BUSSE AVENUE WHEREAS, Tod Curtis (who shall be referred to as "Petitioner" is the owner of a parcel of property !ccated at 18 W. Busse Avenue in the Village of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: The South i.ll feet of the West 37.37 feet of Lot Two and All of Lot Four in Mount Prospect Central District Sub division cf part of the West Half (1/2) of Section 12, Township 4t North, Range 11~ Bast of the third Principal Meridian, in Cook County, i!tinois~ as shown on Plat thereof registered on Dece~er 23~ 1949, as document ~t275902. WHEP~AS~ the Subject Property is located in the B-3 Business Retail and Service District under the provisions of the zoning Ordinance of the Village of Mount Prospect (hereinafter referre~ to as the "Zoning OrdinanceS') 7 and iWHEREAS, Petitioner has heretofore filed an application seeking the following variations from the provisions of the Zoning Ordinance: Variations from Section 14.2005.A.1 of Article XX and from Section 14.107.B.2 .of Article-i of the Zoning Ordinance to permit no parking spaces instead of the two (2) required due. WHEREAS, a public hearing was held on the Petitioner's request for the aforesaid variations, which request is known as ZBA-57-V before the Zoning Board of Appeals of the Village of Mount Prosp~ on January 22, 1981~ pursuant to proper public notice published in the Mount Prospect Herald on January 5~ 1981; and !WHEREAS, the Zoning Board of Appeals has recormmended to the Building Committee of the Board of Trustees of the Village of Mount Prospect that Petitioner's request for the afo_esaza variations, ZBA-57-V-80, be granted; and WHEREAS, the President and Board of Trustees have considered th Petitioner's request and reviewed the recommendation of the Village of Mount Prospect zoning Board of Appeals in ZBA-57-V-80 and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Peti- tioner's requested variations, that Petitioner has satisfied the standards for the grant of variations set forth in Section- 14.605 of Article VI of the Zoning Ordinance and find that it !would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested variations. OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK cOUNTy, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are incor- porated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant the following variations: Variations from Section 14.2005.A.! of Article XX of the Zoning Ordinance and from Section 14.107.B.2 of Article i of the Zoning Ordinance to permit no pa~king spaces instead of the two (2) required due. for a parcel of real estate legally described as follows: The South t.tl feet of the West 37.37 feet of Lot Two and All of Lot Four in Mount Prospect Central District Sub division of part of the West Half (1/2) of Section 12, Township 41 North, Range 11, East of the third Principal Meridian, in Cook County, Illinois, as shown on Plat thereof registered on December 23, 1949, as document #1275902. SECTION THREE: EXcept for the variations granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage,~ approval, and publication in the manner provided by law.
