SUBJECT: PZ -16-15,300 E. EVERGREEN AVENUE FOLLOW UP
During the discussion on the subject petition at the last Village Board meeting Trustee Zadel asked that
staff research whether there are any existing regulations that would limit or prohibit parking vehicles on
gravel surfaces on residential property, particularly from an environmental standpoint. Staff reviewed
local, state and federal regulations to determine if any such restrictions exist. Our research found that
there are no such restrictions. Staff also contacted the Illinois Environmental Protection Agency to
discuss this matter further. They indicated that they do not have any regulations that deal with
homeowner's driveways.
They also added that in many ways gravel surfaces are preferred to paved surfaces as they limit the
amount of vehicular fluids from entering into the storm water system. When driveways are paved,
much more water and vehicular fluids run off into storm water systems and must be treated. The gravel
surfaces keep the majority of these fluids on the subject property.
There are regulations under the National Pollutant Discharge Elimination System (NPDES) Storm
Water Management Program, created in an amendment to the Clean Water Act (33 U.S.C. 1342), that
address storm water discharge from construction sites, industrial facilities, and selected municipalities.
These regulations require that employees are trained to prevent and reduce storm water pollution
during fleet and building maintenance, operation of storage yards, snow disposal, street cleaning
debris, and the disposal of catch basin material.
Please forward this memorandum to the Village Board for their review and consideration at their
meeting on October 6th. Staff will be present at that meeting to further discuss this matter.

ORDINANCE NO.
AN ORDINANCE GRANTING A VARIATION TO ALLOW A
GRAVEL DRIVEWAY FOR PROPERTY LOCATED AT
300 EAST EVERGREEN AVENUE. MOUNT PROSPECT. ILLINOIS
WHEREAS, Thomas F. Karlov (Petitioner), has filed a petition for a Variation to allow
gravel driveway for property located at 300 East Evergreen Avenue (Property) and
legally described as:
LOT "C" (EXCEPT THE NORTH 100 FEET THEREOF AND EXCEPT THE EASAT 75 FEET
THEREOF) IN BLOCK 8 IN BUSSE AND WILLE'S RESUBDIVISION IN MOUNT PROSPECT
IN THE WEST HALF OF SECTION 12,TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE
THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS.
PROPERTY INDEX NUMBER: 08-12-111-010-0000
WHEREAS, the "Petitioner" seeks a Variation to allow a gravel driveway as shown on
the as shown on the, Plat of Survey dated March 4, 1987, attached as Exhibit "A" for the
property located at 300 East Evergreen Avenue; and
WHEREAS, a Public Hearing was held on the request for a Variation being the subject
of PZ -16-15 before the Planning and Zoning Commission of the Village of Mount
Prospect on the 2ihday of August, 2015, pursuant to proper legal notice having been
published in the Daily Herald Newspaper on the 8th day of July 2015; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and
recommendations to the Mayor and Board of Trustees in support of the request being
the subject of PZ -16-15; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the request meets
the standards of the Village and that the granting of the Variation to allow a gravel
driveway would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact
by the Mayor and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect
grant a Variation to allow a gravel driveway as shown on the as shown on the Plat of
Survey dated March 4, 1987, attached as Exhibit "A".
SECTION THREE: The Village Clerk is hereby authorized and directed to record a
certified copy of this Ordinance and Exhibit "A" with the Recorder of Deeds of Cook
County.
SECTION FOUR:. This Ordinance shall be in full force and effect from and after its
passage, approval and publication form in the manner provided by law.
