SUBJECT: ACCEPTANCE OF PROPOSAL FOR SITE REMEDIATION PROGRAM (SRP) CLOSURE
AND PROFESSIONAL REMEDIATION SERVICES FOR 2 - 40 N. MAIN ST. (CENTRAL
PLAZA)
Central Plaza has been neglected for several years and has significantly deteriorated creating a
nuisance to the public. Numerous attempts were made by staff to locate the property owner to
rehabilitate the property without success. Unfortunately the owners have not been responsive and
the Plaza has deteriorated past the point of repair and is a public nuisance.
Given these facts, the Village sought and received a Final Default Order and Injunction for Demolition
from the Circuit Court of Cook County. The order was granted to the Village and all required notices
have been given to all potential owners of our intent to pursue the demolition and environmental
cleanup of the Plaza. The Village previously entered into a contract with Albrecht Enterprises to
demolish the structure which will begin around Labor Day.
The Community Development Department solicited proposals from environmental firms to obtain a
Tier I Residential No Further Remediation (NFR) letter from the Illinois Environmental Protection
Agency (TEPA) for the Central Plaza property. Three proposals were submitted by environmental firms.
All three firms are capable of performing the services requested and have performed similar work for
other local municipalities. Listed below are the cost proposals that were submitted for the work:

The above proposals cover the cost of a Phase 1 Environmental Site Assessment (required for the NFR
application), removal of up to 2,000 tons of non -hazardous soils, removal of 12,000 gallons of
contaminated water and the SRP/LUST reporting that are necessary to obtain a Tier I Residential NFR
letter from the TEPA. The proposal is for time and materials as it relates to the removal of non-
hazardous soils and contaminated water. The estimated quantities for both of these materials were
based upon the Phase 11 study that was completed by Tetra Tech earlier this summer. The final cost

will be based upon the actual quantity removed from the site. Staff recommends including a 10%
contingency in the project award to allow for quantity variances and unanticipated conditions. In this
instance, a 10% contingency would add $26,620 to the proposal for a total of $292,829.
In addition to the costs listed above, the Village will pay the IEPA directly for any application fees
associated with the project. V3 estimates that these fees will range from $5,000 to $10,000 depending
upon the amount of IEPA oversight required. Once all of this work is completed, the Village will file the
necessary priority lien to recuperate all costs associated with this project. Sufficient funds are available
in the Downtown Development Fund to cover these expenses and staff will process a budget
amendment later this fall to reflect this expense.
Please forward this memorandum to the Village Board for their review and consideration at the
September 1St Village Board meeting. Staff will be present to answer any questions related to this
matter.

BACKGROUND
In 2010, the Village secured the services of a roofing consultant to provide a condition
assessment of the Public Works' garage and the Administration office roof systems including
roof membrane and underlayment. The consultant recommended the complete replacement of
the roof membrane and installing an additional layer of insulation to bring the administrative roof
up to the new insulation standard. The roof is an original installation placed when the Public
Works Facility was constructed in 1987-88 and is currently 27 years old.
In July 2015, the Village hired Ehlke Lonigro Architects, LTD., of Wheeling, Illinois to prepare
the bid documents, oversee the bidding, and supervise construction of the project. In preparation
of the bid documents Ehlke Lonigro Architects, LTD. performed a new condition assessment of
the roof that confirmed the original assessment.
BID RESULTS
Sealed bids were opened at 1:00 P.M. on Monday, August 24, 2015 for proposed roof
replacement. Five (5) invitational bids were mailed and a bid notice was placed in the local
paper. Nine (9) companies attended the mandatory pre-bid meeting. Seven bids were received;
results are as follows:

DISCUSSION
Staff has evaluated all bids and determined that the bids received are responsive to the request.
All bidders submitted the required bid securities. All submitted bids meet the bid qualifications.
The apparent low bidder Olsson Roofing Company, Inc., of Aurora, Illinois has provided all
necessary material and references as outlined in the bid specification. Olsson Roofing Company,
Inc. has not done work for the Village in the past. They are known to our roofing consultant,
Ehlke Lonigro Architects, LTD., as an excellent contractor who has successfully completed
several similar projects. Reference checks also indicate that Olsson Roofing Company, Inc. has
sufficient experience and expertise to perform the requisite work.
Staff recommends including a 10% contingency fee in the award of this project. This
contingency would be reserved for solutions to unanticipated conflicts that arise during the
removal and installation of the new roofing system. In this instance, the total recommended
award is $213,400 + $21,340 (10% contingency) = $237,740 (total award).
RECOMMENDATION
Staff recommends accepting the lowest cost proposal as submitted by Olsson Roofing Company,
Inc. of Aurora, Illinois for the Public Works Roof Replacement Project in an amount not to exceed
$237,370. Sufficient funds for this proposed project exist in the current budget.

Background
In 2014 the Village of Mount Prospect received $92,400 in Safe Routes to School funds for the
construction of crosswalk improvements at Central Road and Weller Lane. This highly
competitive, federally -funded program looks to promote and improve walking/biking to and
from school. In July of 2015, the Village signed a Local Agency Agreement with the Illinois
Department of Transportation (IDOT) establishing the division of cost for the project. The
agreement also established that the project construction contract would be awarded by IDOT
through their competitive bidding process. IDOT will pay the contractor directly and the Village
will reimburse IDOT for our share of the construction cost.
Bid Results
IDOT opened bids on July 31, 2015. 9 contractors bid on the project and Alliance Contractors,
Inc. of Woodstock, Illinois was the low bidder with a bid of $164,621.86. The complete bid

The low bid is $33,911.36 above the project estimate of cost. The increase is mainly due to
significant increases in asphalt and concrete prices that are occurring on all 2015 construction
projects. The maximum federal participation is capped at $92,400.00, so the Village would be
responsible for the remaining cost of $72,221.86. IDOT is seeking the Village's concurrence to
award the contract to the as -read low bidder in the amount of $164,621.86. To allow for

contingency in contract quantities, 10% should be added bringing the Village's share to a not -to -
exceed amount of $79,500.00.
Recommendation
1 recommend that we concur with the award by IDOT of the Central Road & Weller Lane
Pedestrian Crossing Improvements Project to the low bidder Alliance Contractor, Inc. in the
amount $164,621.86. It is understood that the Village's maximum participation will be
$79,500.00. There are sufficient funds in the 2015 Budget to cover the Village's cost share.
Please include this item on the September 1S1 Village Board Meeting Agenda.

Police Department Request
The police department is requesting to purchase and install a new range target control system
at a cost not to exceed $120,000.00, as funded in the FY2015 Capital Improvement Plan (CIP).
Attached for your review are itemized estimates from four (4) vendors. Two (2) vendors are
involved with the installation of a new target control system, and two (2) vendors are specific to
the demolition procedures required prior to any new installation.
Discussion
The Police Department's rifle/pistol range is utilized on a frequent basis for weapons training,
qualifications, and maintenance. The firearms range is located in the basement of Fire Station
12, located at Golf and Busse Roads. All sworn personnel are required to qualify three (3) times
a year, demonstrating proficiency with duty weapons, off-duty weapons, less lethal weapons,
and AR -15 rifles. In addition to the required Department qualifications, personnel also complete
the State mandated firearms qualification course and receive ongoing training in weapons
tactics at this facility. For an agency of our size, it would be logistically challenging and very
costly to attempt to conduct these activities at an alternate location outside of the Village limits.
The current target carrier system was installed in early 2008. Three (3) vendors were involved
in the bidding process at that time: Action Target, Meggitt Training Systems, and Patriot Range
Technologies. Patriot Range Technologies was the mid -priced vendor and was awarded the
contract. Patriot Range Technologies is a small, local business based out of Plainfield, IL. Staff
selected this vendor because it was believed that having a small, local company perform the
work would have resulted in superior customer service and expeditious response times for our
service requirements. Unfortunately, this has not been the Department's experience with Patriot
Range Technologies. The performance of the Patriot system has not met the Department's
expectations and the frequent breakdowns have caused considerable downtime to our range
operations. The required parts for the target carriers, such as the internal electric motors, are no
longer manufactured and are unavailable. The software for the Patriot system is antiquated and
is no longer supported. The equipment is unreliable and is in need of constant repair. As such,
the system is in dire need of replacement.
In addition to the equipment issues, the customer service and support provided by Patriot
Range Technologies has been grossly substandard. The company does not return phone calls
and having a technician respond to service our facility in a timely manner has been very difficult.
Our overall experience with Patriot Range Technologies has been extremely poor. As a result,
they were excluded from the bidding process.

Vendors
Action Target and Meggitt Training Systems are the two largest and best known vendors in the
firing range target carrier systems arena. Both vendors have done hundreds of installations for
law enforcement agencies and commercial ranges nationwide. They are always represented at
the International Association of Chiefs of Police Conference, Illinois Tactical Officer's
Convention, and at the International Law Enforcement Educators Association Conference each
year. These are firmly established companies that offer a more stable customer service base
due to their success and longevity within the industry. Sergeant Schmitz, our firearms training
coordinator, and staff visited several agencies in the area to view systems installed by both
Action Target and Meggitt Training Systems. Staff was able to have candid discussions with
other firearms instructors who utilize these systems on a continual basis. The following is a list
of the agencies' staff visited along with the firearms instructors / training coordinators contacted
at each agency:

Staff was very pleased with the results of the onsite inspections. Both Action Target and Meggitt
Training Systems received very positive reviews. The training coordinators and firearms
instructors interviewed advised that they rarely, if ever, had system failures and that
representatives from each vendor contacted them on a regular basis. Both companies were
receptive to the needs of the respective agencies and provided excellent customer service and
support. All of the listed agencies were very satisfied with their current target carrier systems.
None of the agency representatives had anything negative to report.
Best Technology Systems (BTS) is our local bullet trap maintenance company that we have
utilized since the installation of our new backstop in 2008. They are involved in the hazardous
materials removal of the lead from our bullet trap. Action Target and Meggitt advised they
would subcontract BTS to conduct the demolition and soundproofing portions if awarded the
proposed project. Both vendors advised the Village could reduce their costs by contacting BTS
directly as we are a current customer. Staff contacted BTS to obtain a bid on the demolition of
our carrier system and the installation of new acoustical tiles on the range ceiling and walls.
Staff also conducted a search for alternate vendors, which proved to be more difficult than
anticipated. As this portion of the project falls under federal hazardous materials guidelines, the
number of available vendors is extremely limited. We were able to locate a second federally
licensed and certified vendor, Green Bay Lead, who could handle both the demolition and
construction aspects of the proposed project.
Proposed Project
Our firing range is currently a four (4) position range with a linear target carrier system. This
system would be removed and would be replaced by four (4) static target holders placed directly
in front of the backstop. The targets would face/edge upon command, but they would no longer
move longitudinally from front to back of the range. The targets would be controlled from a
control booth console or remotely by the use of a handheld tablet. The most continual and
consistent failure of our current system was the target carrier mechanisms that moved the

targets along a rail system. This entire rail system would be removed and eliminated.
Movement in our training programs will be accomplished by having the officer move, not the
targets. This type of system has a proven track record of outstanding reliability and very low
maintenance.
"Combat walls" will be installed along the interior walls extending out 20 feet from the backstop.
These bullet absorbing walls will allow a 180 degree training area in which officers could engage
multiple targets at varying angles. This would allow our officers to encounter new training
experiences such as live fire dynamic entry and room clearing drills which cannot be conducted
within our current facility. The ability to fire at targets within a 180 degree arc allows our
instructors to design courses of fire that formerly could only have been done in select, outdoor
ranges. The installation of combat walls would greatly enhance the current firearms training
program.
System Costs
Both Action Target and Meggitt Training Systems submitted proposals for the aforementioned
project. These proposals are attached for your review. Total costs from each of these vendors
are as follows:

Meggitt Training Systems $66,712.51
The proposals from Meggitt and Action Target are primarily for the same or very similar
products and services. They also both received very favorable reviews from all the agencies we
had contacted. Both vendors offer a similar product line and their customer service reviews
were virtually the same. However, Meggitt Training Systems' proposal is $9,087.49 cheaper
than Action Target. This figure reflects a savings of approximately 12% overall. It is staff's
recommendation that Meggitt Training Systems be awarded the contract to renovate our range
facility at this time.
The demolition portion of the project consists of proposals submitted by Best Technology
Systems and Green Bay Lead, Inc. Their proposals cover the removal of the existing sprayed
on woolen material from the walls and ceiling and the installation of sound reduction materials.
However, there are some major differences between the two proposals. Green Bay Lead, Inc.
included sound proofing materials along the entire ceiling and BTS did not include this service.
Also, BTS's quote included the use of generic foam tiles for the soundproofing whereas Green
Bay Lead will be installing top quality Acoustical Solutions wall curtains and PolySorb sound
panels. Green Bay Lead's quote included the demolition of our current target carrier and baffles.
Green Bay Lead's quote also included the removal of the existing soundproofing and installing
Acoustical Solutions sound absorbing curtain panels along the walls and PolySorb sound
reducing panels on the ceiling. Green Bay Lead is a certified hazardous materials abatement
company and will be responsible for the disposal of all hazardous waste. It is staff's
recommendation that Green Bay Lead be awarded this contract as their proposal was less
expensive, they offer a greater amount of services, and they utilize superior quality materials.

Summary
This project would be funded from monies budgeted in capital improvement fund account #
020.60.90.00.1706.647.013. Attached for your review are quotes from both the range firing
control system vendors as well as the two demolition companies.
In conclusion, based on their ability to meet all Department specifications, costs, and
professional experience, it is the Police Department's recommendation to waive the bid process
and have Meggitt Training Systems install a new target control system at a cost not to exceed
$66,712.51.
It is also the Police Department's recommendation to waive the bid process and have Green
Bay Lead, Inc. conduct the necessary demolition, sound proofing installation and hazardous
waste removal at a cost not to exceed $41,105.00.
Total cost for both the demolition/removal of the existing target carrier system by Green Bay
Lead, Inc., and the installation of the proposed renovations by Meggitt Training Systems would
be $107,817.51. These funds represent all cost associated with making the new range firing
control system operational.

In addition to our live fire range solutions and virtual training simulators, MTSI also provides agencies with
expert consultation services for design build efforts (by the customer's selected general contractor), and
can provide additional equipment and range customization, as desired by the customer. These design
services can be provided at an additional cost, if the buyer wishes to capitalize on MTSI's vast expertise.
The Live Fire Group of MTSI has over 90 years of experience in developing, fielding and supporting
superior target and range system solutions. Today we supply solutions for a wide range of infantry and
armor stationary and moving targets, ancillary and support devices, and Range Control Systems (RCS), in
addition to a complete line of bullet traps and ballistic protection, and the only shoot house that is
designed for ease of sustainability and long term operation. At MTSI we develop and adapt our products
to satisfy the ever evolving specifications of our customers. In addition to the strengths extolled
elsewhere in this introduction, we have a Field Service Team that stands out as the best in the business.
The Field Service Representatives (FSR) are instrumental in our ability to deliver "turn -key" product
solutions, and support to fielded systems through the full life of the product.

3 Technical Descriptions
3.1 Target Systems
3.1.1 Model AA2 Fixed 3602 Turning Target System (RSIT)
The AA2 RSIT is a fixed/stationary target
mechanism with full 360' turning capabilities. The
RSIT is capable of running preprogrammed
scenarios, and has hit sensing and programmable
hit reaction capabilities.
The RSIT actuator is a derivative of our proven
stationary infantry target (SIT), of which we have
delivered approximately 30,000 units. The AA2
hangs from the ceiling protected by the ceiling
baffles.
The RSIT turning target turns up to 360°, as
programmed by the user, to show a friend/foe
image to force the shooter to make a shoot/ no -
shoot decision. The target system is
programmable to run simple and complex
scenarios, and will randomly turn the targets to
edge, friend, and foe after a preset amount of
time. The actuators are all uniquely addressed, so
while the operator is running only one program,
each target will be performing the unique
functions it was programmed to perform.

Each RSIT has hit sensing capability to enhance training. The system counts and reports the number of
hits each target has received and the target will react as programmed in response to hits.
For example a programmed scenario could read...
• After two bullet strikes against the target, the system will register a kill and turn the target
to edge, then;
• After three seconds the target will present friend, then;
• After 5 seconds it will present foe/and require three shots to kill.
After the training session is complete, the shooter can look at the hit/no hit data that is stored in the
RCS to analyze his shooting proficiency and achieve objective results.

The realistic judgments shooters are faced with using the RSIT target system to better train then to
make the shoot or no shoot decisions that they may face in the field.
3.2 Ballistic Baffle Systems
3.2.1 Model JR5C, Redirective Guard
Model JR5C Steel Redirective Guard is suspended from
the ceiling at locations forward of the bullet trap to
help shelter the ceiling area above. It is installed so
that bullets hitting the guard are redirected down
range toward the bullet trap. The guards are able to
withstand direct hits from all mid-range target
ammunition and regular service ammunition from
handguns, shotguns, and limited rifles, excluding steel
core and armor piercing rounds. The JR5C Redirective
Guard is %" inch thick, AR500 armor plate.
3.3 Combat Wall Systems
3.3.1 Model BWN, Combat Wall System
The BWN Combat Wall System panels are designed
using the airspace principle, to effectively stop
handgun and limited rifle rounds, and protect shooters
from the resultant back -splatter and debris. Each
panel consists of a 1/4" (6mm) AR500 steel plate, with
attached furring (to create airspace between the steel
plate and baffle face) and a 1" rubber facing. BWN
panels are designed for vertical installation and the
system includes a wall faring to protect the leading
edge of the steel. MTSI Combat Wall panels are
designed in nominal (nom). 2' W x 8'T (1.5 m2) panels
that attach to the wall vertically (allowing less than
1/8" (3.2mm) gap between steel plates). The panels
are designed to allow ease of handling for installation
and future maintenance.

3.4 Range Control Systems
3.4.1 Model RM10K-LE, Master Control Computer
The RangeMasterT"" 10K (RM10KT11)
touchscreen controller revolutionizes the
way range officers control targetry and
interact with shooters. The combination
of touch screen technology and wireless
communication provide portability to give
the range officer unprecedented control
from any location in the range.
The RangeMasterTI 10K is intuitive, easy
to navigate, and allows range personnel
to operate their range by simply touching
icons on the display screen. The display
screen is segmented into three main
parts: target commands appear on the
left side of the display, range layout is
adjacent to this, and a menu bar appears
across the bottom of the display.
The RangeMasterT`" 10K can also control a number of optional range support systems such as range and
target carrier lighting, and signal light security systems. The Emergency Stop feature located on the
home screen provides a quick and easy method for halting all range operations with a single press of the
button.

The range layout is depicted using a grid of
targets and provides a real time display of
target conditions. Each target is identified by
the lane number, distance/ location, lighting
indicators, signal lights, and control mode. The
range operator can acquire or release control of
a lane by pressing the corresponding button on
the RM10KII Touchscreen. Releasing control of
the target allows shooters to have independent
control of their lane using the individual control
units located at each firing position.
The RM10KTM allows multiple devices to control
the range at the same time. For example, a
range operator could run a scenario on lanes six
through ten from the RM10KT11, while another
range instructor is positioned at the firing line
and operating lanes one through five with the
RM10KTM wireless tablet controller. In short, the
RMIOKTM provides range operators with control
over firing ranges through multiple wireless
devices from any location in the range.

MTSI assigns a Project Manager (PM) to each
order. The PM coordinates all internal activities
and is the customer's primary point of contact
during contract performance. The PM maintains
the project schedule, administers the submittal
process, monitors the manufacturing and quality
control processes, assures contract adherence,
coordinates delivery and installation, initiates the
internal warranty process, and closes out the
project file. The PM will remain the primary point
of contact throughout the warranty and
maintenance period for issues not related to
Customer Service calls.

The PM convenes aroQect team at time of
award; comprised of the PM project engineer,

range configuration specialist,

engineering group, compliance department, and quality group join the team as required. The project
team configures the product configuration, initiates the manufacturing process, and sets the internal
production schedule.
Once a contract is accepted, the PM will contact the customer to establish the project schedule
(specifically product delivery date and installation time -frame) and verify the customer's requirements.
During MTSI's contractual performance the PM will contact the customer as required to advise of
schedule updates, and progress, in addition to resolving any issues that might occur. A full project
schedule will be delivered after the contract award and agreed to with the customer.
The PM also coordinates with the Compliance Department any export licenses and completion of ITAR
documentation (as required). If the products under contract require export approval from the US Dept.
of State (ITAR), the PM will provide an example of the End User Certificate (for customer completion);
this must be submitted with the ITAR application to receive an export license. If the products purchased
are restricted under [TAR an export license must be received prior to shipping. Export license approval
process can take approximately 4-7 weeks from date of application. To reduce the risk of export license
problems, the application will be made at the time of order.
The PM will coordinate the onsite technical support offered in this order, including as needed a design
visit by the range ventilation engineer, a pre -installation survey by the field technician, the number of
trips required to provide adequate technical support and supervision to the installation crew, and the
commissioning and balance of the range ventilation system.

After the completion of the installation and commissioning by the MTSI technician, and customer
acceptance, a training session for operators and maintainers will be held. Following the completion of
acceptance and training, the customer will take possession of the range, and the warranty and
maintenance periods will begin.

5 Project Schedule
From receipt of order MTSI will begin the
administrative process for project completion.
After submittal package approval and
establishment of Letter of Credit the
manufacturing process will be initiated; the
duration from production planning to
completion of quality control (ready for
shipment) typically runs 120-150 days. After an
export license is received (application being
made at time of order) packing and shipping can
be initiated; this duration is typically 1 week or
less. Ocean transit to S. Korea is typically a 4-5
week duration from MTSI dock to the ocean port
of entry. We expect port clearance, and transit
to jobsite to be 2 weeks or less and the
responsibility of the Buyer.

manuals and one (1) electronic Adobe pdf copy.
Manuals include product identification information,
safety information and warnings, theory of
operation, installation guidelines, trouble -shooting

organization and scope of the Operator and
Maintenance Manual is consistent with prevailing
industry standards. All manuals are provided in the
US English language. Translations have not been
priced and are not included.

7 Installation, Training and Support
MTSI has been providing range equipment
to military organizations and law
enforcement agencies around the world
since 1926. In that time we have learned
that the most cost effective and efficient
way to install our products is by providing
expert technical support and guidance to
local contractors. It is not cost effective for
us to have a crew of workers traveling from
our factory to customer sites around the
globe. It is also not feasible for us to
maintain intimate knowledge of the local
building requirements, and practices, in so
many locations. It is far more effective for
us to provide expertise and training on our
equipment to contractors with construction
experience and expertise specific to that
locale.

On a project such as this MTSI typically provides an experienced Field Service Technician (FST) for a
series of trips during the equipment installation duration. Prior to the technician's initial trip all
improvements to the buildings/facades that will house range equipment including installation of the
electrical and mechanical systems should be completed. On the initial trip (prior to equipment arrival)
the FST will survey the site and work with the General Contractor and Installation Supervisor to identify
and resolve construction coordination issues (conflicts), and verifies installation sequence and schedule.
The FST will work with the installers to establish site logistics, sequence of installation, and properly
locate (lay -out) the range equipment. The FST will also train the installation crew in product
identification and best practices for unpacking and staging.
During subsequent visits the FST works with the installation crew reviewing and revising the layout as
required to resolve conflicts with work in place and updating the installation schedule. The FST trains
the installation crews and foremen on product identification, assembly instructions, proper install
techniques and best practices and quality control (QC) points. When the FST departs the site, the
installers continue with that portion of the work with phone and email support as required. The FST
works with the installation crew to resolve any issues that may arise during installation, provides
technical support and/or clarifications as required, and conducts QC inspections of work in place. Any
corrective actions identified during QC, are documented and reviewed with contractor. As installation
progresses the FST conducts operational testing of all of the range equipment (particularly targetry and
controls), and makes any final adjustments to equipment. As installation of all equipment in an
individual range is completed, the FST will commission that range and prepare for acceptance testing.

1. Full Install: Pricing assumes the MTSI Field Service Technician (FST) and labor crew will be onsite
over one (1) continuous trip. All site preparation work must be done prior to the FST's arrival. If
additional trips are required due to issues beyond MTSI's control, additional charges will
assessed in the form of a change order.
2. Buyer to verify the ceiling structure within the range is capable of supporting the new range
equipment and containing any errant type secondary bullet impacts.
3. All conduit, A.C. wiring, A.C. Electrical Connections, lighting, and any duct work is specifically
excluded from this proposal and MTSI scope of work. If conflict with HVAC, Plumbing or

change order for additional Tech Time. Please remember that MTSI wants you to have a
successful installation in a safe and timely manner.
4. Owner to utilize the existing 120 volt/20 amp target system circuits and have them re-routed
downrange to the new target system location. The existing control wire conduit will also need
to be extended downrange — to the target systems location.
5. MTSI FST will provide training on installed systems after installation is complete. FST will
perform a QC walk and final acceptance with the owner/contractor.

9 Terms and Conditions
These Terms and Conditions will be part of any contract, purchase order or signed offer that Meggitt
Training Systems, Inc. enters into with you, your department or company.
Meggitt Training Systems, Inc.'s Terms and Conditions are not limited to those provided herein. MTSI
Terms and Conditions and the enclosed offer take precedence over all other project documents. Any
earlier offer along with those terms and conditions are immediately null and void. Any subsequent
purchase order will be subject to Meggitt's Standard Terms & Conditions which can be provided upon
request. Please contact MTSC nt.ra _IsMeggitt,com to request a copy.
Limitation of Liability:
Nothing in this contract shall exclude or limit the Supplier's liability for death or personal injury caused
by the Supplier's negligence or for fraudulent misrepresentation or for any liability that cannot legally be
excluded or limited.
EXCEPT AS STATED ABOVE, THE TOTAL AGGREGATE LIABILITY OF THE SUPPLIER ARISING OUT OF OR IN
CONNECTION WITH THE PERFORMANCE OF THE CONTRACT, WHETHER FOR NEGLIGENCE OR
OTHERWISE, SHALL IN NO EVENT EXCEED 20% OF THE TOTAL CONTRACT VALUE
IN NO EVENT SHALL THE SUPPLIER BE LIABLE FOR LOSS OF PROFIT, LOSS OF USE, LOSS OF BUSINESS,
LOSS OF REVENUE OR FOR ANY INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL LOSS OR DAMAGES,
OR PUNITIVE OR EXEMPLARY DAMAGES, HOWSOEVER CAUSED.
These clauses set out the entire liability of the Supplier (including any liability for the acts or omissions
of its sub -contractors) in respect of any breach of this contract or orders placed under it and any
representation, statement or tortuous act or omission including negligence arising under or in
connection with the contract. All warranties, conditions and other terms implied by statute or common
law are, to the fullest extent permitted by law, excluded from the contract."
Force Majeure:
Neither party shall be in default of its obligations under this Agreement by reason of delay or failure to
perform if such delay or failure arises out of causes beyond the reasonable control and without the fault
or negligence of the party including, but not restricted to, acts of God, acts of governments, fires, floods,
epidemics, quarantine restrictions, terrorism, war, labor unrest and unusually severe weather
("Excusable Delay").
The party experiencing the Excusable Delay shall give prompt written notice to the other party upon
such party becoming aware of any circumstance or event which may reasonably be anticipated to cause
or constitute an Excusable Delay as described herein. Such notice shall contain a description of the delay
and of the affected portion of the Work. In the event that MTSI is the party experiencing the Excusable
Delay, MTSI, in its discretion, may delay delivery, cancel delivery, make price adjustments and/or

allocate delivery among customers as necessary due to such unexpected event and during the period of
such Excusable Delay. If the Excusable Delay continues for a period of 30 days, the party not
experiencing the Excusable Delay may terminate this Agreement with no cost or liabilities accruing to
either party."
Meggitt Training Systems, Inc.'s pricing excWdes the following items unless specifically included as a line
item at the end of this paragraph.
A. Line voltage electrical, connections, line or control conduits (empty or full), electrical boxes,
receptacles, target or general lights and any other devices generally considered for high voltage.
B. All temp utilities for construction (including adequate lighting and 115v power for hand -tools)
are the responsibility of the owner/contractor.
C. Bridging, structural supports or any other material that is required as support for MTSI's baffle,
safety ceiling, or target systems. Load points to be verified by owner/contractor to support MTSI
equipment.
D. All coordination for baffle, safety ceiling, and bullet trap (and the associated hanging provisions)
is the responsibility of the owner/contractor. Meggitt Training Systems, Inc. will provide
accurate submittal drawings for this purpose.
E. Unloading and/or moving/placement of MTSI's equipment into the range area.
F. Removal / disposal of existing equipment.
G. Removal / disposal of lead or other hazardous waste.
H. Relocation of existing piping, ventilation ducts, electrical conduit, etc.
I. Any customer requested special shipping or marking/labeling requirements and any related
costs.
J. Specialty anchors or seismic type hanging devices.
K. Concrete pads, core cuts and/or masonry patching.

IMPORTANT NOTE: MTSI is responsible for collecting sales tax in the following states: CA, CT, FL, MN,
GA, IL, KY, VA, NJ, SD, and WA. If work is to be performed in any of these states under a Purchase order
issued as a result of this proposal, any applicable sales tax will be added to the final invoice. If your
organization is federal or state tax exempt, provide a copy of the tax exemption certificate. Otherwise,
please include the sales tax value on any resulting purchase order.
MTSI does not claim, assert or guarantee in any way that purchased equipment is compliant with all
federal, state, county, city or local "trade" or "building" codes. The owner is responsible for compliance
with all local jurisdictions and codes.
Any forthcoming contract between General Contractor and Meggitt Training Systems, Inc. is preferred to
be of a typical AIA subcontract format. Any deviation from a typical AIA format must be mutually agreed
upon in writing.
MTSI is a non-union manufacturer. MTSI will provide prevailing wages (Davis -Bacon) or pay for union
workers only if specifically included as a line item below:

If MTSI is not authorized to commence work on the Project within 90 days from the date of the offer and
subject to the economic conditions of metals, Meggitt Training Systems, Inc. shall be entitled to adjust
its offered prices to account for increased costs to MTSI as a result of said delay.
This (Proposal/Submittal/Document) contains proprietary information and is submitted for evaluation
purposes, and shall not be disclosed, duplicated or reproduced, in whole or in part, without prior written
consent of an authorized representative of Meggitt Training Systems, Inc.
All drawings, specifications and other design documents prepared by Meggitt Training Systems, Inc. and
its consultants in connection with the Project are the property of Meggitt Training Systems, Inc. Meggitt
Training Systems, Inc. shall retain all common law, statutory and other rights, including all copyrights,
related to said design documents. The General Contractor shall not use the design documents on other

The deciding factor for the wall covering was to determine which product, the PolySorpt
Sound Panels or the AFQA- 10 Curtain Panels would be easier and cheaper to replace if
damaged.
The sound panels are glued to the wall and if hit by a bullet the replacement would
include all panels that were damaged, removal of the glue from the wall and replace wi
new panels. Each impact by the round would damage several panels from where the
bullet hits the wall to where it exit the last panel it damages. I
The Curtain Panels are equipped with grommets that will allow them to hang about a Y4"
away from the wall. If a bullet enters one panel it should follow the wall and not damage
another panel until it exits. This means that a panel can be pulled down and replaced
with another panel in a matter of minutes.

the rubber media.
3. Containment area is off limits to all personnel except employees of Green Bay Lead, Inc.

5. Green Bay Lead, Inc. will work up to 10 hour days until project is completed.
6. The final report will include all OSHA required air monitoring results, hazardous waste
disposal manifests (if required), and the amount of lead recycled.
Green Bay Lead, Inc. is a certified WI Lead Company, and ail employees on this project
will be certified in the OSHA 29 CFR Lead Exposure in Construction Standard.
The install will require two mobilizations by Green Bay Lead, Inc. Depending on which
option for the walls is taken. The wall curtains will take up to four weeks to fabricate.
Start Date and Completion Time
Green Bay Lead, Inc. will start the project in a timely manner after receiving a signed PO and completion
time will be four to seven workdays. Start date will be mutually agreed upon.

to this project. All employees of Green Bay Lead, Inc. have been trained as Wisconsin Certified Lead

Proposal 5,(Type, ➢i Rec cle Baslc Clean Plus
This proposal is for maintenance on the bullet trap and cleaning parts of the shooting range. The scope of
work is as follows:
• Set up a decontamination unit and regulate the work area.
• During this recycle the technician will remove approximately 68 cubic feet or 2.5 cubic yards of
granular rubber and projectiles per lane concentrating in the target zones. This will constitute that
half of the rubber material has been removed from the bullet trap. The rubber material removed from
the bullet trap will be recycled by special vacuums that will separate most of the spent lead projectiles
from the rubber. The granular rubber will then be put back into the bullet trap during the recycle and
leveled to the proper slope.
• Please note: during this service, your ventilation unit must be running to keep the lead dust
contained in the range. The filters may need to be replaced before and after our services.
• Supply containers and package the spent lead projectiles for recycling.
• Recycle the spent lead projectiles.
• Visually inspect bullet trap components for wear/damage, compare with manufacturer's specifications,
and inform the owner of any visual defects.

• Replace and/or tighten any loose or missing nuts and bolts on the accessible exterior parts of the
bullet trap.
• Inspect the hoppers for the proper level of granular rubber.

rubber, the BTS supervisor will inform the owner on how many bags of rubber will be needed.
The owner is to provide and install the new rubber.
• HEPA vacuum accessible intake vents over the bullet trap.

5. BTS carries commercial general liability insurance of two million dollar limit per occurrence/two
million dollar aggregate limit and a two million dollar umbrella policy. If a higher amount is requested,
the cost increase will be billed to the client.
6. BTS and our subcontractors carry a one million dollar workman's compensation insurance policy. This
does not include subrogation. Subrogation can be added at an additional cost.
7. A final documentation package will be sent once BTS receives air sampling and final payment. (Allow
2 or 3 months).
8. Contractor has over sixteen years servicing bullet traps and shooting ranges.
This quotation is null and void, if not accepted, in writing, and received by Best Technology
Systems, Inc. within 90 days of the proposal date and services rendered by ,December 31, 2015.
Any modifications to this contract must be completed in writing and signed by both parties. Failure to
properly modify will be considered a breach of contract.
Payment is due within 30 days of the date of the invoice. Late payments will be subject to a fee of 1 '/z%
per month. The client shall be liable for attorney and other costs incurred to collect our fees.
If you choose to pay for this service with a credit card, a 3% processing fee will be added to the
final invoice.

Contractor shall have established programs and if requested, shall submit prior to the start of
work a copy of the following OSHA required, and other items:
• Respiratory Protection Program endorsed by a Certified Industrial Hygienist
• Medical Surveillance Program
• Evidence of medical examinations for all workers, including a physician's statement indicating
the employee is fit to conduct this type of work
• Certificates of worker training
• Reference list demonstrating at least 10 previous projects of similar scope and a minimum of
five years' experience in this type of work.

Background
On June 8, 2015 bids were received for repairs to the Lincoln Street Bridge. Unfortunately
those bids came in much higher than anticipated. The low bid was 90% above the Engineers
Estimate of Cost. An analysis of the submitted bids revealed that escalating unit prices are
indicative of the current construction climate with the number of ongoing construction projects in
Northeast Illinois by IDOT, the Tollway and CDOT. On July 7, 2015 the Village Board rejected
all bids. Since then new plans have been prepared with a reduced scope of work that would
complete all necessary work to limit more extensive repairs in the future if the maintenance is
delayed. The remainder of the work will be scheduled in future years.
Bid Results
A Notice to Bidders was published in a local newspaper as required. Sealed bids were received
on August 24, 2015.
Five (5) contractors submitted bids for this project. The bids ranged from a low of $30,928.00
by Path Construction Company, to a high of $97,400.80 by Martam Construction, Inc. The
engineer's estimate for the project was $70,150.00
All bidders submitted a bid bond in the amount of 10% of the total bid as required in the bid
proposal packet. All bids were checked for their accuracy. No errors were found. All bidders
correctly signed their bids and bid bonds. Below is a summary of the bids:

Discussion
The low bid is 56% below the Engineer's Estimate. Considering the significant difference
between the low bidder and the second low bidder, a discussion was held with the low bidder.

Path Construction Company verified their understanding of the project, the accuracy of their bid
prices and the ability to complete the project for their submitted bid price.
Path Construction Company meets the requirements of the contract documents. They are
currently working on the Village's Northwest Highway Streetscape Project. Their work has been
acceptable.
Staff recommends including a 10% contingency in the project award to allow for quantity
variances and unanticipated conditions. In this instance, a 10% contingency added to the
lowest cost bid would result in a total contract award of $34,201.00 (Base Bid: $30,928.00 +
Contingency: $3,093.00 = Total Recommended Award: $34,021.00).
Recommendation
I recommend the low bidder, Path Construction Company of Arlington Heights, be awarded the
contract for the Lincoln Street Bridge Rehabilitation in the amount not to exceed $34,021.00.
Please include this item on the September 1" Village Board Meeting Agenda.
