New Business 05/19/2015Village of Mount Prospect`zp"'''` Community Development Department MEMORANDUM TO: DAVID STRAHL, ACTING VILLAGE MANAGER FROM: DIRECTOR OF COMMUNITY DEVELOPMENT DATE: MAY 11, 2015 SUBJECT: EXTENSION FOR CASE #PZ -38-07 —CONDITIONAL USE & VARIATIONS 309-317 W. PROSPECT AVE. — PAUL SWANSON ASSOC. INC. (APPLICANT) The Petitioner has requested a fourth extension of the zoning approvals granted by the Village in 2008 for a Conditional Use Permit and Variations to construct a three -unit rowhome development. The Village most recently extended the approvals on June 4, 2013. However, the Petitioner has yet to construct the development due to the current economic downturn. Therefore, the Petitioner is seeking approval to renew the requests for an additional year. Attached is a letter from the Petitioner requesting the extension of the Conditional Use and Variation approvals. As the letter indicates, the Petitioner did not obtain a building permit within the time frame of the zoning approvals but believes that the residential market has regained enough momentum that he will begin construction later this year. Please forward this memorandum and attached letter to the Village Board for their review and consideration at their May 19th meeting. The Village Board would need to approve a motion to extend the Conditional Use and Variations granted pursuant to Ordinance #5692. Staff will be present at this meeting to answer any questions related to this matter. & - William J. :gone Y PAUL SWANSON ASSOCIATES Real Estate Development and Investments 401 E. The renewal would be for an additional 12 years and would enable Lechner and Sons to maintain their operations in Mount Prospect. The Village has granted several Cook County Class 6b tax incentives to attract and retain businesses. The 6b incentive reduces the assessment level for qualified manufacturing and warehouse/distribution facilities from 25% to 10% for the first 10 years, 15% for year 11 and 20% in year 12. After year 12, the assessment level returns to the full 25% for the benefitting property. The 6b incentive can also be renewed for additional 12 year terms if supported by the Village. Lechner and Sons currently employs 88 individuals at their facility. They are requesting the Class 6b abatement to maintain their taxes at around $1.30 per square foot for their property. If the extension is not granted they estimate that their tax bill would rise to $3.20 per square foot. Similar properties in nearby Lake and DuPage County range from $1 to $1.50 per square foot. Please forward this memorandum to the Village Board for their review and consideration at their meeting on May 19th. Staff will be present at that meeting to further discuss this matter. William J. coney RICHARD J. PHELAN MICHAEL J. PHELAN MARY ANNE PHELAN LAW OFFICES KEARNEY & PHELAN, LTD. Unfortunately, changes in the industry, the economy, and other factors beyond their control, including the significant vacancy of properties similarly situated within the same subdivision, have made this issue imperative to the continued viability of this facility from an ongoing cost standpoint. As you know Lechner & Sons has been a good corporate citizen of the Village for more than a decade; the Company employs about 88 full-time workers at any given time, as well as several part-time workers as needed. Employee compensation is consistent with County living wage requirements; these are not fast-food jobs. I would be pleased to meet with you at your convenience to discuss this matter. In the meantime, please schedule such a resolution for a hearing on such a timetable as is convenient for the Village. Thank you for your consideration. MJP:kr cc: Brian Lechner RESOLUTION NO.
