HomeMy WebLinkAboutOrd 3169 12/15/1981 RDIN~NCE NO. $169 ~N ORDINANCE TO .~ND ARTICLE I OF CHAPTER 13 ENTITLED "ALCOHOLIC LIQUOR DEALERS" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: Article I of Chapter 13 entitled "Alcoholic Liquor Dealers" of the Village Code of Mount Prospect, Illinois is hereby amended as follows: "A. By amending Section 13.105 entitled "Term-Pro-Rating Fee" to read: "Sec. 13.105 Term-Pro-Rating Fee Each license shall commence on May 1 and shall terminate on April 30 next following the date of issuance. B o License fees shall not be prorated except in - in the following instances. Where the license is obtained after January 1 of any license year the fee shall be reduced in proportion to the number of full calendar months that have expired in the license term. 2. Where the license is returned by. the license holder upon tbe permanent closing of his business, and not upon the sale or transfer of the business or assests thereof, the fee paid shall be returned in proportion to the number of full calendar months which have not expired in the license term." By amendin9 Section 13.106 entitled "Licenses and Permits" to change the license classification for a CLASS "C" license in subsection A.1. to read: "CLASS "C" License which shall authorize the Licensee to sell and offer for sale at retail in the premises specified in such license alcoholic liquor in its original package only. Samplings of alcoholic liquor in conjunction with sales promotional efforts shall be allowed pursuant to the regulations contained in Section 13.113 of this Chapter." By amending Section 13.113 entitled "Consumption on Premises" to change subsection B.1. thereof to read: "1 o The Local Liquor Commissioner, however, may grant a daily permit to any Class C or Class V Licensee under this Chapter which permit shall authorize %he donation, without charge, ~of alcoholic liquor or wine by such licensee in small and limited amounts for sampling purposes only in conjunction with sales promotional efforts on the licensed premises of alcoholic liquor or wine in the original package for consumption off the premises; which permit shall include the following conditions and limitations. The sampling shall be attended and supervised by a full-time employee and only in a designated area on the licensed premises as stated in the license; he actual amount of alcoholic liquor or wine sampled by an individual may not exceed an ounce; The sample shall be served in a container which shall be disposed of following the the sampling; ~nere shall be no advertising of the availability of "sampling" by advertising materials visible outside the licensed premises; and e. There shall be a permit fee of $10.00 per day for the issuance of such permit." SECTION 2: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form in accordance with law.
