HomeMy WebLinkAboutOrd 3191 03/02/1982 RDINANCE NO. 3191 AN ORDINANCE TO AMEND ARTICLE VII ENTITLED "COIN-IN-SLOT DEVICES" of CHAPTER 1I OF THE VILLAGE CODE OF MO~T PROSPECT, ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUST.EES THE 2nd DAY OF March ~ 1982 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois the 3rd day of March , 1982o /22/82 ORDINANCE NO. 3191 PM ORDINANCE TO AMEND ARTICLE VII ENTITLED "COIN-IN-SLOT DEVICES" OF CHAPTER I1 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Article \~i entitled "Coin-In Slot Devices" of Chapter !1 of the Village Code of ~unt Prospect, Illinois, 1981, is hereby amended as follows: By amending subsection A.5. of Section 11.703 entitled "License Fees" to read: "Ao5. Pinball electronic game and other amusement devices ~ $150.00 per device" By adding a new subsection E to Section 11.705 entitled "General. Operating Requirements" to read: The following geDeral operating requirements · shall apply to the operation and mainten- ance of pin~a!l, electronic game and other amusement deVices: e No amusement device shall be permitted where the reward for skill'in the operation thereof is not plainly posted ~pon each such machine or device or where the opportunity of a reward for skill in the operation thereof is not the same for each individual player. No gambling or individual wager on any amusement device shall be permitted~ and if any such device provides re- plays no person, firm~ corporation or licensee shall buy back replays. Nc amusement device £h.~l] be placed in any required exit path of travel in any establishment. No amusement device located within ... · an establishment possessing a retail alcoholic liquor license shall be opera- ted by anyone under the age of 21 years, unless such person is accompanied by a parent or adult guardian. A minimum of forty (40) square feet of floor area shall be devoted to each amuse- ment device, and such area shall in- clude each game device a~its i~-nnediate v~cinity and may include aisles. The location, operation and maintenance of an amusement device for use by the public shall be subject to the provis- ions and regulations of Chapter I4 'of this Village Code pertaining to.zoning, and where such devices exceed six (6) in number the location, operation and maintenance of the same shall be further subject to the annual license provisions and other regulations of Article VIII of this Chapter." y adding a new Section li.708 to be entitled "Penalty - Suspension or Revocation of License" and to read as follows: "Sec. 11.708. Penalty - Suspension or Revocation of License. Any person, firm, or corporation, or any licensee herein who violates any of the provisions of this Article shall, on conviction, be subject to a fine of not more than $500 for each such violation. Any licensee so convicted of violating a provision of this Article may, in addition, be subject to having his licenses for all coin-in-slot devices suspended for a period of not to exceed one year or Of having the same revoked by order of the Village Manager." D. By adding a new Section 11.709 to be entitled "Appeal" and to read as follows: "Sec. 11.709. ApDeal. In the event that a license provided for herein is suspended or revoked by action of the Village Manager pursuant to Section 11.708 hereof, the Village Manager shall notify the licensee in writing of such action and the reason therefor, and the licensee shall have the right, within ten days follow- receipt of such notice, to appeal the decision of the Village Manager to %he President and Board of Trustees, which shall consider the appeal and either approve or deny the same." IECTION TWO: This.
