COVERAGE
The Petitioner proposes to demolish the gas station and construct a one-story retail building with
related improvements. The proposed building would be placed on the west end of the property along
Mt. Prospect Road. A parking lot consisting of sixteen (16) parking spaces would be located to the
east. The proposed development would reduce the number of access drives serving the site from four
(two on Rand Road and two on Central Road) to two (one on Rand Road and one on Central Road).
The proposed development requires Variations to the setbacks and lot coverage regulations.
The Planning & Zoning Commission conducted a public hearing to review the requests on Thursday,
November 13, 2014, and by a vote of 5-0, recommended approval of the following motions:
A. A Variation to allow a five foot (5) rear yard building setback along the west lot line.
B. A Variation to allow ten foot (10') exterior side yard building setbacks along the north and south
lot lines.
C. A Variation to allow a two foot (2') parking lot setback along the north and east lot lines.
D. A Variation to allow an overall lot coverage of 10,485 square foot (75.9%), subject to the
conditions listed in the staff report.
Details of the proceedings and items discussed during the Planning and Zoning Commission hearing
are included in the attached minutes. Please forward this memorandum and attachments to the Village
Board for their review and consideration at their December 2, 2014 meeting. Staff will be present to
answer any questions related to this matter.

Dear Mr. Cooney:
The Village of out Prospect Planning & Zoning Commission recommended approval of our
Variations to allow a five (5) foot rear yard building setback along the west lot line, a ten (10) foot
exterior side yard building setback along the no & south lot lines, a two (2) foot parking lot
setback along the no & east lot lines, an overall lot coverage of 10,485 square foot (75.9%)
and subject to conditions of approval listed in the staff report by a 5-0 vote. Our request is
scheduled to go before the Village Board for the ordinance's first reading on Tuesday December
2, 2014.
We are requesting that the Village Board waive the second reading, tentatively scheduled for
Tuesday December 16, 2014 and take final action at the Tuesday December 2, 2014 meeting.
We are anxious to start the project as soon as possible. This will enable the seller & the buyer to
close on the property and for us to start the permit documents.

A public hearing has been scheduled for the November 13, 2014 Planning & Zoning Commission meeting to
review the application by Grund & Riesterer Architects, Inc. (the "Petitioner") regarding the property located at
1020 E. Central Road (the "Subject Property"). The Petitioner is seeking Variations to the building and parking
lot setbacks and overall lot coverage. The P&Z hearing was properly noticed in the October 8, 2014 edition of the
Daily Herald Newspaper. In addition, the Petitioner has completed the required written notice to property owners
within 250 -feet and Staff posted a Public Hearing sign on the Subject Property.
PROPERTY DESCRIPTION
The Subject Property is located at the intersection of Rand, Central and Mount Prospect Roads. The existing
improvements include a one-story gas station, gas pumps and a canopy over the pumps. The Plat of Survey
indicates the Subject Property is triangular in shape and includes four access drives; two on Rand Road and two
on Central Road. The Subject Property is zoned B3 Community Shopping and is bordered to the west, north, and
east by the B3 Community Shopping District and by the RA Single Family Residence District to the south.
SUMMARY OF PROPOSAL
The Petitioner proposes to demolish the gas station and construct a one-story commercial building with related
improvements. The project requires Variations to the building and parking lot setbacks and overall lot coverage.
The various elements of the proposal are outlined below.
Site Plan — The site plan indicates the building would be placed along Mt. Prospect Road. The building would be
setback approximately 102' from the east lot line, which is the front lot line. The building would be setback ten
feet (10') from the exterior side lot lines (Rand and Central Roads) and five feet (5') from the rear yard lot line
(Mt. Prospect Road) when the Village Code requires thirty foot (30') exterior side yard setbacks and a twenty foot
(20') rear yard setback. The Petitioner is seeking Variation approval to allow the building's exterior side yard and
rear yard setbacks.
The parking lot setbacks would be ten feet (10') along the south lot line, and two feet (2') along the north and east
lot lines. The Village Code requires a minimum ten foot (10') parking lot setback. Therefore, the Petitioner is
seeking Variation approval to allow two foot (2') parking lot setbacks along the north and east lot lines. The
number of access drives would be reduced from four (two on Rand Road and two on Central Road) down to two
(one on Rand Road and one on Central Road).

Lot Coverage- The Village Code allows a maximum of seventy-five percent (75%) overall lot coverage. The
existing overall lot coverage is nonconforming as it measures approximately eighty-seven percent (87%). The
proposed development would reduce the overall lot coverage to seventy-five and nine tenths percent (75.9%),
which requires Variation approval.
The following table compares the existing and proposed improvement to the B3 requirements. The italicized
items require Variation approval:
Parking — The Petitioner has indicated the proposed development would be retail. The Village Code requires four
(4) spaces per 1,000 square feet of gross floor area for a retail use. The proposed 3,753 square foot building would
require fifteen (15) parking spaces. The Petitioner's plans indicate sixteen (16) parking spaces would be
provided.
Land uses with higher parking requirements, such as a restaurant, will not be permitted in the future due to the
parking provided without additional relief from the zoning code. Land uses will be restricted to those that require
no more than sixteen (16) parking spaces.
Trash Enclosure - A trash enclosure will be located at the northeast corner of the building. The elevation plans
indicate the enclosure will be constructed out of brick to match the building and indicates the gates would be
metal with wire mesh backing. The proposed gates are not considered to be private. The gates will be required to
be revised to be constructed of a solid metal material that is of a color compatible with the building. A detail
plan indicating the gate materials and color will be required at time of building permit application submittal.
Mechanical and Utility Equipment- The plans do not indicate any rooftop or ground mounted mechanical/utility
equipment. Screening of any ground mounted mechanical and utility equipment will be required.
Building Elevations - The elevation plans indicate the building materials will consist of brick, engineered stucco
system, precast stone, and metal clad storefront window systems with clear glass. Awnings would be provided
above each storefront window system.
Landscaping — The proposed landscape plan would not comply with all of the Village Code's landscape
requirements. The landscape plan will be required to be revised to provide building foundation landscaping along
the west and south elevations, and provide additional parking lot landscaping. A revised landscape plan will be
required at time of building permit application.
The Zoning Ordinance requires the installation of an automatic underground sprinkling system. An irrigation
plan was not submitted and will be required for the proposed development.

Lighting Plan — The photometric plan indicates the proposed lighting for the development. The proposed
illumination levels and light fixtures would comply with Village Code.
Signage - The plans wall signs and freestanding signs would be installed. The proposed signs will be subject to
compliance with the Village Sign Code's regulations.
ADDITIONAL STAFF COMMENTS
Building- All bathroom ratios will be required to comply with the Illinois State Plumbing Code. The trash
enclosure will be required to comply with the 2012 IBC fire ratings and protection requirements.
Fire- A fire sprinkler system, fire alarm system, and egress plan will be required. The driveways accessing the
site will be required to have curbs that allow for fire department access from all directions.
Engineering — The project will be required to comply with remediation requirements of the underground storage
tanks and contaminated soils. A permit from the Metropolitan Water Reclamation District Greater Chicago
(MWRD) will be required for the new sanitary service and any improvement or changes to the sanitary service.
The proposed development would be subject to a fee -in -lieu of providing storm water detention. Further, the site
plan will require revisions to comply with the required driveway radii returns, driveway widths, and accessible
ramps. Fifteen foot (15') radii driveway returns will be required at each location and a minimum of twenty four
feet (24') width will be required for each driveway. Handicap accessible ramps will be required to be installed at
each side of each driveway. Sidewalks through the driveways in the public rights of way will be required.
A thorough review of the site and details will be performed when the plans are submitted for building permit.
These requirements are included as part of the Staff Report in an effort to ensure the Petitioner is aware of the
requirements.
COMPREHENSIVE PLAN DESIGNATION
The Village Comprehensive Plan designates the Subject Property as neighborhood commercial. This land use
designation is appropriate for office, retail, and commercial service establishments. The proposed retail
development will be consistent with the Comprehensive Plan's designation.
VARIATION STANDARDS
The standards for a Variation are listed in Section 14.203.C.9 of the Village Zoning Ordinance and include seven
specific findings that must be made in order to approve a Variation. The following list is a summary of these
findings:
• A hardship due to the physical surroundings, shape, or topographical conditions of a specific property not
generally applicable to other properties in the same zoning district and not created by any person
presently having an interest in the property;
• Lack of desire to increase financial gain; and
• Protection of the public welfare, other property, and neighborhood character.
The Petitioner has requested Variations from the Village Code's building and parking lot setbacks, and overall lot
coverage requirements. Per the Petitioner, the Subject Property's unique characteristics create a hardship due to
the lot area and shape. The Subject Property measures 13,804 square feet in area and is a triangular shaped lot
completely surrounded by roads.
Village Staff believes the Petitioner's requests comply with the Variations standards and is supportive of the
requests. The proposed development would reduce the extent of the existing nonconforming building setbacks

and lot coverage. The building setbacks would increase from half a foot (.5') to five feet (5') along the west lot
line and from eight and one half feet (8.5') to ten feet (10') along the south lot line. The proposed setbacks would
place the building outside of the sight triangle and allow for building foundation landscaping along Mt. Prospect
Road where none is currently provided. The overall lot coverage would be reduced by eleven percent (11%);
from approximately eighty seven percent (87%) to seventy-five and nine tenths percent (75.9%). Further, the
proposed development would improve the safety and traffic flow into the site by reducing the number of access
drives from four (4) to two (2) and including narrower curb cuts. The access drive improvements would be
consistent with the Rand Road Corridor Plan, which calls for eliminating curb cuts where possible to improve the
safety and flow of traffic. Staff does not feel the proposed development would not be detrimental to the public
welfare or injurious to other property or improvements in the neighborhood. The proposed development will
comply with the Comprehensive Plan.
RECOMMENDATION
Staff finds that the standards for Variation have been met, as set forth in the Petitioner's responses to the
standards. Based on these findings, Staff recommends that the Planning & Zoning Commission make a motion to
adopt staff's findings as the findings of the Planning and Zoning Commission and recommend approval of the
following motions:
A. A Variation to allow a five foot (5') rear yard building setback along the west lot line.
B. A Variation to allow ten foot (10') exterior side yard building setbacks along the north and south lot lines.
C. A Variation to allow two foot (2') parking lot setback along the north and east lot lines.
D. A Variation to allow an overall lot coverage of 10,485 square foot (75.9%), subject to the following
conditions:
1. Development of the site in general conformance with the site plan prepared by Grund & Riesterer
Architects, Inc. dated November 3, 2014.
2. Development of the building in general conformance with the elevation plans prepared by Grund &
Riesterer Architects, Inc. dated November 4, 2014.
3. Providing a solid private metal gate for the trash enclosure.
4. Development of the site in general conformance with the landscape plan prepared by James Dowden &
Associates dated October 30, 2014, but revised to comply with Article XXIII of the Village Code
5. Obtaining permits from the Illinois Department of Transportation (IDOT) for work within the Rand Road
and Central Road rights-of-way.
6. Compliance with all applicable Village Code requirements, including, but not limited to, building, fire
prevention, signage and lighting.
7. A building permit, in accordance with the current regulations and requirements of the Village of Mount
Prospect, must be issued within one (1) year from the date of adoption of the enabling ordinance by the
Village Board which authorized the development proposal. The development approvals granted herein,
without need for further action by any Village board, commission or official, shall become null and void
if no building permit is issued within the one (1) year requirement and improvements completed within a
period of eighteen (18) months."
The Village Board's decision is final for the motions above.

Commissioner Youngquist called the meeting to order at 7:31 pm. Commissioner Beattie made a motion,
seconded by Commissioner Kueter to approve the minutes of the October 23, 2014 Planning and Zoning
Commission Meeting; the minutes were approved 5-0. Commissioner Younquist introduced Case PZ -31-
14 1020 E. Central Road.
Ms. Andrade stated the Petitioner for PZ -31-14 is seeking Variations to the building and parking lot
setbacks and overall lot coverage for the property located at 1020 E. Central Road.
Ms. Andrade stated the Subject Property is located at the intersection of Rand, Central and Mount

Ms. Andrade continued to explain the number of access drives would be reduced from four to two (one on
Rand Road and one on Central Road), and the Petitioner's plans indicate sixteen (16) parking spaces
would be provided. The project requires Variations to the building and parking lot setbacks and overall lot
coverage.
Ms. Andrade stated The Petitioner shall keep in mind that future land uses will be restricted to those that
require no more than sixteen (16) parking spaces. Land uses with higher parking requirements, such as a
restaurant, will not be permitted without Variation approval.
Ms. Andrade explained not all of the existing improvements comply with code requirements. The
building setbacks along the south and west property lines and parking lot setbacks along the north, side,
and rear property lines are nonconforming. The existing overall lot coverage is also nonconforming. The
lot coverage measures 87% when a maximum of 75% is permitted.
Ms. Andrade further explained that the proposed improvements require Variations to the building and
parking lot setbacks and lot coverage requirements.
Ms. Andrade explained the building would be setback ten feet (10') from the exterior side lot lines when
the Village Code requires thirty feet (30'). The rear yard building setback would be five feet (5') when
Village Code requires twenty feet (20'). The parking lot setbacks would be two feet (2') along the north
and east property lines when the Village Code requires a minimum ten feet (10'). The proposed
development would reduce the overall lot coverage to 75.9%, which requires Variation approval.
Ms. Andrade stated the elevation plans indicate the building materials will consist of brick, engineered
stucco system, precast stone, and metal clad storefront window systems with clear glass. Awnings would
be provided above each storefront window system.
Ms. Andrade stated the Petitioner submitted a preliminary landscape plan which does not comply with all
of the Village Code's landscape requirements. The Petitioner is not seeking a Variation to the landscape
requirements and will be required to submit a revised landscape plan that provides building foundation
landscaping along the west and south elevations, and provide additional parking lot landscaping. A
revised landscape plan will be required at time of building permit application.
Ms. Andrade summarized the Standards for a Variation as the following:

Ms. Andrade stated that Village Staff believes the Petitioner's requests comply with the Variations
standards and that there is a hardship due to the physical characteristics of the property; therefore, Staff is
supportive of the Variation request.
Ms. Andrade stated that the proposed development would reduce the extent of the existing
nonconforming building setbacks and lot coverage. The building setbacks would increase from half a
foot (5) to five feet (5') along the west property line and from eight and one half feet (85) to ten feet
(10) along the south property line. The proposed setbacks would place the building outside of the sight
triangle and allow for building foundation landscaping along Mt. Prospect Road. The overall lot coverage
would be reduced by eleven percent (11%); from approximately eighty seven percent (87%) to 75.9%.
Ms. Andrade further explained the proposed development would improve the safety and traffic flow into

Commissioner Beattie clarified that the gas tanks on the property would have to be removed per
MWRD's code requirements.
Ms. Andrade stated they would and that the Public Works department has to sign off on MWRD's
application in order to do so.
Commissioner Younquist asked if the gas tanks have been replaced.
Mr. Simmons stated they have not and the current operator took over the existing facility including the
existing underground tanks.
Commissioner Filippone asked if there has been any testing to see if the tanks are leaking.
Ms. Andrade stated they aren't aware of any testing and the Petitioner may have more knowledge
regarding that.

Commissioner Mizwicki asked what the traffic flow would be into and out of the site.
Mr. Simmons stated that both curb cuts have restricted left turns on to the site. He further explained that
Central Road and Rand Road are controlled by IDOT and any work that takes place in the right of way
would require an IDOT permit.
Commissioner Youngquist swore in Petitioner Charles Riesterer 20 N Wacker Drive Suite 2418 Chicago,
Illinois.
Mr. Riesterer gave a brief description of the proposed development. He stated the proposed building is
one story and rectangular in shape with a projected bay on the east side of the building. He reiterated the
details presented in the staff report.
Mr. Riesterer further stated they are willing to work with the Village in order for the landscaping plan to
comply with Village Code. He further stated the physical characteristics of the Subject Property create a
hardship and believes the project complies with the Variation standards.
Commissioner Younquist asked if a new landscape plan has been submitted.
Mr. Riesterer stated that it was submitted on Monday and is based off landscape architects meeting with
the Village Staff in order to comply.
Commissioner Younquist asked if the tenants of the space have been determined.
Mr. Riesterer stated it will be a single tenant space and will be occupied by a mattress store.
General discussion occurred regarding if the building could be divided into multiple users and the impact
on parking requirements. Mr. Simmons stated that parking for the entire building is based off of square
footage. The proposed parking spaces are sufficient for the intended retail use and that dividing the
building into multiple retail uses would not impact parking requirements; however, if a restaurant should
go into the space the Petitioner would have to submit for a parking variation as restaurants have a higher
parking requirement.
Commissioner Younquist asked if there has been any testing or studies done regarding the underground
gas tanks.
Mr. Riesterer stated he didn't know if any information regarding environmental testing.
Commissioner Younquist asked the Petitioner has had any preliminary discussions with IDOT regarding
the driveway access.
Mr. Riesterer stated they haven't but has worked with IDOT on other projects throughout the Chicagoland
area and understands the permit process.
Commissioner Filippone stated he commends the Petitioner for taking on such a difficult site but is
concerned the owner will back out if there are issues taking out the gas tanks later on during the process
leaving a vacant lot.

Mr. Riesterer stated that he has full confidence that the owner will take care of any issues that may arise
with the demolition; he further explained the owner and developer will comply with all regulations in
order to remove the tanks properly.
Commissioner Youngquist stated that the responsibility to take out the tanks is on the current owner per
Illinois State law.
There was general discussion regarding the responsibility of the tank removal.
Mr. Simmons stated if something were to go wrong with the project and the developer backed out the
Village's property maintenance code would be enforced to maintain the property.
Commissioner Kueter asked if the proposed signage complies with the code.
Mr. Simmons stated per the code, the Petitioner can have a ground sign for each frontage and wall signs
as well.
There was general discussion between the board and Petitioner regarding the difficultness of the site and
that the proposed site plan is conducive to the uniqueness of the site.
Commissioner Beattie asked if the Petitioner is aware of all the conditions recommended by the Staff.
Mr. Riesterer stated that he was aware and in agreement of all the conditions.
Commissioner Youngquist opened the case to the public. Hearing no comments, he closed the public
portion of the meeting and brought the discussion back to the board. Hearing no further discussion from
the board, Commissioner Beattie made a motion seconded by Commissioner Kueter to approve the
following:
A. A Variation to allow a five foot (5') rear yard building setback along the west lot line.
B. A Variation to allow ten foot (10') exterior side yard building setbacks along the north and south
lot lines.
C. A Variation to allow two foot (2') parking lot setback along the north and east lot lines.
D. A Variation to allow an overall lot coverage of 10,485 square foot (75.9%), subject to the
conditions of approval listed in the staff report.
UPON ROLL CALL AYES: Filippone, Beattie, Kueter, Mizwicki, Youngquist

The vote was approved 5-0 with a positive recommendation to Village Board.

The Petitioner currently operates a sports training and teaching establishment at 604 W. Central and
would like to open up a second location at 900 Business Center Drive. The Petitioner proposes t,#
remodel the east 13,231 square feet of the existing building to operate a sports training and teaching
establishment that would offer baseball and softball training to athletes of all ages. The floor plan
indicates nine (9) batting cages, restrooms, and a viewing room would be provided. The anticipated
hours of operation would be Monday through Friday from 3 PM to 10 PM and Saturdays and Sundays
from 8AIA-to-6QVI.
The Planning & Zoning Commission conducted a public hearing to review the requests on Thursday,
November 13, 2014, and by a vote of 5-0, recommended approval of a Conditional Use for a sports
training and teaching establishment at 900 Business Center Drive, subject to compliance with all
applicable Village Code requirements, including, but not limited to, fire code, lighting regulations, sign
code regulations, and building regulations.
Details of the proceedings and items discussed during the Planning and Zoning Commission hearing

A public hearing has been scheduled for the November 13, 2014 Planning & Zoning Commission meeting to
review the application by The Ball Park, LLC (the "Petitioner") regarding the property located at 900 Business
Center Drive (the "Subject Property"). The Petitioner is seeking Conditional Use approval to operate a sports
training and teaching establishment. The P&Z hearing was properly noticed in the October 29, 2014 edition of
the Daily Herald Newspaper. In addition, the Petitioner completed the required written notice to property owners
within 250 -feet and Staff posted a Public Hearing sign on the Subject Property.
PROPERTY DESCRIPTION
The Subject Property is located on the north side of Business Center Drive, in the Kensington Business Center,
and includes a 43,840 square foot office and warehouse building with related improvements. The existing
building includes two (2) tenant spaces. The west half of the building is currently occupied by Bladeroom. The
east half is vacant. The Subject Property is zoned I1 Limited Industrial and borders the 11 Limited Industrial
District on all sides.
SUMMARY OF PROPOSAL
The Petitioner currently operates a sports training and teaching establishment at 604 W. Central and would like to
open up a second location at the Subject Property. The Petitioner would like to remodel the east 13,231 square
feet of the existing building to operate a sports training and teaching establishment. The attached floor plan
indicates nine (9) batting cages, restrooms, and a viewing room.
The sports training and teaching establishment would offer baseball and softball training to athletes of all ages and
is anticipated to operate Monday through Friday from 3 PM to 10 PM and Saturdays and Sundays from 8 AM to
6PM.
PARKING
The parking requirement for a sports training and teaching establishment is two (2) spaces per three (3) employees
plus one (1) space per maximum number of students. The Petitioner anticipates a peak number of twenty eight
(28) students and four (4) employees. Therefore, the sports training and teaching establishment will require
thirty-one (3 1) parking spaces. The existing tenant's parking requirement is twenty five (25). Therefore, the

overall parking requirement for the Subject Property would be fifty-six (56). The 2013 building permit plans for
Bladeroom indicate the overall parking provided is sixty (60). The following table summarizes the parking
requirements:
ADDITIONAL STAFF COMMENTS
Fire — An egress plan including, occupant loads, travel distances, egress widths, and common path of travel
distances, will be required when the building plans are submitted for review. Further, a fire sprinkler system in
accordance with NFPA 13 and an alarm system will be required. Fire sprinkler shop drawings, hydraulic
calculations, fire alarm shop drawings with point to point wiring diagrams, battery load calculations, and
equipment cut sheets will be required at time of building permit plan submittal. While these are issues to be
addressed as part of the building permit process, these requirements are included as part of the Staff Report in an
effort to ensure the Petitioner is aware of the requirements and submits the necessary documentation.
CONDITIONAL USE STANDARDS
The standards for Conditional Uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include
seven specific findings that must be made in order to approve a Conditional Use. The following list is a summary
of these findings:
• The Conditional Use will not have a detrimental impact on the public health, safety, morals, comfort or
general welfare;
• The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the
vicinity or impede the orderly development of those properties;
• There is adequate provision for utilities, drainage, and design of access and egress to minimize congestion
on Village streets; and
• The request is in compliance of the Conditional Use with the provisions of the Comprehensive Plan,
Zoning Code, and other Village Ordinances.

Fire — An egress plan including, occupant loads, travel distances, egress widths, and common path of travel
distances, will be required when the building plans are submitted for review. Further, a fire sprinkler system in
accordance with NFPA 13 and an alarm system will be required. Fire sprinkler shop drawings, hydraulic
calculations, fire alarm shop drawings with point to point wiring diagrams, battery load calculations, and
equipment cut sheets will be required at time of building permit plan submittal. While these are issues to be
addressed as part of the building permit process, these requirements are included as part of the Staff Report in an
effort to ensure the Petitioner is aware of the requirements and submits the necessary documentation.
CONDITIONAL USE STANDARDS
The standards for Conditional Uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include
seven specific findings that must be made in order to approve a Conditional Use. The following list is a summary
of these findings:
• The Conditional Use will not have a detrimental impact on the public health, safety, morals, comfort or
general welfare;
• The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the
vicinity or impede the orderly development of those properties;
• There is adequate provision for utilities, drainage, and design of access and egress to minimize congestion
on Village streets; and
• The request is in compliance of the Conditional Use with the provisions of the Comprehensive Plan,
Zoning Code, and other Village Ordinances.

Road.
RECOMMENDATION
The proposed sports training and teaching establishment meets the Conditional Use standards contained in
Section 14.203.F.8 of the Zoning Ordinance. Based on these findings, Staff recommends that the Planning &
Zoning Commission adopt staff findings as the findings of the Planning and Zoning Commission and recommend
approval of the following motion:
"To approve:
A Conditional Use for a sports training and teaching establishment at 900 Business Center Drive, subject to the
following condition:
1) Compliance with all applicable Village Code requirements, including, but not limited to, fire code,
lighting regulations, sign code regulations, and building regulations."

Commissioner Youngquist called the meeting to order at 7:31 pm. Commissioner Beattie made a motion,
seconded by Commissioner Kueter to approve the minutes of the October 23, 2014 Planning and Zoning
Commission Meeting; the minutes were approved 5-0. Commissioner Younquist introduced Case PZ -35-
14 900 Business Center Drive.
Ms. Andrade stated the Petitioner for PZ -35-14 is seeking Conditional Use approval to operate a sports
training and teaching establishment at 900 Business Center Drive.
Ms. Andrade stated the Subject Property is located on the north side of Business Center Drive, in the
Kensington Business Center, and includes a 43,840 square foot office and warehouse building with
related improvements. The existing building includes two (2) tenant spaces. The west half of the building
is currently occupied by BladeRoom. The east half is vacant. The Subject Property is zoned Il Limited
Industrial and borders the I1 Limited Industrial District on all sides.
Ms. Andrade stated the Petitioner currently operates a sports training and teaching establishment at 604
W. Central and would like to open up a second location at the Subject Property. The Petitioner would like
to remodel the east half of the building to operate a sports training and teaching establishment. The floor
plan indicates nine (9) batting cages, restrooms, and a viewing room. The sports training and teaching

establishment would offer baseball and softball training to athletes of all ages and is anticipated to operate
Monday through Friday from 3 PM to 10 PM and Saturdays and Sundays from 8:00 am to 6:00 pm.
Ms. Andrade stated the proposed sports training and teaching establishment will require thirty-one (3 1)
parking spaces. The existing tenant's parking requirement is twenty five (25). Therefore, the overall
parking requirement for the Subject Property would be fifty-six (56), which would not be an issue as the
property provides sixty (60) parking spaces.
Ms. Andrade summarized the Standards for a Conditional Use as the following:

Commissioner Younquist asked about Bladeroom.
Ms. Andrade stated Bladeroom was a manufacturer of data centers. Their space is divided up into office
space and a showroom.
Commissioner Youngquist swore in Ken Strickland 2015 E. Freemont Court, Arlington Heights; and Ron
Caccini 16 E. Campbell Arlington Heights.
Mr. Caccini gave a brief history regarding their business and success at the 604 W. Central location. He
further explained that they have become so busy they need to expand in order to accommodate the growth
of their business.
Mr. Caccini stated they choose the Subject Property because it's a great space that doesn't require a lot of
work.
Mr. Strickland stated that he has met with the fire and building departments at the Subject Property to get
the requirements needed in order to comply with code should the Conditional Use get approved.
Commissioner Beattie asked if they are closing the location on Central.
Mr. Caccini stated they are not closing the Central location and have hopes to expand there as well in the
next few years. He further explained that customers come from a number of the outlying suburbs to train
at the facility.
Mr. Caccini gave a brief description of the business development opportunities the training facility has
coming up in the near future. He explained the Subject Property would be perfect for the new training
classes because of its high ceilings and space.
Mr. Caccini stated that they will have to remove some office spaces within the Subject Property because
they are not needed.
Commissioner Beattie asked how many coaches and students would be using the facility on average.
Mr. Strickland stated they expect up to four (4) staff members and about twenty-eight (28) students at any
given time. He further explained teams will come in for about ninety (90) minute sessions and individuals
for thirty (30) minute sessions.
Commissioner Youngquist commented that the Kensington Business center has recently become a
popular place for similar businesses and thinks that it works well for training facilities.
Commissioner Youngquist, hearing no citizens to be heard, closed the public portion of the meeting and
brought discussion back to the board.
Commissioner Beattie made a motion seconded by Commissioner Kueter to approve the following
motion:

Standards for Conditional Use Approval
When considering its recommendation regarding a proposed Conditional Use, the Planning & Zoning Commission is
guided by seven standards listed in. Zoning Code Section 14.203..F.8. '1'hose standards relate to the potential effects on
nearby properties. The standards for Conditional Use approval are:
1. That the establishment, maintenance, or operation of the conditional use will not be detrimental to, or endanger
the public health, safety, morals, comfort, or general welfare;
That the conditional use will not be injurious to the uses and enjoyment of other property in. the immediate
vicinity for the purposes already permitted, nor substantially diminish and impair property values within the
neighborhood in which it is to be located;
That the establishment of the conditional use will not impede the normal. and orderly development and
improvement of the surrounding property for uses permitted in the district;
4. That adequate public utilities, access roads, drainage and/or necessary facilities have been or will be provided-,
5. That adequate measures have been or will be taken to provide ingress and egress so designed as to minimize
traffic congestion in the public streets;
6. That the proposed conditional use is not contrary to the objectives of the current Comprehensive Plan for the
Village; and

2 AND 3 IN KENSINGTON CENTER, PHASE TWO, BEING A SUBDIVISION IN PART OF
THE NORTHWEST ¼ OF SECTION 35, TOWNSHIP 42 NORTH, RANGE 11, EAST OF
THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED

the request herein and have determined that the same meets the standards of the Village and that the
granting of the proposed Conditional Use permit would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth are incorporated as findings of fact by the Mayor and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect do hereby grant a
Conditional Use permit for the property located at 900 Business Center Drive, as shown on the Plat of
Survey, a copy of which is attached and made part of this Ordinance

AND ABATEMENT ORDINANCES
PURPOSE:
To obtain approval of the attached three ordinances related to the tax levies of the Village (corporate and
special service area levies), and the Mount Prospect Public Library.
BACKGROUND:
Prior to December 23, 2014 the Village must have on file with the County Clerk its 2014 tax levy ordinances.
The Village will receive proceeds from the 2014 tax levy in 2015.
The Village Board first discussed the proposed 2014 tax levy at its October 28th Committee of the Whole
meeting. Staff recommends a net Village tax levy of $17,730,921, an increase of 2.48% from the prior year.
The Mount Prospect Library Board approved their tax levy request at its meeting on October 16, 2014. They
are asking for a total levy, inclusive of a 2.0% provision for loss and cost, of $10,534,637. This represents an
increase of 2.0% over the 2013 levy.
DISCUSSION:
The following table compares the proposed 2014 levy to the 2013 levy for the Village and Library. The
amounts presented in the table are net of abatements and are inclusive of the 2% provision for loss and
cost.

The Village's 2013 equalized assessed valuation (EAV) is $1,357,294,084. Our 2014 EAV is estimated to
increase approximately 1.6% from the prior year based on historical trends. The final 2014 EAV will not be
available until August 2015. The Village's 2014 tax rate is estimated at $1.306, compared to the 2013 rate
of $1.275. The Library's 2014 tax rate is estimated at $0.776, compared to the 2013 rate of $0.761.
For illustration purposes only, a home with an EAV of $93,174 (a market value of approximately $350,000)
in 2014 will pay taxes of $1,138 to the Village of Mount Prospect and $676 to the Library for the levy
extended in 2014. Assuming valuations do not change, the Village portion of the levy for a typical home will
increase $27 while the increase in the Library levy is $13 from the levy extended in 2013. These amounts
will vary based on eligible tax reductions for homeowner or senior exemptions or senior
assessment freezes.
Special Service Area No. 5 was created in the mid -eighties to help fund the delivery of Lake Michigan water
to the Village's water system. It is recommended the 2014 levy remain the same as the 2013 levy
($1,545,773).
The Village Board is being asked to consider three ordinances related to the 2014 tax levy. Two of the
ordinances establish the initial levy of the Village (including the Library) and the Village's special service
area. The third is an abatement ordinance that reduces a portion of the Series 2009C and Series 2013 debt
service tax levies established by its bond ordinance. The abatement of the Series 2009C levy is the result of
issuing these bonds as Build America Bonds (BAB). The BAB's provide a federal subsidy of 35% of the
interest paid on the bonds to the issuer which lowers the overall cost of borrowing. The BAB subsidy for
2015 is $42,766. Funds to abate the Series 2013 levy will come from the home rule sales tax dedicated
to support flood control projects.
RECOMMENDATION:
It is recommended the Village Board approve the attached 2014 property tax levy ordinances.

Section 1: That the sum of Twenty -Seven Million Seven Hundred Eleven Thousand Three
Hundred Thirty -One Dollars ($27,711,331), the same being the total amount to be levied of
budget appropriations heretofore made for the corporate and municipal purposes for the
fiscal year beginning January 1, 2014 and ending December 31, 2014 as approved by the
President and Board of Trustees of the Village of Mount Prospect, be and the same is hereby
levied on all taxable property within the Village of Mount Prospect according to the
valuation of said property as is, or shall be assessed or equalized by the State and County
purposes for the current year 2014.
Section 2: The budgetary appropriations having been made by the President and
Board of Trustees of the Village of Mount Prospect were passed and approved by
Ordinance No. 6109 at a meeting hereof regularly convened and held in said Village of
Mount Prospect, Illinois, on the 17th day of December, 2013, and amended by Ordinance
No. 6130 passed and approved on the 18th day of March, 2014 and thereafter duly
published according to law, the various objects and purposes for said budgetary
appropriations are heretofore made and set forth under the column entitled "Amount
Budgeted", and the specific amount herein levied for each object and purpose is set forth

Section One: The President and Board of Trustees of the Village of Mount Prospect find as
follows:
A. That pursuant to Village Ordinance No. 5772 adopted December 1, 2009
authorizing the issuance of general obligation bonds for financing a portion of the
costs of constructing a replacement fire station, emergency operations center and
public works expansion there was levied for the year 2014 the sum of
$174,272.50 for bond interest payments.
B. That pursuant to Village Ordinance No. 6090 adopted August 20, 2013
authorizing the issuance of general obligation bonds for financing the
construction of various flood control projects throughout the village there was
levied for the year 2014 the sum of $369,956.26 for bond interest payments.
Section Two: It is hereby declared by the President and Board of Trustees of the Village of
Mount Prospect that the amount of $174,272.50 levied for G.O. Bond Interest payments for the
purpose of funding a portion of the costs of constructing a replacement fire station, emergency
operations center and public works expansion pursuant to Ordinance No. 5772 be and the same is
hereby abated in the amount of $42,766 leaving a balance of $131,506.50 as that amount levied
for such bond and interest payments for the fiscal year commencing January 1, 2014 and ending
December 31, 2014.
Section Three: It is hereby declared by the President and Board of Trustees of the Village of
Mount Prospect that the amount of $369,956.26 levied for G.O. Bond Interest payments for the
purpose of funding the construction of various flood control projects throughout the village
pursuant to Ordinance No. 6090 be and the same is hereby abated in the amount of $369,956.26
being the entire amount levied for such bond and interest payment purposes for the fiscal year
commencing January 1, 2014 and ending December 31, 2014.
Section Four: Village Ordinance Nos. 5772 and 6090 are hereby amended with respect to the
tax abatements declared herein and set forth in Sections Two and Three of this Ordinance.
Section Five: The Village Clerk of the Village of Mount Prospect is hereby authorized and
directed to file a certified copy of this Ordinance with the County Clerk of Cook County, Illinois
within the time specified by law.

SUBJECT: PROPOSED 2015 BUDGET
PURPOSE:
To present for the Village Board's consideration an ordinance adopting the annual budget for the fiscal
year beginning January 1, 2015 and ending December 31, 2015.
BACKGROUND:
The Village Manager released his proposed budget on October 10, 2014. Over the past two months the
Finance Commission met three times to review the document. The Village Board, meeting as a
Committee of the Whole (COW), reviewed the document on October 28, November 11 and November 25.
DISCUSSION:
Departmental presentations on the 2015 budget were made before both the Finance Commission and
Village Board with various staff on hand to facilitate discussion. The proposed budget incorporates all of
the policies and directives established by the Mayor, Board of Trustees and Finance Commission during
the August 2014 mid -year budget review and subsequent public meeting discussions.
The General Fund budget, as presented, is balanced. The proposed budget provides for a 2.48%
increase in the property tax levy and a 9.0% water rate increase.
A public hearing on the proposed budget has been scheduled for December 16, 2014. Notice of the
public hearing will be published in the Daily Herald on December 5, 2014. The ordinance included with
this memo will officially adopt the budget for the Village of Mount Prospect. Once the ordinance is
passed, the Finance Department will begin work on the final budget document. We hope to have the
approved budget document produced no later than January 1, 2015.
RECOMMENDATION:
It is recommended the Village Board pass the accompanying ordinance adopting the 2015 annual budget.

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect in accordance with State Statutes, have
provided for the preparation and adoption of an Annual Budget in lieu of passage of an Appropriation Ordinance; and
WHEREAS, the tentative Annual Budget for the Village of Mount Prospect for the fiscal year beginning January 1, 2015 and
ending December 31, 2015, as prepared by the Budget Officer for the Village and submitted to the President and Board of
Trustees, was placed on file in the Office of the Village Clerk on October 10, 2014 for public inspection, as provided by
Statute; and
WHEREAS, pursuant to notice duly published on December 5, 2014, a public hearing was held by the President and Board
of Trustees on said tentative annual budget on December 16, 2014, as provided by Statute; and
WHEREAS, following said public hearing, said tentative Annual Budget was reviewed by the President and Board of
Trustees and a copy of said tentative Annual Budget is attached hereto and hereby made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Annual Budget for the Village of Mount Prospect for the fiscal year beginning January 1, 2015 and
ending December 31, 2015, a copy of which is attached hereto and made a part hereof, is hereby approved and adopted as the
Annual Budget for the Village of Mount Prospect for said fiscal year.
SECTION TWO: Within thirty (30) days following the adoption of this Ordinance there shall be filed with the County Clerk
of Cook County a copy thereof duly certified by the Village Clerk and Estimate of Revenues by source anticipated to be
received by the Village in the fiscal year beginning January 1, 2015 and ending December 31, 2015, duly certified by the
Chief Fiscal Office
SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.

A RESOLUTION AUTHORIZING THE APPOINTMENT
OF AN ACTING VILLAGE MANAGER
Preamble
WHEREAS,
the Village of Mount Prospect is a home rule municipal corporation; and
WHEREAS, t
he Village of Mount Prospect is an Article V Managerial form of government
pursuant to the Illinois Municipal Code, 65 ILCS 5/5-1-1 et.seq.; and
WHEREAS,
there is in place, in the Village, a currently serving Village Manager appointed and
functioning under such Article V. However, the Mayor and Board of Trustees have determined
that there is a temporary absence in the office of Village Manager. The law provides that in
such instances the Mayor and Board of Trustees may appoint an Acting Manager to perform the
duties of an Article V manager.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING PURSUANT
TO ITS HOME RULE POWER, RESOLVES AS FOLLOWS:
SECTION 1:
David Strahl, the Assistant Village Manager, is hereby appointed, pursuant to the
Mount Prospect Municipal Code at Section 4.102 (C) and 65 ILCS 5/5-3-7 as Acting Village
Manager of the Village of Mount Prospect in the absence and in the stead of the currently
appointed Village Manager. This appointment shall be in full force and effect from and after the
adoption of this Resolution and shall continue in effect until such time as the Mayor and Board
of Trustees shall cause its rescission.
SECTION 2:
That this Resolution shall be in full force and effect from and after its passage and
approval in the manner provided by law.

A RESOLUTION AUTHORIZING PAYMENT TO THE MOUNT PROSPECT PUBLIC LIBRARY
UNDER THE TERMS OF A GROUND LEASE AGREEMENT
WHEREAS
Prospect Public Library
and
WHEREAS
, the Village has caused its attorney and staff to review the terms of the Lease and the
current status of the Property and its usage; and
WHEREAS
, the attorney and staff have reported that both the Village and the Library are in
substantial compliance with all material terms of the Lease; and
WHEREAS
, the Mayor and Board of Trustees have determined that it is in the best interests of the
Village and its residents to assure that there is continued compliance with the Lease.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE

A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT
BETWEEN THE FOREST RIVER FIRE PROTECTION DISTRICT
AND THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Village of Mount Prospect and the Forest River Fire Protection District are
desirous of entering into an Intergovernmental Agreement; and
WHEREAS, the Intergovernmental Agreement being the subject of this Resolution
provides for the Village of Mount Prospect to provide for the fire protection, fire prevention
and emergency medical services for that area known as the Forest River Fire Protection
District.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE
EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby
authorize the Mayor to sign and the Clerk to attest his signature on the Intergovernmental
Agreement between the Forest River Fire Protection District and the Village of Mount
Prospect for the year 2015, a copy of which is attached hereto and hereby made a part
hereof as Exhibit “A”.
