FARLEY AND BOARD OF TRUSTEES VILLAGE MANAGER JULY 11,2003 REQUEST FOR CLASS R LIQUOR LICENSE BURRITO EXPRESS (CURRENTLY BABY LOU'S PIZZA), TWO WEST BUSSE AVENUE On Monday, July 7, the Village Manager met with Mr. Femando Perez regarding his request for the issuance of a new Class R Liquor License to be utilized in conjunction with the operation his proposed restaurant at the above location. The Class R designation provides for the serving of alcoholic beverages at dining tables only. Baby Lou's Pizza and Hot Dogs currently operates at this location. Mr. Perez is currently negotiating the purchase of the business and intends to convert it into a Mexican fast food/sit d own restaurant. Mr. Perez would like to offer beer, wine and Margaritas as an accompaniment to the food menu. Since 1998, Mr. Perez has operated a "Burrito Express" restaurant in the Village of Fox Lake, Illinois. He has held a Liquor License for that establishment since 2001. Mr. Perez reports there have been no violations or other problems with regard to the Fox Lake Liquor License. He plans to operate both locations. Other than some modest changes in d~cor, the restaurant will maintain its existing configuration. Mr. Perez plans to offer a lunch and dinner menu, seven days a week. The Class R designation provides for full service liquor at dining tables only. While the proposed cuisine would justify the sale of beer, wine and Margaritas, it would not lend itself to unrestricted hard liquor sales. Therefore, in order to accommodate the applicant's request, while at the same time limiting the scope of alcohol sales, staff would propose t hat t he issuance o f the C lass R contain a specific restriction Iimiting sales to beer, wine and Margaritas. Said restriction would be built into both the Ordinance creating the Class R License as well as the License that would be posted at the establishment. Mr. Perez is amenable to said restriction. he Village Manager discussed at length with the applicant the Village's particular sensitivities to the sale of alcohol to minors and over-service to clearly intoxicated individuals. The Manager also indicated that the applicant was responsible for the actions of all employees and managers. Mr. Perez indicated he had read the Village's rules and regulations in this regard and understood all of our requirements. The required application is complete and on file along with the payment of appropriate fees and other documentation. Mr. Perez has submitted to the required fingerprinting and background checks. The Village Manager recommends, a nd Mr. Perez agrees, that all managers who work at the Mount Prospect location must complete a certified liquor servers, training course and provide proof of same to the Liquor Commissioner. If the Village Board considers this request favorably, adoption of an Ordinance creating a new Class R Liquor License with the aforementioned restrictions would be appropriate. MEJ/rcc ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 13 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ON E: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized. Said list is hereby amended b y increasing t he n umber o f C lass R with Restrictions (Beer, wine a nd Margaritas only) Liquor Licenses by One (1) Burrito Express, Two West Busse Avenue: Said liSt is as follows: Zero (0) Class A License Two (2) Class B Licenses Nine (9) Class C Licenses One (1) Class D License One (1) Class E License One (1) Class G License Zero (0) Class H License Zero (0) Class M License Zero (0) Class MH License One (1) Class P License Fourteen (14) Class R Licenses One (1) Class R (with restrictions: Beer, wine, Margaritas only) License Fifteen (15) Class S Licenses One (1) Class T License One (1) ClaSs V License Five (5) Class W Licenses Zero (0) Class XX License (with conditions as attached to License SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided bY law.
