A RESOLUTION AMENDING RESOLUTION NO. 29-82
RELATIVE TO A CERTAIN LEASE AGREEMENT
BETWEEN THE VILLAGE OF MOUNT PROSPECT
AND THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO
WHEREAS, the Village of Mount Prospect and the Metropolitan
Sanitary District of Greater Chicago, now known as The Metropolitan
Water Reclamation District of Greater Chicago, did enter into a
Lease Agreement, authorized through the passage of Resolution
No. 29-82, for property commonly known as Melas Park, generally
located on the north side of Central Road at Busse Road in the
Village of Mount Prospect; and
WHEREAS, the Metropolitan Water Reclamation District of Greater
Chicago has agreed to amend the existing Lease Agreement, the
subject of said amendments include a 20 year extension to lease
and deletiing certain restrictions relative to the sale of
intoxicating liquors on the property; and
WHEREAS, the Village of Mount Prospect is desirous of entering into
an amendment to the Lease Agreement with the Metropolitan Water
Reclamation District of Greater Chicago as set forth in the
Extension toeas€ Agreement and Amendment to Lease, a copy of
which is attached hereto and hereby made a part hereof as Exhibit
"A".
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and village Clerk are hereby
authorized and directed to sign the Extension to Lease Agreement
and Amendment to Lease with the Metropolitan Water Reclamation
District of Greater chicago for property commonly known as Melas
Park, a copy of which is attached hereto and hereby made a part
hereof as Exhibit "A".
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

EXTENSION TO LEASE AGREEMENT
AND AMENDMENT TO LEASE
THIS INDENTURE, made this 18th day .of July, 1989, by and
between the METROPOLITAN YATER RECLAMATION DISTRICT OF GREATER CHICAGO, a
Municipal Corporation organized and existing under the laws of the State of
Illinois (hereinafter designated the "Lessor"), authorized by an Order of the
Board of Commissioners dated the 6th day of July, 1989; and the VILLAGE OF
MOUNT PROSPECT, a municipal corporation organized and existing under the laws
of the State of Illinois, amends a certain Lease dated May 7, 1981, as
amended, for certain park premises commonly known as Melas Park. The parties
hereby further amend the Lease as follows:
Lessor and Lessee do hereby agree to extend the terms of the Lease for
an additional period of twenty (20) years from June 1, 1991 to and including
May 31,2011, unless terminated sooner by virtue of the provisions of Article
1.01 of the Lease dated May 7, 1981.
1.05 Paragraph 1.05 of the Lease dated May 7, 1981 is hereby revised
effective as of July 6, 1989 so as to delete the prohibition against the sale
or giving away of intoxicating liquors for five (5) events in each calendar
year to be named by Lessee so as to enable Lessee to sell alcoholic beverages
during the period of the designated adult events, subject to Lessee's
furnishing Dram Shop Insurance designating the District as a named insured.
Lessee further agrees that all proceeds above costs derived from the sale of
alcoholic beverages will be applied to landscaping and to improvements to the
park premises.
The parties do hereby ratify and affirm all of the terms and
conditions of the Lease dates May 7, 1981 as amended and as further revised
herein.
IN WITNESS WHEREOF, on the day and year first above written, the
parties hereto have caused these presents to be executed in triplicate by
