HomeMy WebLinkAboutOrd 6067 05/07/2013 Amending Chapter 23 Regarding Alarm SystemsORDINANCE NO. 6067 AN ORDINANCE AMENDING CHAPTER 23 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS, REGARDING ALARM SYSTEMS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF ITS HOME RULE POWERS: SECTION 1: Article XVII, Alarm Systems, of Chapter 23 of the Mount Prospect Village Code shall be amended as follows: A. The table of contents shall be amended by inserting reference to a new "Section 23.1706: Display of Alarm System License: ", the remaining Sections and descriptions to be renumbered numerically. B. The definition of "Alarm System" in Section 23.1701, `Definitions ", shall be deleted in its entirety and the following inserted in its place: ALARM SYSTEM: Any security device installed for the purpose of alerting others to any unauthorized entry on the premises or the commission of an unlawful act. Such a device does not include an alarm system to the extent regulated in the Fire Prevention Code, Chapter 24 of this Code. C. Section 23.1702, "License Required ", shall be amended by deleting the phrase "the police department of to be and read as follows: 23.1702: LICENSE REQUIRED: It shall be unlawful for any person, firm or corporation to install or maintain an alarm system designed or intended to be used to signal an unauthorized entry on the premises, the commission of an unlawful act or any other emergency at the premises where such alarm system is located without first having obtained a license therefor from the Village. D. Section 23.1703, "Application for License ", shall be deleted in its entirety and replaced with the following: 23.1703: APPLICATION FOR LICENSE: A. The application for license, as required herein, or renewal thereof shall be filed with the Village finance department, and shall be accompanied by the license fee, as set forth in section 23.1704 of this article: B. The application for license and renewal of license shall be made on forms provided by the Village finance department and shall contain the following information: I . Name and address of the applicant. 2. The name and address of the premises where the alarm system is located. 3. The names, addresses and telephone numbers of at least one (1) and up to three (3) persons responsible for the premises where the alarm system is located and who should be contacted to deactivate the alarm system. 307279_1 E. Section 23. 1705, "Issuance of Alarm System License and Inspection ", shall be amended by deleting the phrase "chief of police of the" in the first sentence and replacing the phrase "chief of police" in the second sentence with the word "Village ", to be and read as follows: 23.1705: ISSUANCE OF ALARM SYSTEM LICENSE AND INSPECTION: The Village shall issue a license for an alarm system, except for an unauthorized automatic telephone alarm, within fifteen (15) days after a completed application for license accompanied by the annual license fee, is filed. Prior to the issuance of such alarm system license, the Village may inspect or cause to be inspected the alarm system for which a license has been requested. F. Section 23.1706, "Display of Alarm System License ", shall be deleted in its entirety, the remaining Sections to be renumbered numerically. G. Section 23.1712, renumbered 23.1711, "Automatic Telephone Alarm Prohibited," shall be amended by inserting the word "telephone" after the word "automatic" in the first sentence and inserting the phrase "or his /her designee" after the phrase "chief of police of the village" in the second sentence, to be and read as follows: 23.1712: AUTOMATIC TELEPHONE ALARM PROHIBITED: No person, firm or corporation shall install or cause to be installed, or maintain any automatic telephone alarm in the Village. Such automatic telephone alarms shall be considered a nuisance and are prohibited. Nothing in this section shall apply to automatic telephone alarms for handicapped persons authorized by the chief of police of the Village, or his /her designee. H. Subsection D of Section 23.1714, renumbered 23.1713, "Charges for Response to False Alarms and Reports ", shall be deleted in its entirety and replaced with the following: D. Within five (5) days after the chief of police receives a request for reconsideration from the licensee, the chief of police, or his /her designee, shall determine whether or not the alarm was false and shall notify the licensee of his /her decision in writing by personal delivery or U.S. regular mail. I. Subsection E of Section 23.1716, renumbered 23.1715, "Appeal Procedure ", shall be deleted in its entirety and replaced with the following: E. Revocation or suspension of an alarm system shall not be effective during the pendency of an appeal before the President and Board of Trustees of the Village and the period for which judicial review may be sought. SECTION 2: : Chapter 23, "Offenses and Miscellaneous Regulations ", of Appendix A, Division II, Fees, Rates and Taxes, of the Village Code shall be amended as follows: A. Delete the license fee and late fee for Section 23.1704: license Fee (Alarm Systems), and replace with the following: Section 23.1704: License Fee (Alarm Systems) Annual License Fee: $10 ($25.00 effective January 1, 2014) License Fee (renewal) after February 1: $20.00 ($40.00 effective January 1, 2014) B. Replace "Section 23.1714" with "Section 23.1713 ". 307279_1 SECTION 3: Appendix A, Division III, Penalties and Fines, of the Village Code shall be amended by deleting "Section 23.1718" and replacing it with "Section 23.1717 ", the heading and penalties to remain, as follows: Section 23.1717: Penalties (Alarm Systems) Fine: Not less than $50.00 nor more than $500.00 for each offense. SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
