HomeMy WebLinkAboutRes 07-00 03/07/2000~/1/00 RESOLUTION NO. 7-00 A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO ADOPT AN INTERGOVERNMENTAL AGREEMENT WITH THE VILLAGE OF ARLINGTON HEIGHTS FOR STREET LIGHT IMPROVEMENTS WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect has deemed that the best interests of the Village may be served by entering into intergovernmental agreements; and WHEREAS, Section 10 entitled Intergovernmental Cooperation of Article VII of the Illinois Constitution empowers municipalities to enter into intergovernmental cooperation agreements; and WHEREAS, the Village of Mount Prospect and the Village of Arlington Heights desire to enter into a mutual agreement to provide street lighting improvements at specific locations throughout Mount Prospect and Arlington Heights, as stated in the Intergovernmental Agreement, attached hereto; and WHEREAS, the Village of Mount Prospect and the Village of Arlington Heights have received federal funding to assist in this project, and desire to share the necessary additional funding, as set forth in said Agreement, for such street lighting improvements; and WHEREAS, the Village of Mount Prospect and the Village of Arlington Heights desire to share in the maintenance and energy costs, as set forth in said Agreement, for such street lighting improvements; and WHEREAS, said Agreement is a direct benefit to the Village of Mount Prospect and its residents by providing for safer driving and living conditions throughout the Village. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect are hereby authorized to execute the Intergovernmental Agreement for street light improvements, attached hereto and made a part of this Resolution as Exhibit "A.". age 2/2 Intergovt. Agrmt. SECTION TWO: That this Resolution shall be in full force and effective from and after its passage and approval in the manner provided by law. ATTEST: Village Clerk 03/06/00 - Legal #1) Consent Street Lighting Im! nts on Central and Algonquin A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE VILLAGE O?'MOUNT PROSPECT FOR STREET LIGHTING IMPROVEMENTS BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ARLiNGTON HEIGHTS: SECTION ONE: A certain intergovernmental agreement by and between the Village of Mount Prospect and the Village of Arlington Heights, regarding street lighting improvements on Central and Algonquin Roads, a true and correct copy of which is attached hereto, be and the same is hereby approved. SECTION TWO: The Village President and Village Clerk are hereby authorized and directed to execute said intergovernmental agreement on behalf of the Village of Arlington Heights. SECTION THREE: This resolution shall be in full force and effect from and after its passage and approval in the manner proVided by law. Prospect IA Street Lighting INTERGOVERNMENTAL AGREEMENT This Intergovernmental Agreement entered into this ~¢4~ day of ~0u{c~ , 2000 A. D., by and between the Villag~-Mount Prospect, Cook C~)unty, Illinois and the Village of Arlington Heights, Cook County, Illinois. WITNESSETH: WHEREAS, the Corporate Authorities of the Villages of Mount Prospect and Arlington Heights have determined that it would be in their mutual best interests to provide street lighting at the following two locations: (1) along Central Road from Belmont Avenue, in Arlington Heights, to Northwest Highway, in Mount Prospect; and (2) along Algonquin Road from 2000' east of Arlington Heights Road to east of Busse Road, including along Busse Road from. p(~6h e~ D~pster Street to south of Algonquin Road and along Dempster Street from east of Busse Road to Algonquin Road as shown on Exhibit A attached to and made a part of this IntergOvernmental Agreement; and WHEREAS, the Villages of Mount Prospect and Arlington Heights have sought and received federal funding' to assist in the construction of these street light improvements; and WHEREAS, the Villages have determined that the street lighting will be of immediate and permanent benefit to the VI ages' residents; NOW THEREFORE, in consideration of the following mutual covenants, the parties agree as follows: 1. Mount Prospect agrees to act aS lead agency. Mount Prospect Will coordinate the project with the Northwest Municipal Conference, make the surveys, prepare plans and specifications, receive bids, award the contracts, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications and contract. 2. Mount Prospect also agrees to pay, or provide for payment of, all construction and engineering costs subject to reimbursement by Arlington Heights. O0 .-oo o o It is mutually agreed by and between the parties that the estimated cost of the improvement and cost proration is as shown. The percentages and costs set forth in the following charts are only estimates based on the length of the improvements in each Village. The percentages may be adjusted based on the final construction costs. Arlington Heights will reimburse MoUnt PrOspeCt its prorated share of the cost of the project after receipt of appropriate progreSs payment requests and any other documentation deemed necessary. 5. Upon completion of the improvements and final field inspection by the Villages, Arlington Heights and Mount Prospect agree to maintain or cause to be maintained that portion of the improvements which lie within their respective municipal boundaries. 6. Arlington Heights and Mount Prospect agree to pay for all energy costs associated with the operation of the proposed street lights within their respeCtive muniCipal boundaries. THIS AGREEMENT shall be null and void in the event the contract covering the construction work contemplated is not awarded Within 3 years SUbsequent to the execution of this agreement. THIS AGREEMENT shall be binding upon and inure to the benefit of the parties, their successors and assigns.
