HomeMy WebLinkAboutOrd 3099 04/08/1981 ~ 4/3/81 ORDINANCE NO. 3099 AN ORDINA~NCE GP~-NTING SPECIFIED VARIATIONS FR©!~ THE DEVELOP.~_--NT~ CODE FbR TF_E k%UENHORST PHASE THREE A PROPERTY WHE.REAS, Rauenhorst Corporation (who shall be referred to as "Petitioner") is the owner of a parcel of property located il the Vi!laqe of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property~) which is the subject of an Annexation Agreement_dated in May of 1950 by and between the Village of Mount Prospect, an Illinois municipal corporation, ~_Drican Nation, Bank and Trust Company of Chicago, a national banking associ~ tion, not individually, but solely as Trustee under a Trust Agreement dated February 10, 1979 and known as Trust No. 457' and the beneficiary thereof, Northern Illinois Gas Company, an Illinois corporation.and ~--he Rauenhorst Corporation; and W~E.~EAS, the Subject Property is legally described as follow: That part of the Northwest Quarter, and of the Northeast Quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, described as follows:' Beginning at a point in the South line of said Northeast Quarter which is 25.0 feet South 89 degrees 39 minutes 56 seconds East of the Southwest corner of said North- east Quarter; thence North 89 degrees 39 minutes 56 seconds West along the South line of said Northeast Quarter, and along the South line of said Northwest Quarter, a distance of 2004.46 feet to the East line of Kensington Center Phase One Subdivision, being a Subdivision in the East half of Section 34 in aforesaid Township and Range, and in the Northwest Quarter of said Section 35, according to the plat thereof recorded October 2, 1979, as Document No. 25173362; thence North 0 degrees 03 minutes 14 seconds East along the East line of said Subdivision, a distance of 876.52 feet to the South line of Kensington Center Phase Two Subdivi- sion, being also the South line of Kensington Center Resubdivision II, being a Subdivision and Resubdivision in part of said Northwest Quarter recorded June 2, 1980, as Document No. 25472808, and December 31, 1980, as Document No. 25722782 respectively; thence South 89 degrees 56 minutes 46 seconds East along the South line of said Subdivisions, a distance of 1024.99 feet to the Southeast corner~of said Kensington Center Phase Two Subdivision; thence North 0 degrees 03 minutes 14 seconds East along the East line of said Kensington Center Phase Two Subdivision, a distance of 270.39 feet to the most Southerly corner of Outlot 9 in said Sub- division; thence South 25 degrees 48 minutes 29 seconds East, a distance of 346.79 feet to the centerline of Feehanvi!le drainage ditch; thence North 63 degrees 47 minutes 00 seconds East along said centeriine of ditch, a distance of 791.87 feet to the intersection of said line with a line drawn 91.95 feet West of, and parallel with the East line of said Northwest Quarter; thence South parallel with the East line of said North- west Quarter, a distance of 195.27 feet; thence East, perpendicular to the last described line, a distance of 116.95 feet to a line drawn 25.0 feet East of and parallel with the West line of said Northeast Quarter; thence South along said parallel line, a distance of 1000.00 feet to the point of beginning, all in Cook County, Illinois. A variation from Section 16.405F3 of the Development Code to permit sto_~m..'water detention ~ond high water level to be located ntt less than twenty-five (25) fee from buildings. A variation from Section !6.405F3b of the Development Code to eliminate the requirement for rip rap in storm water detention ponds to be located on the Subject Property, provided, however, that Buyer shall provide rip rap in the stor~ water detention ponds at storm sewer inlets and outlets. A variation frcm SectioD 16.4!!G2 of the Development Code to reduce the design frequency of storm sewers to five (5) years~ A variation from Section !6.408A!0 of_the Development Code to permit cul-de-sacs to be located on ~e Subjec~ Property to extend to 800 feet. A variation from Section !6.408B8 of the Development Code to permit street'and road paving without the winter's delay provided in said Section, provided the weather pe~Lits such paving. A variation from Section !6.~14A! of the Development Code to permit sidewalks to be located on only one sid~ of each of the streets to be located on the Subject Property. i.REAS~ the Development Code provides in Section !6 206 that Plan Commission should consider and recommend to the Presi- and Board Cf Trustees of the Village of Mount Prospect whet ~at~cns from the Deyelcpment Code should be granted; and i.R~AS, the Plan Commission reviewed Petiticner's requested ~iaticns at its meeting of March 1.2, 1980 and ~om~ended to ~ne President an~ Board o: u-rustees of the iage that such variations be granted; and ?gAS, the President and Board-of Trustees have considered .itioner's request and reviewed the reco~endation cf %he Vi ~e of Mount Prospect Plan Ccr.~ission; and L~EAS, 5he President and Board of Trustees cf the Village cf ~n% Prospect have determined that it would be in the best ~erest cf the village of Mcun~ Prospect to grant Petitioner requested variations.
