HomeMy WebLinkAbout04/24/1990 COW agenda COMMII'IEE OF THE WHOLE AGENDA Meeting Location Meeting Date and Time Semor Citizens' Center Tuesday, April 24, 1990 50 South Emerson Street 7 30 P M I CALL TO ORDER - ROLL CALL II ACCEPTANCE OF MINUTES OF APRIL 10, 1990 III CITIZENS TO BE HEARD IV ORDINANCE REGULATING SALE OF TOBACCO PRODUCTS TO MINORS Th~s Ordinance is redrafted in accordance ',,nth the Board's input at the last Comnnttee of the Whole meeting Copies of the Schaumburg and Woodndge Ordinances are attached Attorney Hill vnll be present to review the raodlficat~ons made in our proposed Ordinance V ORDINAN(~E PROHIBITING FEEDING OF ANIMALS The Village's Health Inspection staff has received several complaints in the last couple of years from residents indicating that their next door neighbors feed ammals which cause a real health concern in a particular neighborhood We have had a couple of cases that have gone to Court where Judges have ruled to stop the feeding However, we find that our Ordinances were not specific enough in all cases, therefore, we are recommending that the attached Ordinance be passed by the Board which ~s a modification which adds Section 19 307, Feeding of Ammals and prohibits excessive feeding which causes a health problem for a neighbor VI DISCUSSION OF ORDINANCE AMENDING THE LIOUOR CODE (FINES AND COSTS) There are two items that are being recommended for cons~deration by the Board The first is to increase the dollar amount of a fine from the present m~x~mum amount of $1,000 to a mayamum amount of $2,500 As a home rule umt of government, we are permitted to raise our fines Several communities have raised their fine to the equivalent of one year's Liquor License fee The second area which is of major concern is the cost of holding a hearing In the past when we have found people guilty and fine them $1,000, our costs to hold that Hearing may actually end up being more than the fine itself This proxas~on will allow us to receive the costs to conduct the Hearing if no fine is issued, or to receive the Hearing cost in addition to any fine lewed VII DISCUSSION OF ENGINEERING SERVICES FOR A RATE STUDY ON FLOOD CONTROL Staff recommends that the Vfllage Board authorize the engineering firm of RJN Enmronmental, Inc, to conduct a Rate Study for Flood Control Sermces The attached memorandum from the Finance D~rector lndtcates reasons from a financml standpoint why tt would be benefic~al for us to have a Rate Study conducted When we look at a $5 nulbon Bond Issue, the cost to place that on the Tax Rate, would be approxtmately a $ 07 increase for a 20-year Bond Issue If, m fact, the cost for flood control ts a higher number as suspected, maybe as htgh as $15 rmlhon, that would mean a Tax Rate increase of $ 21 added on to our present Tax Rate Staff had tndlcated that there is a need to explore other avenues and opttons, ~n particular, the possiblhty of a surcharge to be placed on a single-family home and an eqmvalent amount to be placed on business or industrial property While thts ~s relatively new In the State of Ilhnols, there have been approximately 25 commumt~es throughout the natron who have done such a surcharge m thetr communities The Study would enable us to gather information and would give us enough money to fund the tmtial stage of any flood control project We also have to be concerned that there may be certain sections of the Village that are more affected than others and, therefore, a surcharge specifically to that section of town may be appropriate This mformatlon can be gathered through this Rate Study There w~ll be a d~rect Vfllage-wtde benefit to move ahead on flood control The Village would gain the reputation of being a pro-acttve commumty tn develop~ng soluttons to the problem of floodtng I am urging you to authorize RJN Environmental to conduct this study so that we would have thts reformation as soon as possible so that we can move ahead w~th a program once the engineering design work is tn hand I further beheve that using the design f~rm for this Rate Study would be beneficial to the Village VIII ANA E ' R IX ~,NY OTHER BUSINESS X AD.IOURNMENT 32[ EXECUTIVE SESSION - PERSONNEL DEFERRED ITEMS S~dewalk Policy on Major Roadways Crime StaUstlcs/Prevent~on Parking for Prospect Avenue
