HomeMy WebLinkAboutOrd 2984 03/04/1980 /11/80 ORDINANCE NO. 2984 AN ORDINANCE AI,fEND!NG CRYSTAL TOWERS PLANNED DEVELOPMENT WHEREAS, Petitioners, Clifford Josefik, Crystal Towers Homeowners Association, Crystal Towers Condominium "A" Association, Crystal Towers Condominium "B" Association, Crystal Towers Condominium "C Association, Crystal Towers Condominium "D" Association (herein- after referred to collectively as "Petitioners"), manage a planne unit development within the Village of Mount Prospect which is co monty called "Crystal Towers" and which located at 1717, 1727, 1747 and 1777 Crystal Lane in the Village of Mount Prospect (here inafter referred to as the "Subject Property"); and WHEREAS, the Subject Property ls legally described as follows: "Parcel "A", Lot "A" in Tally Ho Apartments, a subdivision part of the North East Quarter of the North East Quarter of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois also Parcel "B", Lot "B" of Tally Ho Apartments, a subdivision Part of the North East Quarter of the North East Quarter of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois;" and WHEREAS, planned development approval for the SubjectProperty,w~s granted by Ordinance No. 2346 passed and approved by the Presiee~t and Board of Trustees of the Village of Mount Prospect on April 1972; and WHEREAS, Ordinance No. 23~6 requmred the development of the Subielct Property in accordance with a site plan attached to said Ordina~c~ and also provided for the prevismon of specified amenities in co]-,- nection with such development; and WHEREAS, Petitioner has requested the following amendments to th~ planned development previous}y approved by the Village: To eliminate the ce,'ered bridge previously proposed to be constructed over the retention pond on the Subject Property. e To eliminate or modi. fy the decorative fence previously proposed to be constructed at the BUsse Road entrance to the Subject Prcperty. TO seek approval fc!~ the improvements, including land- scaping, existing e~: either side of the Busse Road entrance to the Subject Property. To amend the loCation and dimensions of the specified maintenance building previously proposed to be erected at the west line ri~ar ~he tennis court. 2 - 5. To eliminate the childrens' wading pool previously proposed to be constructed on the Subject Property. 6. To eliminate the childrens' playground area previously proposed to be constructed on the Subject Property. 7. To eliminate the putting green previously proposed to be constructed on the Subject Property. To eliminate the concrete patio previously proposed to be constructed next to the outdoor swimming pool located on the subject property and expand the presently existing swimmina pool deck. 9. To eliminate the water wheel previously proposed to be constructed on the Subject Property. 10. To seek approval for an aeration pump in the retention pond as the alternative to %he water wheel. 7HEREAS, a public hearing on Petitioner's requested amendments, 5BA-73-A-79, was held before the Village of Mount Prospect Zoning ~oard of Appeals on December 27, 1979 pursuant to public notice duly published in the Mount Prospect Herald on December 12, 1979; ~nd ~HEREAS, the President and Board of Trustees of the Village of ~ount Prospect have reviewed the aforesaid amendments requested by ?etitioners and the recon~mendations of the Zoning Board of Appeals ~nd qHEREAS, the President and Board of Trustees of the Village have determined that it is in the best interest of the Village to approve the aforesaid amendments requested by Petitioners subject to the conditions set forth hereinafter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT'AND BOARD OF TRUSTEES OF THE VILLAGE OF ~dOUNT PROSPECT, COOK COUNTY, ILLINOIS AS FOLLOWS: SECTION ONE: Subject to the conditions set forth hereinafter ~n Section Two, Ordinance No. 2346 of the Village of Mount Prospect be, and the same is hereby~ amended as follows: The covered bridge and water wheel to be constructed in connection with the retention pond on the Subject Property may be eliminated and Petitioners may substi- tute for such water wheel an adequate aeration pump subject to the approval of the Village Engineer. The childrens' playground area shown on Exhibit A attached hereto and incorporated herein by this reference may be eliminated. 3. The childrens' wading pool shown on Exhibit A hereto may be eliminated. 4. The putting green shown on Exhibit A hereto may be eliminated. 5. The concrete patic~ shown on Exhibit A hereto may be eliminated. he decorative fence shown on Exhibit A hereto at the Busse Road entrance to the Subject Property may be eliminated and a different fence, plans and specifica- tions for which shall be submitted to and be subject to the review and ~pproval of the Director of Com- munity Development, may be substituted therefor. The berms and landscaping consisting of trees and bushes located at the Busse Road entrance to the Sub- ject Property be, and the same are hereby, approved. ECTION TWO: The amendments to Ordinance No. 2346 approved in Section One of this Ordinance are approved subject to the Peti- tioner's compliance with the condition that Petitioner shall submit for the review and approval of the President and Board cf Trustees of the Village of Nount Prospect a properly signed and acknowledged resolution from each of the homeowners associations, ~hich resolution approves of the amendments authorlzed by this ~rdinance and which has been passed and approved by the same ~ercentage of condominium ow~ers as is required under the By- ,awe of each such association to approve special assessments. 'he form and contents of such Resolution shall be submitted to Director of Community Development and Village Attorney for ~eview and approval. THP~EE: The provisions of this Ordinance a~e not intended abrogate, annul or otherwise interfere with any covenant or private agreement or legal relationship. ECTION FOUR: This Ordinar~ce shall be in full force and effect from and after its passage~ approval and publication in the ~anner provided by law and the Village's receipt of the Resolu- zion as provided in Section Two hereinabove.
