COMMUNICATIONS AND PETITIONS, CITIZENS TO BE HEARD ~" VVESTBROOK Ernest Lasse, 805 S. Elm Street, asked if the Village has taken a SCHOOL stand on the proposed lease between School District 57 and the Jack London School for students with special needs. It was noted that as of ibis meeting, staff has found no reason why the Village would oppose the proposed use of this public school property. BUSSE ROAD Tony Palazzo, 1713 Verde Court, stated that he understands the WIDENING Village Board will be considering the widening of Busse Road between Lonnquist Blvd. and Central Road and asked that notices be sent to residents within 250 feet of Busse Road informing them of any public hearings on this subject. OLD BUSINESS ZBA 2-A~96 ZBA 2-A-96,* Text Amendment TEXT AMENDMENT The Village administration proposed amending the driveway width regulations to permit driveways serving three-car garages to exceed the maximum allowable driveway width within 15 feet of a garage. The Zoning Board of Appeals recommended granting this text amendment by a vote of 5-0. Trustee CIowes, seconded by Trustee Hoefert, moved to concur with the recommendation of the Zoning Board of Appeals to grant the text amendment being the subject of ZBA 2-A-96. Page 2 - February 20, 1996 An Ordinance was presented for first reading and will be presented at the next regular meeting on March 5th for second reading. ~ NEW BUSINESS ~ An Ordinance was presented for first reading that would amend AMEND CH. 22 ~ Article V entitled "Meters and Rates" of Chapter 22 of the WATER/SEWER Village Code by increasing the water and sewer rates for those RATE INCREASE receiving Village services. The rate for both water and sewer would increase from $3.07 to $3.20 per 1,000 gallons. This Ordinance will be presented March 5th for second reading. An Ordinance was presented for first reading that would amend AMEND CH. 19 Article II entitled "Garbage and Refuse" of Chapter 19 of the Village LIEN: GARBAGE Code to provide for a lien to be placed against property if garbage fees are unpaid for service to that property. Trustee Hoefert, seconded by Trustee Clowes, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes~ H'oefe, rt, Skowron, Wilks Nays: Hendricks Motion carded. Trustee Hoefert, seconded by Trustee Skowron, moved for passage ORD. NO. 4776 of Ordinance No. 4776 AN ORDINANCE AMENDING ARTICLE II ENTITLED "GARBAGE AND REFUSE" OF CHAPTER 19 OF THE VILLAGE CODE Upon roll call: Ayes: Clowes,'Hendricks, .Hoefert, Skowron, Wilks Nays: None Motion carded. 1996 An Ordinance was presented for first reading that would authorize GENERAL the ssuanca of General Obligation Bonds in the amount of OBLIGATION $3,150,000. BONDS It was noted that these monies would be used for flood control projects, downtown development, to replace Opticom equipment, Melas Park improvements and Geo-Base System software. The' bids for these bonds will be opened and presented to the Village Board for acceptance on March 5th at which time this Ordinance will be presented for 2nd reading. Page 3 - February 20,1996 AMEND CH. 8: An Ordinance was presented for first reading that woUld amend REAL ESTATE Article VIII "Real Estate Transfer Tax" to extend the period from one TRANSFER TAX to two years in which a resident can sell and then buy a home in the Village and be eligible for a rebate from the real estate transfer tax. The two year period conforms with the IRS regulations. Trustee Hoefert,. seconded by Trustee Clowes, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: . ORD.NO. 4777 Trustee Hoefert, seconded by Trustee Cl0wes, moved for passage of Ordinance No. 4777 AN ORDINANCE AMENDING ARTICEE VIII · ENTITLED "REAL ESTATE TRANSFER TAX" OF CHAPTER 8 OF THE VILLAGE CODE Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. AMEND CH. 23 An Ordinance was presented for first reading that would amend LANDLORD/TENANT Article XVIII entitled "Residential Landlord and Tenant Regulations" LICENSE FEE of Chapter 23 of the Village Code, which amendment increases the licensing fee for a rental ur~it from $7.00 per year per unit to $14.00 per unit per year. The Ordinance also provides the license period from June 1 through May 31 of each year. This Ordinance will be presented for second reading on March 5th. ACCEPT A request was presented to accept the public improvements installed PUBLIC in conjunction with the construction of the Toko America facility IMPROVEMENTS: located at 1250 Feehanville Drive. TOKO AMERICA Trustee Hoefert, seconded by Trustee Clowes, moved to concur with the recommendation of the administration and accept the pubic improvements installed in conjunction with the construction of the Toko America facility. MFT FUNDS: 1996 A Resolution was presented that would appropriate $850,000 from RESURFAClNG Motor Fuel Tax Funds for the 1996 Resurfacing Program. PROGRAM Trustee Hoefert, seconded by Trustee Skowron, moved for passage RES.NO. 6-96 Page 4 - February 20,1996 of Resolution No. 6-96. A RESOLUTION APPROPRIATING MOTOR FUEL TAX FUNDS ,....., Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. A Resolution was presented that would appropriate Motor Fuel Tax MFT FUNDS: Funds in the amount of $150 000 for the 1996 Reconstruction 1996 Program. RECONSTRUCTION PROGRAM Trustee Hoefert, seconded by Trustee Clowes, moved for passage of Resolution No. 7-96 RES.NO. 7-96 A RESOLUTION APPROPRIATE MOTOR FUEL TAX FUNDS Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. INCREASE A proposal was presented to increase the cost of a refuse/yard REFUSE/YARD [ waste sticker from $1.25 to $1.40 each. WASTE STICKER FEE There was discussion relative to the overall cost of refuse disposal and whether the Village Board should review the policy of 2 garbage cans at the curb to paid out of the real estate taxes with additional cans and/or items requiring a sticker. Members of the Board asked for additional information on this subject. Trustee Hoefert, seconded by Trustee Clowes, moved to defer this item to the March 5th meeting of the Village Board. VILLAGE MANAGER'S REPORT In the absence of Village Manager Janonis, Assistant Village Manager David Strahl presented the Manager's Report. Mr..Strahl presented bids for parkway/shade tree purchase and BID: installation; a complete tabulation of the results is attached to these PARKWAY minutes. TREES Trustee Wilks, seconded by Trustee Clowes, moved to concur with the B-C LANDSCAPE recommendation of the administration and accept the Iow qualified bid & GRO- HORTICULTURAL Page 5 - Februa~ 20, 1996 submitted by B-C Landscape and Gro Horticultural Enterprises for 2- 1/2" trees and Tommy Pollina Co. and Gro Horticultural Enterprises for 3" trees for a total cost not to exceed $120,025.00. Upon roll call: Ayes: Clowes, Henddcks, Hoefert, Skowron, Wilks Nays: .None Motion carried. OPTICOM A request was 'presented to waive the bidding procedure and EQUIPMENT authorize the purchase of Opticom (traffic preemption equipment) REPLACEMENT equipment as the first part of a 2 part placement program. It was noted that this is specialized equipment with Tomar Optical being the manufacturer and Brown Electric of Northbrook as the distributor of this equipment. The maintenance of this equipment will be provided by either Lyons-Pinne.r Electric or Contracting and Material Company. There is $t00,000 budgeted for this first phase. TOMAR/BROWN Trustee Hoefert, seconded by Trustee Clowes, moved to concur with the recommendation of the administration to waive the bidding procedure and authorize the purchase of specialized Opticom equipment manufactured by Tomar Optical (traffic preemption equipment) and distributed by Brown Electric with maintenance to be provided by either Lyons-Pinner Electric or Contracting and Material Company. at a cost not to exceed $100,000 as phase one of this 2 phase project to replace all the Opticom equipment throughout the Village. LITTERING Assistant Village Manager Strahl gave an update to the Village Board relative to the distribution of Chlcagoland Express, an advertising paper, which is being distributed throughout the Village by throwing it in front yards or on driveways. Many residents have complained and expressed their desires not to receive this publication. Mr. Strahl' stated that anyone who does not want to receive this publication shoUld call the Chicago Tribune and/or the distributor and their addresses would be removed from the delivery schedule. ANY OTHER BUSINESS ~-, TAP: PEER JURY Trustee Clowes stated that TAP is considering participating in a Peer Jury system, which has been a beneficial tool in other communities. Additional information will be distributed relative to this system. TORT Trustee Clowes also asked that representatives of the Village look into the Tort Reform Bill recently considered as it pertains to anyone performing community service. Trustee Clowes forwarded an article to the Finance Director relative to billing for all ambulance calls. MULTI-FAMILY Trustee Clowes stated that information is available from the Chicago UNITS: Crime Commission relative to alert pertaining to abandoned multi- ABANDON Page 6 - February 20,1996 amily dwelling units and the signs warning of the possibility of such action. Trustee Wilks noted that the Police Department.is enforcing the RAILROAD new law relative to crossing railroad tracks when the' gates CROSSING are down, stating that her interpretation of the law was that it wasSAFETY geared toward areas with 2 sets of railroad tracks, however Mount Prospect has 3 tracks. It was also noted that the 50 hours of community service being assessed as a fine' amounts to quite a long period of time. ADJOURN President Pro Tem Corcoran adjourned the meeting at 9:35 P.M.
