SUBJECT: CENTRAL ROAD & WELLER LANE PEDESTRIAN CROSSING IMPROVEMENTS
IDOT INTERGOVERNMENTAL AGREEMENT
Background
In 2014, the Engineering Division with the support of the Village Board of Trustees submitted a grant application
to improve the pedestrian crossing at Central Road & Weller Lane. The Safe Routes to School Program (SRTS) is
a federally -funded program that looks to promote and improve walking/biking to and from school. For Illinois, it
is administered by the Illinois Department of Transportation (IDOT). The Village was notified late last year that
we were successful in receiving $92,400.00 from this highly competitive program.
The Central Road & Weller Lane intersection currently has a painted crosswalk across Central Road connecting
the neighborhood to Melas Park. Lincoln Middle School, Westbrook Elementary School, and 5t. Raymond School
are all located in the neighborhood. The crosswalk is used by students as well as visitors of Melas Park. The 75'
long crosswalk is protected only with signs. It has been identified In both the Village Bicycle Plan and School
District 57 Travel Plan as a crossing in need of a safety enhancement project.
Construction drawings have been completed and IDOT is preparing to bid the project at the end of July. Work
will include a raised concrete pedestrian refuge island, a Rectangular Rapid Flashing Beacon system (similar to
the one at Busse Road & Lonnquist Boulevard), new signage, and enhanced pavement markings. Construction is
expected to begin in early fall and be completed by the end of the year.
Intergovernmental Agreement
As part of the process, IDOT requires the Village to enter into an Intergovernmental Agreement attesting that
sufficient local funds have been allocated for the Village's share of the project. The estimated construction cost
of the project is $137,600.00. With the grant covering $92,400.00, the Village's share is estimated at
$45,200.00. Once bids are opened and a contractor selected, IDOT will require the Village to concur with an
award of the contract. Staff will present the bid amount of the chosen contractor and the Village's actual share
of the project. The Village Board of Trustees will be asked to approve or deny a contract award prior to
construction. If approved, IDOT will administer the project and pay the contractor directly. IDOT will then
invoice the Village requesting reimbursement of our share. Sufficient funds based on the cost estimate are
available in the 201S Village Budget.

Recommendation
It is Staff's recommendation that a Resolution be passed authorizing the Mayor to sign the IGA and attesting
that sufficient funds have been allocated based on the cost estimate for the Village's share of the Central Road
& Weller Lane Pedestrian Crossing Improvements.
Please include this item on the July 7th Village Board Meeting Agenda.

RESOLUTION NO.
A RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND
THE ILLINOIS DEPARTMENT OF TRANSPORTATION (IDOT) FOR
PEDESTRIAN CROSSING IMPROVEMENTS AT THE INTERSECTION OF
CENTRAL ROAD AND WELLER LANE, MOUNT PROSPECT, ILLINOIS
Constitution of 1970; and
WHEREAS, the provisions of the Intergovernmental Cooperation Act, (5 ILCS 220/1 et seq.,) authorizes and encourages
intergovernmental cooperation; and
WHEREAS, the Village of Mount Prospect and the Illinois Department of Transportation (IDOT) are units of government
within the meaning of the Constitution of the State of Illinois, 1970 Article VII, Section 10, having the power and authority
to enter into an intergovernmental agreement; and
WHEREAS, in order to ensure the safety of pedestrians and the motoring public, IDOT and the Village wish to make
pedestrian crossing safety improvements at Central Road and Weller Lane; and
WHEREAS, in 2014 the Village of Mount Prospect was awarded $92,400 in federal funds through the Safe Routes to
School Program (SRTS) to promote and improve walking/biking to and from school; and
WHEREAS, the estimated total construction cost for the pedestrian crossing improvements at Central Road and Weller
Lane is $137,600; $92,400 of this cost will be covered by the SRTS grant and the remaining estimated balance of $45,200
will be paid by the Village of Mount Prospect; and
WHEREAS, the improvements shall include a raised concrete pedestrian refuge island, a Rectangular Rapid Flashing
Beacon (RRFB) System, new signage and enhanced pavement markings; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have deemed that the best interests of the
Village will be served by entering into the Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE POWERS:
SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby authorize and direct the Mayorto
execute the Intergovernmental Agreement between the Village of Mount Prospect and the Illinois Department of
Transportation (IDOT) for pedestrian crossing safety improvements at Central Road and Weller Lane attached hereto and
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the
manner provided by law.

Over the years, as the Randhurst site and outlots were developed and redeveloped, a
patchwork network of watermains and sanitary sewers was installed to serve the various
buildings. Some of these watermains and sanitary sewers were publicly owned and maintained
while others were not. Easements granting the Village access and maintenance rights were
established over those publicly owned watermains and sanitary sewers.
The recent Randhurst Village redevelopment included the installation of new watermain and
sanitary sewers to serve much of the property. This provided the opportunity to reevaluate the
ownership and maintenance responsibilities for the watermains and sanitary sewers for the
entire site. All watermain and sanitary sewers identified as only serving the Randhurst Village
site have been confirmed as being owned and maintained by Randhurst Village.
The attached Plat of Abrogation identifies all easements on the Randhurst Village site granted to
the Village over the years, and abrogates those that are no longer necessary. Staff has
reviewed and recommends approval of the Plat of Abrogation.

A RESOLUTION ABROGATING A PORTION OF
CERTAIN WATERMAIN AND SANITARY SEWER EASEMENTS
LOCATED AT RANDHURST VILLAGE, 999 NORTH ELMHURST ROAD,
MOUNT PROSPECT, ILLINOIS
WHEREAS, the Corporate Authorities of the Village of Mount Prospect, after due consideration,
have determined that the best interests of the Village of Mount Prospect would be served by
abrogating certain watermain and sanitary sewer easements as shown in
WHEREAS, the Corporate Authorities of the Village of Mount Prospect have determined that there
is no evidence of significant use of this area for watermain or sanitary sewer easements; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the watermain and sanitary sewer easements as shown is
hereby abrogated and it is hereby declared that the same is no longer required for public use and
that the public interest will be served by such abrogation.
SECTION TWO: That the abrogation is hereby granted for watermain and sanitary sewer
easements and the Plat of Easement Abrogation
appropriate execution and recording. Such Plat is incorporated into and made part of this
resolution.
SECTION THREE: That this Resolution shall be in full force and effect from and after its passage
and approval in the manner provided by law.

The Petitioner has requested an extension of the zoning approvals granted by the Village in 2014 for a
Conditional Use Permit and Variations to construct two additional retail buildings at the Mount Prospect
Plaza. The Petitioner has yet to construct the buildings as they have been working through obtaining
needed tenant consents from existing tenants. Therefore, the Petitioner is seeking approval to renew the
requests for an additional year.
Attached is a letter from the Petitioner requesting the extension of the Conditional Use and Variation
approvals. As the letter indicates, the Petitioner did not obtain a building permit within the time frame
of the zoning approvals but believes that they will be able to proceed with the project within the next
year.
Please forward this memorandum and attached letter to the Village Board for their review and
consideration at their July 7th meeting. The Village Board would need to approve a motion to extend
the Conditional Uses and Variation granted pursuant to Ordinance #6148. Staff will be present at this
meeting to answer any questions related to this matter.

Please be advised that I represent Mt. Prospect Plaza, LLC, the owner of Mt. Prospect Plaza
Shopping Center. Last July, the Village approved conditional uses for a final PUD development and
drive through as well as a lot coverage variation. One of the conditions of approval was that the owner
apply for and obtain a building permit within one year of adoption of the ordinance. Under a number of
tenant leases at the shopping center, tenant consents are required before any changes can be made to the
center. The owner has been in negotiation with those tenants to obtain such consents so that it could
apply for the building permit and proceed with construction. The tenants which need to consent include
LA Fitness, Marshalls, Ross, Petco, and Aldi. A number of these tenants have given verbal assurances
that they are agreeable to consenting to the proposed changes, but negotiations continue with a number of
the other tenants and have not yet resulted in agreements.
We are hereby requesting that the Board of Trustees of the Village extend the deadline in which
to obtain a building permit with respect to the requested conditional uses and variation for an additional
one year in order to allow the owner to obtain the required tenant consents and proceed with
redevelopment as planned.
Kindly advise as to when this matter will be placed on the agenda of the Board of Trustees so that
we may have a representative present to answer any questions which the Board may have. Thank you.

WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect, Illinois did adopt

The attached ordinance is a result of the Committee of the Whole meeting on March 24
regarding the establishment of eligible agencies and potential fees and permits that
could potentially be waived upon request and if the Village were to capture a reasonable
level of out of pocket costs/fees. Staff recommended and the Village Board concurred at
the COW meeting that fees related to nuisance and performance guarantees could be
eligible for waiver since the Village requires these fees to guarantee performance, but in
the case of non-profit and governmental agencies the Village knows where to find the
agency in case of performance issues.
The attached ordinance reflects the staff recommendations of the following:
1. Consider a fee/permit waiver upon written request for non-profit eligible agencies (501
(3) (c)), religious institutions, and other governmental agencies, but limit the waiver
options so that the Village staff and out of pocket expenses are not singly incurred by the
Village.
2. Public Works related fees that could be eligible for waiver are limited to fees related to
maintenance and performance guarantees.
3. Fire inspection and review fees that could be eligible for waiver are limited to fees
related to retrofitting an existing structure.
4. Building related inspection and review fees that could be eligible for waiver are limited to
fees and expenses that are not out of pocket expenses incurred by the Village. An
eligible waiver for building permit fees would be capped at $250 per entity; therefore, if
the building permit fee process cost to be charged was more than $250 the entity would
not be required to incur more than $250 in expense.
Staff recommends approval of the attached ordinance outlining the permit and fee
waiver procedure regarding non-profit and governmental agencies.

WHEREAS,
the Village historically has not required non-profit organizations,
charitable organizations, and local governmental bodies to pay various permit fees
required by the Village; and
WHEREAS,
the reasons for waiving permit fees include that the projects for
which these fees apply are funded by agencies that either are community-based or
supported by Village taxpayers; and
WHEREAS,
the Village desires to implement a policy related to the waiver of
permit fees for non-profit organizations, charitable organizations and local governmental
bodies that allows it to recognize the status of these entities and their contributions to
community while recovering certain costs for staff time and out of pocket expenses;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1:
Section 4.103 entitled “Powers and Duties” of Article I entitled
“Village Manager” to Chapter 4 entitled “Appointive Village Officers” of the Mount
Prospect Village Code shall be amended by adding a new Paragraph H which shall be
and read as follows:
H. Consider and either grant or deny written requests from non-profit
organizations, charitable organizations and local governmental bodies for permit fee
waivers or reductions consistent with Section 15.811 for projects in the Village.
Paragraphs H and I of Section 4.103 shall be re-identified as Paragraphs I and J
with the addition of the new Paragraph H.

SECTION 2:
Section 15.202 entitled “Definitions” of Article II entitled “Rules and
Definitions” to Chapter 15 entitled “Subdivision, Development and Site Improvement
Procedures” of the Mount Prospect Code shall be amended by adding the following
definitions:
NON-PROFIT ORGANIZATION: An organization subject to and organized under
the Illinois General Not For Profit Corporation Act of 1986 for any one or more of the
following or similar purposes: charitable, benevolent, educational, civic, patriotic,
religious, social, athletic, or scientific.
CHARITABLE ORGANIZATION: Any not-for profit corporation, association or
foundation organized and operated exclusively for charitable purposes that qualifies for
tax exemption status under Section 501(c) (3) of the Internal Revenue Code.
LOCAL GOVERNMENTAL BODY: Any of the following governmental bodies:
county, township, municipality, municipal corporation, school district, forest preserve
district, park district, fire protection district, sanitary district, library systems and all other
local governmental bodies.
SECTION 3:
Article VIII entitled “Fees, Guarantees, and Agreements” to Chapter
15 entitled “Subdivision, Development and Site Improvement Procedures” shall be
amended by adding a new Section 15.811 entitled “Fees for Non-Profit Organizations,
Charitable Organizations and Local Governmental Bodies” which shall be and read as
follows:
Permit fees to non-profit organizations, charitable organizations or local
governmental entities for actions taken pursuant to the requirements of
this chapter shall be assessed in an amount that allows the Village to
recover the costs of staff time and out of pocket expenses related to
payments to service providers necessary for project review, inspections
and completion. The assessed permit fees shall not exceed $250.

Permit fees in amounts that exceed the costs the Village seeks to recover
may be waived and/or reduced for non-profit organizations, charitable
organizations and local governmental bodies upon written application to
the Village Manager.
