HomeMy WebLinkAboutOrd 2953 10/16/1979 I I .r\ ORDINANCE NO. 2953 AN ORDINANCE AMENDING ORDINANCE NO .2939 .11 WHEREAS, on September 4, 19~9, the President a~d Board of Trustees of the Village o~ Mou~t Prospect passed and approved II Ordinance No. 2939 calling a referendum election for Novem- I ber 10, 1979, which ordinance provided for the polls to remain I open from 6:00 A.M. to 6:00 P.M.; and Ii WHEREAS, on September 20, .1979, the Governor of the State of II Illinois signed Public Act 81-850 which became effective ¡immediately with respect to the amendments contained therein i to Section 17-1 of the Illinois Election Code which specifies I ~he hours during which the polls must remain open; and WHEREAS, pursuant to Public Act 81-850 the Illinois Election Ii Code, as amended, now requires that the polls remain open from 6:00 A.M. to 7:00 P.M.; and . WHEREAS, there is a conflict between Ordinance No. 2939 of the Village of Mount Prospect and the provisions of Section 17-1 of the Illinois Election Code, as amended by Public Act 81-850, and the President and Board of Trùstees have been advised, and desire to provide that the polls at the referendum election called for November 10, 1979, shall remain open .from 6:00 A.M. to 7:00 P.M. in conformity with the Illinois Election Code, as amended effective September 20, 1979; and WHEREAS, the President and Board of Trustees have been advised that the Deputy village Clerk, acting on the advice of the general counsel to the Village, has specified in the notice of the said referendum set for November 10, 1979, that the polls shall remain open from 6:00 A.M. to 7:00 P.M., and the President and Board of Trustees desire to ratify her action in doing so; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, . COOK COUNTY, ILLINOIS AS FOLLOWS: . SECTION ONE: Section Three of Ordinance No. 2939 of the Village of Mount Prospect, passed and approved September 4, 1979, be and I it is hereby amended by deleting from the first line on page 7 I of the said ordinance the words "6:00 A.M. to 6:00 P.M." and I substituting in their place in the first line on page 7 of the II said Section Three the words "6:00 A.M. to 7:00 P.M." I SECTION TWO: The action of the Deputy Village Clerk, Carol I Fields, in revising the notice of the said referendum called for November 10, 1979, so as to provide that the polls will I remain open from 6:00 A.M. to 7:00 P.M. rather than 6:00 A.M. to 6:00 P.M. be and the same is hereby ratified and approved. \ I I ~ '- ~ - 2 - SECTION THREE: This ordin~nce shall b~ in ~~ll ~o~c~ ~~¿ , effect from and after its 1-'::SS.3ge, <:p~)rú\'<ll and >;1bll_~:n.in~i in the <manner provid(~d by 1&".
