AN ORDINANCE AMENDING ORDINANCE NO. 5692, AS AMENDED
BY ORDINANCE NO. 6077, GRANTING CONDITIONAL USE PERMIT AND
VARIATIONS FOR PROPERTY LOCATED AT 309-317 WEST PROSPECT AVENUE,
TO APPROVE AN EXTENSION OF THE EFFECTIVE DATE OF THE
CONDITIONAL USE PERMIT AND VARIATIONS
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect, Illinois did adopt Ordinance
No. 5692, entitled "An Ordinance Granting a Conditional Use permit and Variations for Property Located at
309-317 Prospect Avenue" at their regular meeting on May 20, 2008; and
WHEREAS, Paul Swanson Associates ("Petitioner"), is requesting a second extension of the zoning
approvals granted by Ordinance No. 5692, as amended by Ordinance No. 6077 by the Mayor and Village
Board at their regular meeting on June 4, 2013; and
WHEREAS, the Petitioner plans to complete the project and is seeking to renew the zoning approvals to
construct the three (3) unit rowhome development, as approved in Ordinance No. 5692; and
WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the Village to grant the
Petitioner's request to extend the effective date for Conditional Use permit and Variations.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME
RULE POWERS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the Mayor
and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: Ordinance No. 5692, as amended by Ordinance No. 6077 is hereby amended to extend
the effective date of the Conditional Use permit and Variations to June 4, 2016.
SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.
