NORTHWEST HIGHWAY WHEREAS, Commercial National Bank as Trustee under rus't number 176 , date August 31, 1978, and the beneficiaries hereof, Gerald S. Grobman, Lee Siegel and Carl Weilding, (the Trus_e¡ nd the beneficiaries thereof s6all be referred to collectively s "p~titioner") are the owners of a parcel of property ocated at 100 W. Northwest Highway in the Village of Mt. Prospect, ounty of Cook, State of Illinois (hereinfater referred to as I he IT Subj ect Property"); and WHEREAS, the Subject Property is legally described s follows: Lot 1 of Wille's Reconsolidated Plat of Lots 1 and 2 in Wille's Consolidation Plat of Lots 2 to 12, both inclusive, in Block 2 in Busse and Wille's Resubdivision in Mount Prospect, a S~bdivision in the West Half of section 12, Township 41 North, Range II, East of the Third Principal Meridian, in Cook County, Illinois. nd WHEREAS, the Subject Property is located in the B-3 usiness Retail and Service District under the provisions of the oning Ordinance of the Village of Mt. Prospect (hereinafter eferred to as the "Zoning Ordinance"); and WHEREAS, Petitioner has heretofore filed an appliêa- ion seeking a variation from the provisions of Section 14.101P f the Zoning Ordinance which prohibits one lot to be occupied y more than one main use to allow the building located on the ubject Property to be subdivided into four separate units to e occupied for more than one use; and WHEREAS, a public hearing was held on the Petitioners' equest for the aforesaid variations, which request is known as BA-36-V-79, before the Zoning Board of Appeals of the Village f Mount Prospect on June 28, 1979, pursuant to proper public otice published in the Mount Prospect Herald on 6/8/79 ; and '\. WHEREAS, the President and Board of Trustees of the Village 'of Mount Prospect have determined that with resp~ct to the Petitioner's requestpd variation from the provisions of Section14.l0lF of the zoning Ordinance that Petitioner has satisfied the standards for the grant of a variation set forth in Section 14.605 of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount ,Prospect to grant Petitioner the requested variation. NOW, THEREFORE, BE IT ORDAINED BY THE, PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, Cook County, Illlnois as follows: SECTION ONE: The recitals set forth hereinaböve are incorporated herein as though fully set forth. SECTION TWO: The President and Board of Trustees f the Village of Mount Prospect hereby grant Petitioner a variation from the provisions of Section l4.l0lF of the Zoning Ordinance whiçh prohibits one lot to be occupied by ore than one main use to permit the building/located on the ubject Property to be subdivi~ed into four separate units to e occupi~d by more than one main use. , - SECTION THREE: Except for the variations granted all other applicable Village of Mount Prospect ordinances remain in full force and effect ,as to the Subject Property. SECT!ON FOUR:' This Ordinance shall be in full force nd effect from an~ after its passage, approval and publication n the manner provided by law.
