HomeMy WebLinkAboutOrd 3024 07/15/1980 ORDINANCE NO. 3024 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY AT 900 NORTH WOLF ROAD WHEREAS, the Northwest Assembly of God (which shall be referred to as "Petitioner") is the owner of a parcel of property located at 900 North Wolf Road in the Village of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: PARCEL 1: The South 530 feet of the East 300 feet (except the South 208 feet of the East 275 feet thereof) of the East half of the Southeast quarter of Section 26, Township 42 North, Range 11, East of the Third Principal Meridian, ALSO PARCEL 2: Easement for the benefit of Parcel 1 as created by deed from Western National Bank of Cicero, as Trustee under trust Agreement dated May 21, 1964 and known as Trust 03311 to Central Baptist Church dated January 19, 1965 and recorded June 17, 1965 as Document 019498502 for sewer and water purposes in the East 50 feet of the South 269.53 feet of the North 800 feet of the South 1330 feet of that part of the East half of the Southeast quarter of Section 26, Township 42 North, Range 11, East of the Third Principal Meridian, lying East of West 635 feet thereof, all in Cook County, Illinois. SUBJECT to the real estate taxes for the years 1967 and thereafter and all restrictions and covenants thereto. WHEREAS, the Subject Property is located in R-X Single Family Residence District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioner has heretofore filed an application seeking the following variations: A variation from Ordinance 2885, Article I, Section 21.103 f. 5. to exempt the subject Property from the requirement that the sanctuary of the church located on the Subject Property be spinklered. A variation from Article X, Section 14.1002. A. and Article XXVI, Section 14.2602. B. 51. h of the Zoning Ordinance to permit parking on twenty- five (25) feet of the required forty (40) foot front yards on both Wolf and Kensington Road frontages, thereby allowing a fifteen (15) foot front yard on both road frontages. WHEREAS, a public hearing was held on the Petitioner's request for the aforesaid variations, which request is known as ZBA-13-V-80 (as to the sprinkler requirement) and ZBA-19-V-80 (as to the front yard requirement) before the Zoning Board of Appeals of the Village of Mount Prospect on April 24, 1980 and continued to May 22, 1980 with regard to ZBA-13-V-80, and on May 22, 1980 with regard to ZBA-19-V-80, pursuant to proper public notice published in the Mount Prospect Herald on April 8, 1980 for ZBA-13-V- 80, and on May 7, 1980 for ZBA-19-V-80; and WHEREAS, the Zoning Board of Appeals has recommended to the Building Committee of the Board of Trustees of the Village of Mount Prospect that Petitioner's request for the aforesaid variations, ZBA-13-V-80, be granted, and that ZBA-19-V-80 be modified to allow a fifteen (15) foot, rather than a twenty-five (25) foot variation with landscaping and berming to be approved by the Director of Community Development, and be granted as modified; and WHEREAS, the President and Board of Trustees have considered the Petitioner's request and reviewed the recommendation of the Village of Mount Prospect Zoning Board of Appeals in ZBA-13-V-80~ and ZBA-19-V-80; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Petitioner's requested variations, that Petitioner has satisfied the standards for the grant of variations set forth in Section 14.605 of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested variations, as modified below. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are incor- porated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant the following variations A variation from Ordinance 2885, Article I, Section 21.103 f. 5. to exempt the Subject Property from the requirement that the sanctuary of the church located on the Subject Property be sprinklered o A variation from Article X, Section 14.1002. A. and Article XXVI, Section 14.2602. SUBJECT to the real estate taxes for the years 1967 and thereafter and all restrictions and covenants thereto. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECT!ON FOUR: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Passed this 15th day of July , 1980.
