AN ORDINANCE PROVIDING FOR THE DISCONNECTION
AND WITHDRAWAL OF THE VILLAGE OF MT. PROSPECT
FROM MEMBERSHIP IN THE DES PLAINES, MT. PROSPECT,
ARLINGTON HEIGHTS, AND PALATINE WATER CO~LMISSION

WHEREAS, this Village did, by Ordinance No. 519 adopted
October 16, 1956 and thereafter amended by Ordinance No. 532,
)pted on December 18, 1956, join with the Villages of Des Plaines
lington Heights and Palatine for the purpose of establishing
Water Commission to acquire and operate a joint and common
urce of supply of water; and
WHEREAS, from the establishment of such Water Commission,
)wn as the Des Plaines, Mt. Prospect, Arlington Heights, and
.atine Water Commission, to date no such joint common source
supply of water has been acquired or operated by the Commission,
was intended when this Village joined in forming the same; and
WHEREAS, there are no outstanding and unpaid bonds or other
ng term indebtedness, claims or liabilities incurred by the said
ter Commission, and all present operating costs and expenses
the Commission have been paid or are otherwise payable from

WHEREAS, this Village deems it to be in the best interests
the citizens and residents thereof to obtain an alternate
:er source through participation in an organization commonly

WHEREAS, it is no longer advisable, necessary or in the publi

~erest for the Village to retain its membership in the Des Plaines
Prospect, Arlington Heights, and Palatine Water Commission; and
WHEREAS, the disconnection and withdrawal of the Village
om said Water Commission will not adversely affect the efforts
the remaining members of the Water Commission to secure a
~non source of water supply, nor jeopardi~ze or imperil any
isting obligations or liabilities of the Commission incurred

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
TRUSTEES OF THE VILLAGE OF MT. PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: This Board does hereby declare its membership
the Des Plaines, Mt. Prospect, Arlington Heights, and Palatine
~er Commission to be hereby terminated and cancelled and withdrawn
all the territory constituting the corporate limits of the
.lage of Mt. Prospect is hereby disconnected from said Water
mission.
SECTION 2: The term of office of the Commissioner appointed
this Village to membership on the Des Plaines, Mt. Prospect,
.ington Heights, and Palatine Water Commission is hereby terminate~
~n the effective date of this Ordinance and said Commissioner
~11 not participate further in the affairs of the Commission.
SECTION 3: This Village shall not be responsible for any
.igation or expenses incurred by the said Water Commission

SECTION 4:
The Village Clerk is hereby authorized and

irected t° send a certified copy of this Ordinance to the members
~f the Des Plaines, Mt. Prospect, Arlington Heights and Palatine
~ater Commission.
SECTION 5: Village Ordinance No. 519 and 532 are hereby
~epealed in their entirety.
SECTION 6: This Ordinance shall be in full force and
~ffect immediately upon its passage, approval and publication
~s required by law.
