 2016 THROUGH DECEMBER 31, 2018) Upon roll call: Ayes: Hoefert, Polit, Rogers, Saccotelli Nays: None Motion carried. ANY OTHER BUSINESS Trustee Hoefert requested updates on property maintenance issues of three (3) residential properties on Rand Road and the status of the development of the old Tri-State property. Community Development Director William Cooney stated two (2) of the properties on Rand have been sold and the third has a sale pending. Community Development inspectors monitor the properties daily to ensure compliance. The developers of the old Tri-State have yet to break ground. He maintains regular contact with developer for status reports. Trustee Polit announced the Saturday, August 20th Blues Mobile Car Show will feature Auto Barn VW and have live music from Rosie and the Riveters.
