AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED
AT 1020 EAST CENTRAL ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, Grund & Riesterer Architects (Petitioner), has filed a petition for 1)Variation to allow a five foot
(5) rear yard building setback along the west lot line; 2) Variation to allow ten foot (10') exterior side yard
building setbacks along the north and south lot lines; 3) Variation to allow two foot (2') parking lot setback
along the north and east lot lines and 4) Variation to allow an overall lot coverage of 10,485 square foot
(75.9%) for property located at 1020 East Central Road, and legally described as:
That part of the South 1653.37 feet of the East% of the Southwest 1/4(measured on the East line of
said tract) and the Southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third
Principal Meridian,described as follows:commencing at the Southeast corner of the Southwest 1/4 of
said Section 35,thence West along the South line of the said Southwest'/4 for a distance of 1108.91
feet,thence North along a line which makes and angle of 900 0 minutes with the last described line for
a distance of 33.0 feet to an intersection with the North line of Central Road,for a point of beginning,
thence West along the North line of Central Road for a distance of 150.0 feet,thence North along a line
which makes an angle of 900 0 minutes with the last described line for a distance of 158.47 feet to an
intersection with the Southerly right of way line of Rand Road(route number 12)thence Southeasterly
along the said Southerly right of way line of Rand Road,for a distance of 176.29 feet to a point on the
West line of Mount Prospect Road, extended North,thence South 62.11 feet along said West line,to
the point of beginning, all in Cook County, Illinois(excepting therefrom the South 17 feet of the land
as condemned in case number 7BL-15470), in Cook County, Illinois
Commonly Known as: 1020 East Rand Road, Mount Prospect, Illinois
Property Index Number 03-35-301-020-0000; and
WHEREAS, the "Petitioner" seeks 1) Variation to allow a five foot(6) rear yard building setback along the
west lot line; 2)Variation to allow ten foot(10')exterior side yard building setbacks along the north and south
lot lines; 3)Variation to allow two foot(2')parking lot setback along the north and east lot lines and 4)Variation
to allow an overall lot coverage of 10,485 square foot(75.9°/x), as shown on the Petitioner's Site Plan dated
November 3, 2014; and
WHEREAS, a Public Hearing was held on the request for Variations being the subject of PZ-31-14 before the
Planning and Zoning Commission of the Village of Mount Prospect on the 13 day of November, 2014,
pursuant to proper legal notice having been published in the Daily Herald on the 8 1 day of October 2014; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the
Mayor and Board of Trustees in support of the request being the subject of PZ-31-14; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given consideration to the
request herein and have determined that the request meets the standards of the Village and that the granting
of 1)Variation to allow a five foot(5) rear yard building setback along the west lot line; 2)Variation to allow
ten foot(10')exterior side yard building setbacks along the north and south lot lines; 3)Variation to allow two
foot(2')parking lot setback along the north and east lot lines and 4)Variation to allow an overall lot coverage
of 10,485 square foot(75.9%)would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE
POWERS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the Mayor and
Board of Trustees of the Village of Mount Prospect.

SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect do hereby grant 1)
Variation to allow a five foot(5)rear yard building setback along the west lot line;2)Variation to allow ten foot
(10')exterior side yard building setbacks along the north and south lot lines; 3)Variation to allow two foot(2')
parking lot setback along the north and east lot lines and 4)Variation to allow an overall lot coverage of 10,485
square foot(75.9%), as shown on the Petitioner's Site Plan dated November 3,2014 and attached as Exhibit
"A.,
SECTION THREE: Approval of the Variation to allow an overall lot coverage of 10,485 square foot(75.9%)is
subject to complying with the following conditions:
1. Development of the site in general conformance with the site plan prepared by Grund & Riesterer
Architects, Inc. dated November 3, 2014.
2. Development of the building in general conformance with the elevation plans prepared by Grund &
Riesterer Architects, Inc. dated November 4, 2014.
3. Providing a solid private metal gate for the trash enclosure.
4. Development of the site in general conformance with the landscape plan prepared by James Dowden
&Associates dated October 30, 2014, but revised to comply with Chapter 14, "Zoning",Article XXIII,
of the Village Code.
5. Obtaining permits from the Illinois Department of Transportation (IDOT) for work within the Rand
Road and Central Road rights-of-way.
6. Compliance with all applicable Village Code requirements, including, but not limited to, building, fire
prevention, signage and lighting.
7. A building permit, in accordance with the current regulations and requirements of the Village of Mount
Prospect, must be issued within one(1)year from the dated of adoption of the enabling ordinance by
the Village Board which authorized the development proposal. The development approvals granted
herein,without need for further action by any Village board, commission or official,shall become null
and void if no building permit is issued within the one (1) year requirement and improvements
completed within a period of eighteen months.
SECTION FOUR: The Village Clerk is hereby authorized and directed to record a certified copy of this
Ordinance with the Recorder of Deeds of Cook County.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and
publication in pamphlet form in the manner provided by law.
