AT 310 WEST NORTHWEST HIGHWAY, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS I WHEREAS, the owners of certain property hereinafter .~escribed, located at 310 WeSt Northwest Highway, in the Village .6f MOunt Prospect, Illinois, and commonly known as the Winklemann I~ervice, Inc. ,have filed an apPlication seeking a variation from ~he provisions of Article III, entitled "Signs and Awnings" of !Chapter 9 of the Village Code of Mount Prospect, Illinois; 1nd WHEREAS, the Subject Property is to be described as Follows: Lot 1 in Winkelmann's Resubdivision of Henry J. Ehard's Subdivision of that part of the Northeast Quarter (1/4) of Section 11, Township 41 North, Range 11 East of the Third Principal Meridian - Recorded November 16, 1978 as Document 24721954, in Cook County, Illinois. WHEREAS, Petitioner seeks a variation from the sign equirements set forth in Section 9.307 of Article III of ~hapter 9 of the said Village Code, and specifically, sub- ~ections E.4.A.1 and B.3. thereof to allow the erection of freestanding pole sign approximately 12 feet from the prop- rty line of the subject property; and WHEREAS., a public hearing was held on Petitioner's t~equest for the aforesaid variations (deSignated as Case No. ZBA-5-V-82) before the Zoning Board of Appeals of the Village ~f Mount Prospect on the 25th day of March, 1982, pursuant no due and proper notice thereof published in the Mount 'respect Herald on March 8, 1982; and WHEREAS, the Zoning Board of Appeals has recommended ihat the Board of Trustees of the Village of Mount Prospect ~rant' Petitioner's request for a sign variation upon the ~ondition that the subject pole sign would also incorporate ~he gasoline price signs presently erected elsewhere on the ~roperty in order to reduce the number of signs located on ~he property, and that the existing signs painted on the ~tructure located on the property be removed and that the ~ubject pole sign be located in conformity with a site plan ~o be submitted to and approved by the Community Development )epartment of the Village prior to the installation of the ~ubject sign; and WHEREAS, the President and Board of Trustees of the Tillage of Mount Prospect have determined that the Petitioner's ;ariation request satisfies the standards set forth in Section [4.605 of Article VI of the Zoning Ordinance, and further find ~hat it would be in the best interests of the Village to grant the Petitioner the requested variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporate( herein as findings of fact by the President and Board of Trustee~ of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the property hereinabove described the variation requested with respect to SeCtion 9.307, subsections E.4.A.1. and B.3. of Article III of Chapter 9 of the Village Code of Mount Prospect, Illinois, to allow the installation of an 18-foot high freestanding pole sign approx- imately 12 feet from the property line of the subject property upon the conditions that said pole sign shall also incorporate the gasoline price signs pertaining to the operations of the property, that all existing signs painted upon the structure located on the property in question shall be removed, that the pole sign shall be located in conformanCe with a site plan submitted to and approved by the Community Development Department of the Village, and that said site plan shall also include provision for landscaping or beautification of the subject property. SECTION THREE: ExcePt for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and reg- ulations shall remain in full force and effect as to the sub- ject property. SECITON FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
