Lisa Angell Village Clerk Village of Mount Prospect Cook County, Illinois (meal) ORDINANCE NO. 6251 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A CIRCULAR DRIVEWAY FOR PROPERTY LOCATED AT 402 WEST GOLF ROAD MOUNT PROSPECT ILLINOIS WHEREAS, Suvhanberdi Atamyradov ("Petitioner'), has filed a petition for a Conditional Use for a circular driveway for property located at 402 West Golf Road ("Property') and legally described as; LOT 12 IN BLOCK 3 IN LONNQUIST GARDENS, BEING A SUBDIVISION OF PART OF THE NORTHEAST '/4 OF SECTION 14, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 20, 1945 AS DOCUMENT 13663132, IN BOOK 356 OF PLATS PAGE 5, IN COOK COUNTY, ILLINOIS. PIN: 08-14-207-022-0000 WHEREAS, the Petitioner seeks a Conditional Use to construct a circular driveway; and WHEREAS, a Public Hearing was held on the request for Conditional Use designated as PZ -12-16, before the Planning and Zoning Commission of the Village of Mount Prospect on the 26th of May, 2016, pursuant to due and proper notice thereof having been published in the Daily Herald Newspaper on the 11th day of May, 2016; and WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the Mayor and Board of Trustees in support of the request being the subject of PZ -12-16; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the Mayor and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect grant Conditional Use permit to allow the construction of a circular driveway, as shown on the Site Plan (Elegant Architecture LLC), a copy of which is attached as Exhibit "A" subject to the following conditions: 1. The new driveway apron should be installed at least 6' from the existing parkway tree. 2. A permit will be required from IDOT before work can begin. SECTION FOUR: The Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in in the manner provided by law.
