MAYOR'S REPORT None. COMMUNICATIONS AND PETITIONS COMPLAINT: John Gissler, 1103 Hunt Club, informed the Village Board about TCI some problems he is and continues to experience with TCl relative to the Intelligent TV service as well as billing problems. Assistant Village Manager David Strahl stated that he would continue the investigation into these problems and will report back to Mr. Gissler and the Village Board. OLD BUSINESS ZBA 13-97 ZBA 13-97, Text Amendment AMEND CH. 14 An Ordinance was presented for first reading that would amend FENCES Chapter 14 (Zoning) relative to regulations governing fences. The Zoning Board of Appeals recommended granting these amendments by a vote of 6-0. Trustee Hoefert, seconded by Trustee Nocch ~, moved to waive the rule requiring two readings of an Ordinance. AN ORDINANCE AMENDING CHAPTER 14 (ZONING) OF THE VILLAGE CODE Upon roll call: Ayes: Clowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried. AMEND CH. 18 An Ordinance was presented for first reading that would amend TRAFFIC CODE the Traffic Code (Chapter 18) by authorizing 2-way YIELD signs on YIELD on Thayer at Stratton, east and westbound. The Safety Commission recommended granting this request by a vote of 6-0. Trustee Hoefert, seconded by Trustee Nocchi, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried Page 2 -June 17, 1997 Trustee Hoefert, seconded by Trustee Nocchi, moved for passage ORD.NO. 4867 of Ordinance No. 4867 AN ORDINANCE AMENDING CHAPTER 18 (TRAFFIC CODE) OF THE VILLAGE CODE Upon roll call: Ayes: CIowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried. An Ordinance was presented for second reading that would LANDLORD amend Chapters 21 and 23 relative to Landlord Tenant TENANT regulations and inspections of multi-family units. AMEND CH. 21 & CH 23 Trustee Hoefert, noted that he had recently accompanied staff on a tour of multi-family complexes and observed vacant units that were in very poor condition and being rehabilitated. Trustee Hoefert noted that the proposed Ordinance requires interior inspections of units built over 20 years ago, however, this particular complex was built less than 20 years ago and suggested inspections be made of units built 10 or more years ago. It was stated that if the Village inspected these units more recently, the condition of the units may not have been bad. The following people spoke on this matter: Wes Pinchot, 747 Westgate Jack Berringer Rod McKenzie, 910 Boxwood Calvin Huber, 716 Fairview Lois McMichael Trustee Wilks, seconded by Trustee Nocchi, moved for ORD.NO. 4868 passage of the Ordinance AN ORDINANCE AMENDING ARTICLE XVIII ENTITLED "PROPERTY MAINTENANCE CODE" OF CHAPTER 21 AND ARTICLE XVII ENTITLED "RESIDENTIAL LANDLORD AND TENANT REGULATIONS" OF CHAPTER 23 OF THE VILLAGE CODE OF MOUNT PROSPECT Trustee Hoefert, seconded by Trustee Nocchi, moved to amend the proposed Ordinance for 20 to 10 years so would read in part "...no multi-family structure which is less than ten years old shall be subject to individual dwelling inspections unless independent probably cause exists to make such an inspection". Upon roll call: Ayes: Hoefert, Lohrstorfer, Nocchi, Wilks Nays: Clowes Motion carried. Trustee Clowes, seconded by Trustee Wilks, moved to amend Page 3-June 17,1997 the 'Rider to Lease' of the proposed Ordinance to add the following words to the last sentence "You and the owner or building agent have the right...". NO. 4868 Upon roll call to adopt the Ordinance as amended: Ayes: Hoefert, Lohrstorfer, Nocchi, Wilks Nays: Clowes Motion carried. NEW BUSINESS ZBA 3-97 ZBA 3-97, Mt. Prospect Park District, 1000 W. Central Road MP PARK DISTRICT The Petitioner presented their requests as follows: To rezone the subject property from I-1 (Light Industrial) to C-R (Conservation Recreation) For a Conditional Use for a recreational complex A variation to increase the maximum lot coverage from 25% to 62% Variations to decrease the parking set-back from 50 feet to . 20 feet along the north and south property lines. The Zoning Board voted 2 in favor of the requests and 3 against, resulting a no recommendation to the Village Board. The Petitioner noted that several neighborhood meetings have been held on this matter in order to explain the proposed uses for the building, in-line skating/hockey, Park District administration office, activities for senior citizens, and children, to name a few. The Petitioner stated that the neighbors expressed concern about many areas of the plan and the following changes were incorporated in the proposed plan. Change the detention area to decease its depth Commitment to have employee parking at the north portion of the parking lot to help eliminate vehicular movement Reduce the hours of operation from 6:00 AM to 10:30 PM to 7 AM to 10!00 PM Move the playground area to the northwest corner of the property Page 4 -June 17, 1997 The following residents spoke on this case: Ed Kasen, 901 Whitegate Jack Metcalf, 210 Prospect Manor Marlo Moratti, 1516 Mitchell Dick Norak Calvin Huber, 716 Fairview Steve Polit, 610 Wilshire Alice Johnson, 116 N. Lancaster There was considerable discussion relative the pros and cons of the proposal, however, the main consideration discussed was safety, such as people walking across Central Road and the fact that vehicles can only use Cathy Lane onto Central Road. Trustee Wilks, seconded by Trustee Hoefert, moved to grant the zoning requests made in the Petitioner's Application which are the s.ubject of ZBA 3-97. ~ Upon roll call: Ayes: Corcoran, Hoefert . Page 5 - June 17, 1997 FARMERS A Resolution was presented that would authorize Gall Meyers to MARKET conduct the annual Farmers Market from July 6 through October 12 in the railroad right-way parking lot. NO. 34-97 Trustee Hoefert, seconded by Trustee Nocchi, moved for passage of Resolution No. 34-97 A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE WITH GAlL MEYERS TO CONDUCT A FARMERS MARKET Upon roll call: Ayes: CIowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried. AMEND CH.21 An Ordinance was presented for first reading that would amend CRIME FREE Article Xlll of Chapter 21 (Building Code) to establish procedures HOUSING PROGRAM for the "Crime Free Housing Program". PREVAILING WAGES An Ordinance was presented for first reading that would adopt the prevailing wage rates established by the State of Illinois for public works projects provided by private contractors. Trustee Hoefert, seconded by Trustee Nocchi, moved to waive the rule requiring two readings of an Ordinance. A request was presented to accept the improvements installed ACCEPT in conjunction with the Randhurst General Cinema development IMPROVEMENTS: RANDHURST Trustee Hoefert, seconded by Trustee Clowes, moved to CINEMA accept the improvements installed in conjunction with the construction of the new Randhurst Cinema complex. A Resolution was presented that would appropriate $1,000,000 MFT FUNDS from the Motor Fuel Tax Fund for the 1997 street reconstruction program. Trusiee Hoefert, seconded by Trustee Nocchi, moved for RES.NO. 35-97 for passage of Resolution No. 35-97 A RESOLUTION APPROPRIATING MOTOR FUEL TAX FUNDS Upon roll call: Ayes: Clowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None VILLAGE MANAGER'S REPORT Assistant Village Manager David Strahl presented bid results. BIDS: The following bids were received for the Streetscape Program STREETSCAPE which includes improving the area south of Central Road, PROGRAM north of Northwest Highway and west of Pine Street: Bidder Amount Madam Construction $556,566.60 Kovilic Construction $598,010.66 ,--... Krugel Cobbles $836,036.14 Trustee Clowes, seconded by Trustee Wilks, moved to concur MARTAM with the recommendation of the administration and accept the CONST. Iow qualified bid submitted by Madam Construction for the Streetscape Program at a cost not to exceed $556,566.60. Page 7 - June 17, 1997 PALM DRIVE The following bids were received to make the necessary SANITARY & STORM repairs to the sanitary and storm sewers on Palm Drive REPAIRS between Robert and Birch: Bidder Amount Glenbrook $133,898.00 Vian $159,601.00 Scully, Hunter & Scully $169,452.80 George Kennedy $213,000.00 GLENBROOK Trustee Nocchi, seconded by Trustee Clowes, moved to concur with the recommendation of the administration and accept the Iow qualified bid received from Glenbrook in an amount not to $133,898.00 for the Palm Drive Sanitary/Storm Sewer Repair Project. Upon roll call: Ayes: Clowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried. INCREASE Assistant Village Manager presented a request to increase the BID AMOUNT authorized bid amount for the purchase of 9 computers by $400.00. PRINTERS It was noted that following approval of the bid amount of $6,570.00 the supplier found that the specific printer had been discontinued. The cost of the available printer that meets the specifications of the Village is $39.00 more, therefore the request to increase the authorized expenditure from $6,570.00 to $6,921.00. Trustee Clowes, seconded by Trustee Nocchi, moved to authorize an increase in the amount authorized for the purchase of 9 printers from Computer Discount Warehouse from $6,570.00 to $6,921.00. Upon roll call: Ayes: Clowes, Hoefert, Lohrstorfer, Nocchi, Wilks Nays: None Motion carried. ISABELLA/RAND Mr. Strahl informed the Board that the newly authorized traffic TRAFFIC regulations governing tums at Rand and Isabella and Henry have CONTROLS been installed. It was also noted that 18 tickets have been issued so far. ANY OTHER BUSINESS ~_. LIGHTING Trustee Hoefert expressed his concern relative to 'spill over lighting' and asked that staff take a look at the lighting at the new car lot on Northwest Highway as well as the Citco Station on Northwest Highway. Trustee Hoefert also asked that street lights be installed on Algonquin Road at Briarwood, near Prospect Commons Apartments. Trustee Hoefert expressed disappointment that the TCI studio is Page 8 -June 17, 1997 ess than satisfactory and asked that discussion on this subject take place at a future meeting. Members of the Board expressed their desire to resolve the parking problem on Forest Avenue prior to Prospect High School opening in the Members of the Board congratulated the Visions Committee on receiving the First Place Governors Award for their program, and the Mount Prospect Historical Society received a Second Place Award. Trustee Hoefert asked that the Board discuss the shopping cart Ordinance at a future meeting. Trustee Clowes asked the Board to consider increasing the non- resident ambulance fee from $125.00 to $250.00 or more and to consider charging the person responsible for a traffic accident to be charged for ambulance services. He asked that staff look into these options. Trustee Clowes also asked that staff make an attempt to stream- line the permit process, noting that Mount Prospect takes the longest time for the issuance of permits. Mr. Strahl stated that staff would look into the comparisons between neighboring communities relative to the amount of time it takes to issue and building permit.
