HomeMy WebLinkAboutOrd 3067 11/05/1980 RDINANCE NO. 3067 AN ORDINANCE AMENDING CHAPTER 18 AND SCHEDULE XV OF THE TRAFFIC CODE OF THE VILLAGE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: Section 18.1322 of Article XIII of Cha~ter 18 (Traffic Code) of the Municipal Code of the Village of Mount Prospect be, and is hereby, amended by deleting said Section in its entirety and by substituting therefor a new Section 18.1322, which new Section 18.1322 shall hereinafter be and read as follows: S~ctio~ 1'S.1322. Metered Parking Zones~ A. There are hereby established certain parking zones to be known as metered parking zones, which zones shall be'within the districts or upon those streets or parts of streets described in Schedule XV of the Appendix to this Chapter. It shall be unlawful for any person to park a motor vehicle in the Maple Street parking lot unless a current Mount Prospect vehicle sticker is displayed i~ the front windshield of the vehicle so parked therein; so that parking in the said Maple Street lot shall be limited to Mount Prospect residents only. C. Master Collection Box System. There shall be established at each pa~king lot described in Schedule XV of the Appendix to this Chapter one or more Master COllection Boxes which shall have numbered slots. ~he slot numbers shall correspond to numbers (hereinafter "posted numbers") assigned to and posted at the head of each parking space in the parking lot. The deposit of sufficient United States coins amounting to seventy-five cents ($.75) in a numbered slot in a Master Collection.Box~!sh~ll establish a parking time of one day for th~ correspondingly numbered parking space. Parking Meters. t. If a parking meter, instead of a posted number, is located at the head of a parking space, then, for that space, the deposit of certain coins shall establish the allowed parking time up to the maximum time limit as follows: Upon the ~deposit of one five cent ($.05) coin, a parking limit of one-half (1/2) hour shall be established. o Upon the deposit of sufficient United States coins, except pennies, amounting to ten cents ($.10), a parking limit of one (1) hour shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to fifteen cents ($.15), a parking limit of one and one-half (1-1/2) hou~ shall be established. Upon the deposit of sufficient United States coins, except pennies, amopnting to twenty cents ($.20), a parking limit of two (2) hours shaI1 be established. Upon the deposit of sufficient United States coins, except pennies, amounting to twenty-five cents ($.25), a parking limit of two and one-half (2-1/2) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to thirty cents ($.30), a parking limit of three (3) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to thirty-five cents ($.35), a parking limit of three and o~e-half ~(3-1/2) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to forty cents ($.40), a parking limit of four (4) hours shall be establsihed. Upon the deposit of sufficient United States coins, except pennies, amounting to forty-five cents ($.45), a parking limit of four and one-half (4-1/2) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to fifty cents ($.50), a parking limit of five (5) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting-to fifty-five cents ($.55), a parking limit of five and one-half (5-1/2) hours shall be established. Upon the deposit of sufficient United States co~ns, except pennies, amounting to.sixty cents ($.60), a parking limit of six (6) hours shall be established. Upon the deposit of sufficient United States coins, except pennies, amounting to sixty-five ($.65), a parking limit of six and one-half (6-1/2) hours shall be established. 3 - nt Upon the deposit of sufficient United States Qoins, except pennies, amounting to seventy cents ($.70), a parking limit of seven (7) hours shall be established. Oo Upon the deposit of sufficient United States coins, except pennies, amounting to seventy- five cents ($.75), a parking limit of twelve (12) hours shall be established. o Each parking meter shall be so designed, constructed, installed and set that upon the expiration of the time period registered, by the deposit of one or more coins, as provided herein, it will indicate by an appropriate signal that the lawful parking meter period has expired, and during said period of time and prior to the expiration thereof, will indicate the interval of time which remains of such period. Each parking meter shall bear thereon a legend indicating the days and hours when the requirement to deposit coins therein shall apply, the value of coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking meter zone in which such meter is located. No person, except physicians on emergency calls, shall park any vehicle in any metered parking zone between the hours of 2:00 o'clock a.m. and 6:00 o'clock a.m. on any day. There shall be no charge for parking in metered parking zones on holidays, Saturdays and Sundays. The following days shall be designated as holidays: January 1, Good Friday, Memorial Day, July 4, Labor Day, Thanksgiving Day and December 25. If any of these days shall fall on Sunday and be observed on Monday, or if any of these days shall fall on Saturday and be observed on the Friday preceding, then such Monday or Friday shall be considered as a holiday for the purpose of this Section. H. Deposit of Coins and Time Limits. No person shall park a vehicle in any parking space alongside of and next to which a parking meter has been installed during the restricted and regulated time applicable to the metered parking zone in which such meter is located unless a coin or coins of United States currency of the appropriate denomination as provided in this Chapter shall have been dep6sited ~berein, or shall have been previously deposited therein for an unexpired interval of time, and said meter has been placed in operation. No person shall park a vehicle in any parking space at the head of which is a posted number during the r~stricted and regulated time applicable to the metered parking zone in which such parking space is located unless a coin or c~ins of United States currency amounting to seventy-five cents ($.75) shall have been deposited in the corresponding slot on the Master Collection Box.dUring the then- current calendar day. e No person shall permit a vehicle within his control to be parked in any parking space alongside a meter during the restricted and regulated time applicable to the metered parking zone in which such parking space is located while the parking meter for such space indicates by signal that the lawful parking time in such space has expired. This provision shall not apply to the act of parking or the time which is required to deposit immediately thereafter a coin or coins in such meter. No person shall permit a vehicle within his control to be parked in any parking s~ace at the head of which is located a posted number during the restricted and regulated time applicable to the metered parking zone in which such parking space is located unless seventy-five cents ($.75) has been deposited in the correspondingly numbered slot on the Master Collection Box. This pro- vision shall not apply to the act of parking or the time which is required to deposit immediately thereafter seventy-five cents ($.75) in such numbered slot. No person shall park a vehicle in any such parking space for a consecutive period of time longer than that limited period of time for which parking is lawfully'permitted in the metered parking zone in which such parking space is'located. The provisions of -this Section shall not relieve any. person from the duty to observe other and more restrictive provisions of this Chapter pro- hibiting or limiting the stopping, standing or parking of vehicles in specified places or at specified times. Use of Slugs Prohibited. No person shall deposit or attempt to deposit in any parking meter o~ Master Collection Box any slug, button or any other device or substance as substitutes, for coins of United States currency. Tampering With Meter, Master Collection Box or Posted Numbers. No person shall deface, injure, tamper with, open or Qilfully break, destroy or impair the usefulness of any parking meter, Master Collection Box, or posted number. L. Special Penalty. Notwithstanding the provisions of Sections 18.1905 and 18.1325 of this Chapter, any person who violates subsections J and K of this Se~.tion 18.1322 shall be fined not less than five dollars ($5.00) nor more than two hundred dollars ($200.00) for each offense. It shall be the duty of the Police Department and certain designated employees of the Department of Public Works of the Village to i~sue citations to any persons who violate the provisions of subsections B, C, D, E and H of this Section. Such citations may be delivered to the violator personally or may be affixed to the vehicle of the violator. Nothing in this subsection shall be construed to abridge the power of a police officer ~ arrest any violator and take him into custody. nstallation of Master Collection Boxes, Posted Numbers and Par~ing Meters. e The V~llage Manager, with the approval of the Board of Trustees, shall install Master CollectiOn Boxes and posted numbers in the parking lots described in Schedule XV of the Appendix to this Chapter as provided in this Chapter. If the number of parking spaces in a parking lot exceeds the number of slots on the Master Collection Box or Boxes in that lot, then a parking meter shall be installed by the Village Manager, with the approval of the Board of Trustees, at the head of each excess parking space. The Village Manager shall have markings painted or placed upon the curb and/or upon the street or pavement adjacent to each parking meter or posted number for the purpose of designating the parking space for which said meter is to be used or to which such posted number applies, and each vehicle parking adjacent or next to any parking meter or posted number shall park within the lines or markings so established. The installation of parking meters and/or'Master Collection Boxes and posted numbers in Chicago and Northwestern Railroad Lots Nos. 1, 2, and 3 shall be subject and pursuant to the provisions of the agreement and lease with the Chicago and Northwestern Railway Company relating to the in- stallation of parking meters in such zones. The payment for such parking meters or Master Collection Boxes and posted numbers and their in- stallation under any contract or contracts hereto- fore entered into by the Village or hereafter to be entered into by the Village for the purposes of leasing, acqu±ring, installi~g, operating,'main- raining, supervising, regulating and using the parking meters or Master Collection soxes provided for herein, either for a trial period or otherwise, shall be only and solely from ~he receipts, funds and revenues obtained from the operation of said parking meters and Master Collection Boxes without in any manner obligating the Village to pay for the same from any other sources, and further that no revenue bonds shall be issued to pay.for any such meters. The operatioQ, maintenance and management of the parking system shall be under the supervision of the Village Manager, who shall see that said system is kept in good working and operating or~er and is managed to the advantage of the Village, and shall operate the system in an economical and efficient manner. pplication of Proceeds The Village Manager, subject to %he approval of the President and Board of Trustees, shall designate such collector or collectors and methods as are necessary to collect properly all coins deposited in the meter boxes and Master Collection Boxes. Such collector or collectors shall be only such employees as are now or may hereafter be duly bonded in a sum not less than one thousand dollars ($1,000.00) for the faithful performance of their duties. Ail monies so collected shall be deposited with the Village Treasurer, who shall credit such collections to ~he parking system revenue fund for the purposes set forth herein and shall submit a monthly report to the Village Board showing all revenues derived from parking meters and Master Collection Boxes. The coins required to be deposited in parking meters and Master Collection Boxes as provided in this Article are levied and assessed as fees to cover: The regulation and control of parking upon public streets; the cost of parking meters,Master Col- lection Boxes and posted numbers, their installation, inspection, supervision, operation, repair and maintenance, control and use Of parking spaces, and . regulating ~he parking of vehicles in metered parking zones; and the cost of acquiring, establishing, improving, maintaining and operating public ~ off-street parking facilities. The Village Treasurer shall pay from such parking system revenue fund the costs of any parking meters, Master Collection Boxes and posted numbers purchased by the ¥illage and incurred for their 'installation, inspection, service, supervision, repair and main- tenance, for making collections from such parking meters and Master Collection Boxes and for the enforcement of the provisions of this Chapter applicable to metered parking zones. The net pro- ceeds of the operation of the parking system in said parking system revenue fund, after the payment of such costs and expenses, shall be used for parking studies and for the acquisition, establishment, im- provement, maintenance and operation of public off-street parking facilities as the ~illage Board shall from time to time direct. The percentage of revenu~collected to beapplied to t~ecost of installation of meters and Master Collection Boxes in Chicago and Northwestern Railroad Lo~£ Nos. 1, 2, and 3 shall be thirty-three and one-third percent (133-1/3%) of the gross revenue as provided in the agreement and lease with the Chicago and Northwestern · Railway Company consenting to the installation of meters in said lots· 7 The parking meter fund shall be audited as a separa' fund at the time of the annual audit by the Village Proof of registration of a motor vehicle and proof of violation of this Section shall be construed as prima facie proof that the registered owner of such motor vehicle was the user or operator thereof at the time of the violation charged. S :CTION TWO: Schedule XV of Article XX of Chapter 18 (Traffic C ~de) of the Municipal Code of the Village of Mount Prospect be, t Le same is hereby, amended by deleting therefrom the words "Vi!la. ~ ~11 Parking Lot" under the c61umn headed "District or Street" and b~ deleting therefrom all the language opposite to the language 'illage Hall Parking Lot" under the column headed "Description". :CTION THREE: Subsection i8.1323.A, of Article XIII of Chapter 1 ?raffic Code) of the Municipal Code of the Village of Mount Prosp and is hereby, amended by inserting the language "or number ~sted" between the .words "meter" and "adjacent", so that said [bsection shall hereafter be and read as follows: ao To park a Vehicle in anyarea of such lot which is not designated (by lines or markings painted or placed on pavement, wheel stops, etc.) as a parking space and/or which space has no parking meter or posted number adjacel thereto for the use thereof. ~CTION FOUR: This Ordinance shall be in full force and effect nd after its passage, approval and publication in pamphlet form i he manner provided by law. ~ssed this 5th day of November , 1980.
