OWNER: Laura Egger PIN NUMBER: 08-12-112-017-0000 REQUEST :AdministrativeConditional Use – Unenclosed Porch in front yard STAFF PRESENT: Bill Cooney, Director of Community Development Consuelo Andrade, Senior Planner Jenna Moder, Administrative Assistant INTERESTED PARTIES: John Berta Mr. Cooney called the hearing to order at 4:03pm. He explained the process for the Administrative Conditional Use Hearing to the Petitioner. Ms. Andrade stated the Petitioner for PZ-15-13 is requesting a CU approval to allow the construction of an unenclosed front porch for the property located at 113 S. Elmhurst Avenue. Ms. Andrade stated the Subject Property is located on the east side of Elmhurst Avenue and contains a single-family residence with related improvements. She further explained the principal structure currently does not comply with the required front yard setback. Ms. Andrade explained the principal structure is setback 29.41’ from the front property line when the Village requires a minimum of thirty feet (30’). She stated the primary structure is considered non-conforming and is allowed to remain in its current location. Ms. Andrade stated the Petitioner’s proposed improvements included a two-story addition in the rear and a front porch. The proposed porch would extend six feet, four inches from the front elevation of the home, resulting in a twenty five foot (25’) front yard setback. Village Code requires administrative Conditional Use approval for the unenclosed porch in the front yard. Ms. Andrade stated the front elevation drawing indicated the proposed porch would be constructed out of wood, stone, vinyl and a shingled proof. The porch would measure approximately twelve feet (12’) tall, as measured to the midpoint of the roof. Ms. Andrade stated that the proposed improvements would meet the required bulk regulations. The gross floor area and lot coverage would increase to .32 and 27% respectively, which would be within the allowable gross floor area and lot coverage. Ms. Andrade stated the standards for approving an unenclosed porch are listed in Section 14.316.E of the Village Zoning Ordinance and include the following findings: William Cooney, AICP, Director of Community Development PZ-15-13 Administrative Conditional Use Hearing August 29, 2013 Page 1 of 2 That the conditional use will not be detrimental to, or endanger the public health, safety, morals, comfort, or general welfare; That the porch as designed is unenclosed and does not encroach more than (5) feet into the required front yard; and That building materials will be consistent with the remainder of the structure. Ms. Andrade explained that staff reviewed the Petitioner’s plans and found the proposed porch complies with the Conditional Use standards. She stated the porch would not adversely affect the character of the surrounding neighborhood, utility provisions, or public streets. The porch would be constructed to be consistent with the remainder of the home and would be in character with the neighborhood. Ms. Andrade stated Conditional Uses for unenclosed front porches have been approved for two properties located within a quarter mile of the Subject Property. The Village approved a Conditional Use for unenclosed front porches for the properties located at 111 I Oka Avenue in 2008 and 121 S. Elmhurst Avenue in 2003. Ms. Andrade stated Staff found the porch met the administrative conditional use standards and recommended that the Director of Community Development approve the following motion: “To approve an administrative conditional use for an unenclosed porch to encroach into the required front yard resulting in a twenty five and four tenths (25.4’) foot front yard setback for the property located at 113 S. Elmhurst Avenue.” Mr. Cooney asked if the Petitioner had anything further to add. Mr. Berta stated that he was the architect for the project and that the homeowners purchased the house from a family member and are making the much needed improvements. Mr. Cooney approved the motion as presented by Staff.
