CONSOLIDATE FIVE LOTS TO CREATE A THREE-LOT SUBDIVISIO~ DENNIS MILLER - APPLICANT The Planning & Zoning Commission transmits their recommendation to approve a plat of resubdivision as described in detail in the attached staff report. The Planning & Zoning Commission heard the request at their May 22, 2003 meeting. The Planning & Zoning Commission briefly discussed the proposed plat. The Commission noted that the project was thoroughly reviewed and discussed in great detail when it was originally proposed and that the resubdivision was a condition of approval of the project. They noted that the petitioner was not seeking relief from Village Codes and that the plat was prepared according to the Village's Development Code regulations. The Planning & Zoning Commission voted 7-0 to approve the plat of resubdivision for the property located at 105 E. Prospect Avenue. Please forward this memorandum and attachments to the Village Board for their review and consideration at their June 3, 2003 meeting. CT: PC-03-99 - MILLER RESUBDIVISION (3-LOT SUBDIVISION) 105 E. PROSPECT AVENUE (5-UNIT TOWNHOME PROJECT) BACKGROUND A public hearing has been scheduled for the May 22, 2003 Planning & Zoning Commission meeting to review the application by Dennis Miller (the "Petitioner") regarding the property located at 105 E. Prospect Avenue (the "Subject Property"). The Petitioner received Conditional Use approval for a planned unit development and was required to resubdivide the Subject Property to create a 3-lot subdivision. The plat request was properly noticed by posting a Public Hearing sign on the Subject Property. PROPERTY DESCRIPTION The Subject Property is located at the southeast comer of Emerson Street and Prospect Avenue and currently contains a restaurant (Mrs. P& Me), a mixed-use building (commercial and residential), and a vacant lot. The Subject Property is zoned B5 Central Commercial Planned Unit Development and is bordered on all sides by the B5 District. SUMMARY OF PROPOSAL As you may recall, the Village previously granted approval for the 5-unit townhome (row houses) development. As part of that approval, the Petitioner was required to resubdivide the Subject Property so that the existing restaurant would be located on one lot of record, the mixed-use development on a second lot of record and the townhomes on a third lot of record. The plat under review changes the site from five lots of record to three lots of record. The plat includes easements as required by Village Code and ensures safe access to the townhomes and existing uses. Other Departments have reviewed the plat and found that it was prepared in accordance with Village Codes. RECOMMENDATION The proposed Plat of Resubdivision seeks to create 3-lots of record. The plat and new lots comply with Village regulations and the Petitioner is not seeking relief from the Development Code. Based on these findings, Staff recommends that the Planning & Zoning Commission recommend the Village Board approve the Miller Resubdivision plat, Case No. PC-03-99. The April meeting minutes were approved 6-0, with one abstention by Matthew Sledz. At 7:32, Ms. Juracek introduced Case No. PC-03-99, a plat of resubdivision. Judy Connolly, Senior Planner, presented the case. She explained that the petitioner received conditional use approval for a planned unit development and was required to resubdivide the subject property to create a 3-lot subdivision. There were no questions or comments. Joe Donnelly moved to approve the request for the Millers Resubdivision, Case No. PC-03-99. AN ORDINANCE PERTAINING TO A DETERMINATION OF THE PREVAILING WAGE RATES WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and other works employed in any public works by the State, County, Village or any other public body or any political subdivision or by an one under contract for public works," approved June 26, 1941, as amended (820 ILCS 130/1); and WHEREAS, the aforesaid Act requires that the Village of Mount Prospect of Cook County investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said Village of Mount Prospect employed in performing public works projects for said Village of Mount Prospect. BE IT ORDAINED BYTHE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: To the extent as required by "An Act regulating wages of laborers, mechanics and other workmen employed in any public works by the State, County, City or any public body or any political subdivision or anyone under contract for public works," approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in the construction of public works coming under the jurisdiction of the Village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook County areas as determined by the Department of Labor of the State of Illinois as of September 1, 2002, a copy of which wage rates are on file in the Office of the Village Clerk. The definition of any terms appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in said Act. SECTION TWO: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertain to any work or employment except public works construction of this Village to the extent required by aforesaid act. SECTION THREE: The Village Clerk shall publicly post or keep available for inspection by any interested party in the main office of this Village this determination of such prevailing rate of wages. SECTION FOUR: The Village Clerk shall mail a copy of this determination to any employer, and to any association of employees and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affect by such rates. Page 2/2 Prevailing Wage - 2003 SECTION FIVE: The Village Clerk shall promptlyfile a certified copy of this determination with both the Secretary of State and the Department of Labor of the State of Illinois and shall further cause to be published in a newspaper of general circulation within the Village, a copy of this determination which shall constitute notice that the determination is effective and that this isthe determination of the President and Board of Trustees of the Village of Mount Prospect. The following list is considered as those days for which holiday rates of wages for work performed apply: New Years Day, Memorial/Decoration Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, Christmas Day. Generally, any of these holidays which fall on a Sunday is celebrated on the following Monday. This then makes work performed on that Monday payable at the appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration such as the day after Thanksgiving for Veterans Day. If in doubt, please check with IDOL. EXPLANATION OF CLASSES ASBESTOS - GENERAL - removal of asbestos material from any place in a building, including mechanical systems where those mechanical systems are to be removed. This includes the removal of asbestos materials from ductwork or pipes in a building when the building is to be demolished at the time or at some close future date. ASBESTOS - MECHANICAL - removal of asbestos material from mechanical systems, such as pipes, ducts, and boilers, where the mechanical systems are to remain. CERAMIC TILE FINISHER The grouting, cleaning, and polishing of all classes of tile, whether for interior or exterior purposes, all burned, glazed or unglazed products; all composition materials, granite tiles, warning detectable tiles, cement tiles, epoxy composite materials, pavers, glass, mosaics, fiberglass, and all substitute materials, for tile made in tile-like units; all mixtures in tile like form of cement, metals, and other materials that are for and intended for use as a finished floor surface, stair treads, promenade roofs, walks, walls, ceilings, swimming pools, and all other places where tile is to form a finished interior or exterior. The mixing of all setting mortars including but not limited to thin-set mortars, epoxies, wall mud, and any other sand and cement mixtures or adhesives when used in the preparation, installation, repair, or maintenance of tile and/or similar materials. The handling and unloading of all sand, cement, lime, tile, fixtures, equipment, adhesives, or any other materials to be used in the preparation, installation, repair, or maintenance of tile and/or similar materials.
