ELM STREET HEREAS, Clarence and Bernadine'Rasmus (hereinafter referred to ~ollectively as Petitioners ) have requested a special use permit ko operate a day care home in a single family dwelling at 320 N. ~lm Street in the Village of Mount Prospect,' county of Cook, Statei )f Illinois (hereinafter referred to as the "Subject Property"); ~nd ~HEREAS, the Subject Property is located in the R-1 Single Family ~esidence District and is legally described as follows: Lot One (1) in Block Five'(5) in Bluet~'s Subdivision of part of the North Half (I/2) of the 'Southeast Quarter (1/4) of Section Thirty-four (34), Township Forty-two '(42) North, Range Eleven (11) East of the Third (3rd) Principal Meridian in Cook County., Illinois, Illinois; 4HEREAS, Section 14.1101 C of the zoning Ordinance of the Village )f Mount Prospect provides that a day care home is a special use ~he R-1 Single Family Residence District; and ~HEREAS, a public hearing was held on Petitioners' request for a ~pecial use permit to operate a day care home on the Subject Property, which request is known as ZBA-55-SU-79, before the Zonin Ioard of Appeals of the Village of Mount Prospect on October 25, .979, pursuant to proper public notice published.in the Mount ~rospect Herald on October 9, 1979; and ~HEREAS, the Zoning' Board of Appeals'has recommended to the Build- ing Committee of the Board.of Trustees of the Village of Mount Prospect that Petitioners' request for the aforesaid special use )ermit, ZBA-55-SU-79, be granted; and ~HEREAS, the President and Board of Trustees of ~he Village of [ount Prospect have determined that with respect to the Petitione] I~equest for a special use permit to operate a day care home on th~ ~ub~ect Property, that Petitioners have satisfied the standards f¢ ~he grant of a special use permit set forth in Section 14.704 of ~rticle VII of the zoning Ordinance of the Village of' Mount '~.rospeCt and find that it would be in the best interest of the ;illage of Mount Prospect to grant Petitioners said special use )ermit provided Petitioners operate such' day care home in accord- ~nce with any requirements of the State of Illinois for such ~day ~are homes and further 'provided that Petitioners are licensed to ~perate such day care home by the State of Illinois. ~OW, THEREFORE, BE IT ORDAINED by the president and Board of rustees of the Village of Mount Prospect, Cook County, Illinois ~s follows: ECTION ONE: The foregoing recitals are set forth herein as fin( ings of fact of the President and Board of Trustees of the Villa¢ of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby authorize the issuance of a special use permit to Petitioners to operate a day care home on the followin¢ described property subject to Petitioners' compliance with the conditions set forth in Section Three hereinafter: Lot One (1) in Block Five (5) in Bluett's Subdivision of pa of the North Half (1/2) of the Southeast Quarter (1/4) of Section Thirty-four (34), Township Forty-two (42) North Range Eleven (tl) East of the Third (3rd) Principal Me in Cook County, Illinois (referred h~retofore and hereinafter as'the "Subject Property"). SECTION THREE: Petitioners shall be permitted to operate a day care home on the Subject Property provided~Petitioners comply the following conditions: Petitioners must be licensed by the State of Illinois operate a day care home on the Subject Property. Petitioners shall operate such day care home in accordar with any requirements imposed.by the State of Illinois such day care homes. Petitioners shall operate such day care home in accord- ance with all applicable Village of Mount Prospect ordi- nances. SECTION FOUR: The special use permit authorized herein shall be automatically revoked if Petitioners cease to occupy the premise~ of the Subject'Property. SECTION FIVE: The special permit authorized herein shall be sub- ject to revocation if Petitioners fail to operate the aforesaid day care home in accordance, with the conditions herein above set forth in Section Three of this Ordinance. SECTION SIX: The special use permit authorized herein shall not be deemed to run with the land and shall be issued to Petitioner~ only for ~s long as Petitioners occupy the premises of the Subje~ Property and operate a' day care home thereon in accordance with the provisions of this ordinance.
