AN ORDINANCE TEMPORARILY' SUSPENDING THE RECLASSIFICATION OF ZONING DISTRICTS WHEREAS, the Village of Mount Prospect has heretofore on July 20, 1976, adopted a comprehensive plan for the present and future development and redevelopment of land within and without the corporate limits of the Village; and WHEREAS, the Village of Mount Prospect has, on April 5, 1977, approved revisions and amendments to the said comprehensive plan; and WHEREAS, the President and Board of Trustees, the Zoning Board of Appeals and the Plan Commission of the Village have been required to consider frequent requests for changes in the zoning district classifications of land within the Village, many of which applications for changes have involved requests for the reclassification of land zoned for single family develop. ment to districts in which multiple family development would be permitted; and WHEREAS, only approximately 8% of the land area of the Village remains undeveloped; and WHEREAS, approximately 10% of the land in the Village may be presently underutilized and subject to redevelopment; and WHEREAS, the President and Board of Trustees have found and tetermined that the comprehensive plan should give more con- ~ideration to the housing and other land use goals of the ~unicipality and in particular that additional information ~nd guidelines should be detezmined for changes in the zoning :lassification of land; and ~IEREAS, the President and Board of Trustees have found and tetezmined that in order to insure a rational and.harmonious )alance of types of land uses within the Village it is impera- :ire that there be a temporary pause in the consideration of iezoning applications pending a review, reconsideration and ~ugmentation of the comprehensive plan of the Village so as to )rovide meaningful and useful guidelines for the decision of ~pplications for the reclassification of particular tracts of and; and HEREAS, the President and Board of Trustees have found and etermined that the process of reviewing, reconsidering and ugmenting the comprehensive plan of the Village so as to pro- ide more meaningful and useful guidance to the Village, its fficers, boards and co~m~,issions with respect to applications or reclassification of particular parcels of land will require ot more than 12 months; and HEREAS, the President and Board of Trustees of the Village have ound and determined that it would be i~equitable to require ersons who have heretofore filed rezon~ng applications with he Village to await a decision on their applications pending 2 - the completion of the proposed planning program, but that antil such comprehensive planning program has been completed · nd the results thereof considered and approved by the Village ~oard, no rezoning applications filed after the effective date Df this Ordinance should be acted upon by the President and ~oard of Trustees or the other boards and commissions of the ~illage except in those instances in which the Village Board ~etermines that action on such an application is reasonably %ecessary in order to ensure that federal or state grants for ~he construction of low or moderate cost housing will not be ~orfeited or lost; and ~REAS, the President and Board of Trustees have found and determined that it is in the best interests of the Village ~nd its residents that a comprehensive planning program designed to provide goals, objectives and guidelines for making decisions ~n requests for the reclassification of particular parcels of land be undertaken, and that the advice, consultation and ~ssistance o.f such experts as may be necessary or desirable should be secured by the Village. ~OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF ~RUSTEES OF THE VILT~GE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, %S FOLLOWS: ~ECTION ONE: The President and Board of Trustees find as facts :he matters hereinabove set forth. ~ECTION TWO: The Village President, acting i~ consultation with ~he Village Manager and the Director of Co, mt%unity Development, )e and they are hereby authorized and directed to prepare a scope of services for a comprehensive planning program designed to articulate goals, objectives and guidelines for deciding rezoning applications and requests made to the Village of Mount Prospect, to secure proposals for the services of expert con- sultants in connection with the said comprehensive planning program, and to present the same to the Board of Trustees for its consideration and action. ~ECTION THREE: Section 14.804 of the Zoning Ordinance of the ~illage of Mount Prospect is herebY amended bY adding thereto ~ew subsection D to read ~s follows: D. Notwithstanding anything to the contrary in this SeCtion 14.804, no application for rezoning received by the Village Clerk after ..December !~ , 19 ~9, shall be processed by the Village Clerk as provided in this Section or be the subject of review or hearing by the Zoning Board Of Appeals or any other board or commission of the Village for a period extending from and after DecemSer 18 ..... 19 ~, to and including December 31. , 1~ 8~ Pending the review of the comprehensive plan of the Village; provided, however, that applications that involve the allocation or expenditure of funds provided by the federal or state government for use in paying a portion of the cost of low or moderate cost housing shall not be subject to the provisions of this subparagraph. 3 SECTION FOUR: The Plan Commission of the Village shall be primarily responsible for undertaking the comprehenisve planning process hereinabove described and to the end that the President and Board of Trustees may be kept advised of the progress made in the said comprehensive planning process, the Plan Commission shall render progress reports to the President and Board of Trustees not less than monthly and the Plan Commission is directed to submit its recommendations with respect to the comprehensive plan of the Village, and the goals, objectives and guidelines for the decision of rezoning applications to the President and Board of Trustees not later than nine months from the date of this resolution. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
